Actually I think I was wrong about the type of visa. I think she will be applying for the IR-2 visa.

My wife's daughter lives in the Philippines and we are filling out an Affidavit of Support and Consent so she can get a passport. We are wondering if she will need a DSWD clearance. She does not have a visa yet but she will be getting one after the I-130 is approved. On the DFA website it says that there is no need to secure a DSWD clearance if the minor traveling abroad has parents who are in the Foreign Service or living abroad or are immigrants, provided he / she is holding a valid pass such as a dependent’s visa / pass / identification card or permanent resident visa / pass / identification card which serves as proof that he / she is living with parents abroad.

The part that I am unsure of is what type of visa she will be getting. Her mother is a permanent resident and I am a U.S. citizen. I'm guessing that she will need to get a Family Preference Immigrant Visa but I'm not sure if that's correct. If that is the case then will she need a DSWD clearance to come to America unaccompanied?

Can I petition for my wife's kids from the Philippines? My wife just got her green card and now we are filling out the I-130's. Can I be the petitioner and check child for who I'm petitioning?

Yes they are on the I-129f. My question is whether or not it is too late for them to be issued a K2 visa based on the eligibility of the I-129f or if we have to petition with the I-130 now since it will be one year from the time the K-1 was issued to my wife on 3/5. I'm wondering if we were to pay the fee for the interview now and get it scheduled before 3/5 would they be aloud to get the K-2 visa and enter the US or do they have to actually have the K-2 visa in hand and then enter the US before 3/5? It looks like Hank answered that for me though.

I was wondering if it is too late for us to get K2 visas for my wife's kids using the I-129f petition? It's 2/27 today and my wife's visa is going to be one year old on 3/5 I believe. What needs to be done before the one year is up? Do the kids have to be in the US within one year of the K1 visa being issued or do they just have to have the interview schedule within the one year?

1. My wife's interview for AOS is coming up on feb. 26. They gave us a checklist of everything that we need to bring and one of the things it says is to bring evidence of joint accounts. We don't really have any joint accounts or anything. The only thing we have is a family cell phone plan and gym memberships but we don't have a joint bank account and her name is not on the lease for our apartment or anything like that. Is it crucial that we have these things?

2. Also, the checklist says to bring all documentation establishing her eligibility for Lawful Permament Resident status. What documents are they talking about?

I recently got out of the military and I'm going to school using the Post 9/11 GI Bill. During the semester I receive a monthly Housing allowance. With my housing allowance and my part time job I make more than the 125% poverty guideline. But without my housing allowance I don't make enough.

Can I include my Housing allowance as a source of income on the I-864 and, if so, how can I show proof of it? Would I just give them copies of my bank statements showing the direct deposits? Other than that, I don't get anything in the mail from them. The money is just deposited directly into my account and that's it.

My wife got here back in April on the K-1 visa and now we are married and we are going through the AOS process. I keep reading that once you get here you are suppose to change your address on USCIS. It said that she was suppose to do it within 10 days of her arrival here (oops). I never heard that until now, and when I went on the USCIS website to change her address it does not allow us to enter her old address. Her old address is from the philippines, and her zip code is 4 digits. It says the zip code must be 5 digits. Can anyone tell us what we should do?

I was just reading the instructions for all the forms we need to file and I am confused about the filing fee for the I-765. In the instructions for the I-485 it states "

NOTE: You may file Form I-765, Application for Employment Authorization, and/or a Form I-131, Application for Travel Document, without fee, if you file Form I-485 and you pay its required fee." On the instructions for the I-765 it states

"If this is a renewal application and you are applying under one of the following categories, a filing fee is

not required:

1.

(a)(8) Citizen of Micronesia, Marshall Islands, or Palau;

2.

(a)(10) Granted Withholding of Deportation;

3.

© , ©(4), or ©(7) Dependent of certain foreign

government, international organization, or NATO personnel;

4.

©(9) or ©(16) Adjustment applicant who applied after

July 30, 2007"

So in the instructions for the I-765 it says the filing fee is not required IF IT IS A RENEWAL APPLICATION, but it does not say that it is not required if it is an initial application. And the instructions for the I-485 don't say that it has to be a renewal application to file without a fee.

So my question is: Since we did not file the I-765 before, do we need to pay the filing fee even if we file it with the I-485?

My wife and I just got married and now we are beginning the AOS process. My question is for all the filipinos/as. My wife says that in the philippines when you get married your maiden name becomes your middle name. When we apply for adjustment of status is it ok for her to put her maiden name as her middle name, and my last name as her last name?

Today my fiance got a message from the embassy that said she can pick up her passport at 2go or whatever it is. Now she has the passport and a packet that says do not open and neither one of us knows what we are suppose to do now. I read something about a mandatory CFO guidance and counseling session. The only place I read that is on visajourney but I haven't read it anywhere else. By the way, my fiance is telling me that her visa has an expiration date of 17 April 2014. This doesn't make sense to me because I read somewhere that we have like 6 months after the visa is issued for her to get here.

Believe me...I had undergone 3-day sputum smear collection and sputum culture. To be exact, the amount is 490pesos..

Yes that's what my fiance had to do. She just did the 3-day sputum test. How long did you have to wait after your sputum tests for the results?

My fiance in the philippines went to her medical exam and didn't pass because they wanted to test her lungs. So they did sputum tests and they said it's going to be like 2 months until they find out the results. Then one of the nurses told her that the next time she comes back she should bring 500 pesos for a pregnancy test. Now I'm confused because I thought the $223 we paid at the beginning covers everything for the medical exam. Is it normal for people to pay more?

Ok my fiance called the embassy and they told her that her petition will be automatically extended every four months up to one year.

My fiance in the Philippines went to the medical exam and they told her there's something abnormal on the x-ray of her lungs and now she has to go back there THREE TIMES to get a sputum test. Her interview was going to be November 21 and the I-129F is going to expire on November 23. They told her to call the embassy to cancel her interview. I know that only a consular can extend the validity of her I-129F. Is there anyone who knows how we get that to happen?

The medical exam is first come first serve so you can go there Monday through Friday and they are open 6 AM TO 4 PM. The date that I chose was referring to when my fiance plans to depart for the U.S.

since you were in the military in 2013,

you are evaluated for that income at the poverty level, not at 125 percent of the poverty level.

So, take your final LES statement, look at the biggest number there, and tell us if it's OVER the poverty level or no.

I would say that this year I definitely made over the poverty level. But my problem is that when I fill out the I-134 it asks who my current employer is. I don't even have a current employer right now. If I give them my last LES statement will they overlook the fact that I am separated from the military and currently unemployed?

Mother-in-law His mom helped us out for our K1 and now our AOS. Just go ahead with having a co-sponsor and take your chance like we did.

Regarding the co-sponsorship, it has always been a 50-50 chance of them accepting it or not. However in our case, they accepted my MIL to be the co-sponsor and they approved us, yet we were worried that they wouldn't accept it as well. You could always try and have a co-sponsor that is a family member, just bring all the supporting documents. It's still a chance though.

Maybe some of the other member could give you their two cents regarding the I-134 concern.
