  1. Filed in January (NOA1 in march 7) for my 4 stepchildren at VSC and the date they are working on hasnt changed in all that time? Has anyone on here seen anyone processed & approved for anything closer to 2008?

    PS... my wife, Lucita and I are very happily married still after all this time...sorry to hear about those who are not :( on the forums.

    Any info would be appreciated...but from my recollection of the USCIS they have gone on extended vacation or something :(

  2. Its official she is a perm resident so the discussion is academic. We will go the I-130 route.... they say it will take 12-14 months after we file....this is not entirely a bad delay in that it will allow Lea, Rachel, Russell, and Randolph to finish more of their studies (Lea is actually a HS graduate and in college at 16! Rachel will be a HS graduate in March).... we at this end are sad by the time delay but God's plan is always in motion even if we fail to understand it and nor do we need to.

    As far as the land sale... I am disabled (2 total hip replacements :( ) and we as a family here (Mom is 83) have had a rough time here in Florida since one particular Cat 4/5 hurricane came ashore at our place... our finances were weak as a result.... bringing all four of our children over would have likely resulted in denial due to income. And for quite a while they were not wanting to come to the US (citing that they wanted to finish their studies including college) so we a long period of time that we didnt know what to do...

    I love them and wish they could be here tomorrow...but doing things recklessly/fast is not usually the right way..... they have a home to live in that Lucita bought & paid for, so at least they are in a stable and happy (not as happy as here though I hope & pray!) environment...

  3. If you listed all the children on the I-129F, then they would be eligible for K-2 Visas.

    I listed my daughter on my I-129F, but she did not accompany me to the U.S. She came later as she wanted to finish school in Canada. We obtained her K-2 Visa within one year of my K-1 Visa.

    The problem is that the K-2 Visa must be ISSUED (in hand), NOT just applied for, within 1 year of the K-1 Visa. I doubt very much that your wife would be able to finish the K-2 process before April 26th, 2007 (which would be 1 year from the date her K-1 was approved). You could, however, check with the Consulate where she was interviewed for her K-1 Visa to find out if her children's K-2 interviews could be done before the year is up.

    So, unfortunately, your wife will now have to petition for her children under the "family class" of immigration. I do not know a whole lot about that process myself, but if you read the "Guides" and "FAQ" sections here on VJ, you will probably find the answers you need.

    What if we were to submit the K-2 papers anyways and get them into the system before the 1 year anniv? If we had submitted the papers 6 months ago there would have beena good chance they would not have been approved by then anyways!?

    Also when she has her Adjustment of status completed, how long then would it take for her minor children? We dont want this to take too long...no more than at year at most (less would be better)

  4. Hi...our I-129F was approved on of March 9, 2006. Her K1 was approved April 26th,2006. Lucita has been going through the AOS status also...and from a online notice she has been approved just Friday.

    We had been waiting for a land sale here in Florida before submitting the papers within the 1 year limit... Our children (I am their step-Dad which I know makes a difference in the eyes of the USCIS) are listed on the I-129F but due to our financial situation we feared complete denial if we didnt wait until the land sale was complete to file the additional papers to start their process that we have 1 year to start according to this site. My wife has been a foriegn worker in Mexico (she is from the Philippines) supporting her children (Lucita is widowed and her sister has taken care of the children) and even bought a house which is owned in Cavite free & clear on her own.... Im sure many of you know how many Filipinos & filipinas have been forced to work abroad to support their families.

    NOW the land deal is closed (real estate market has been bad sadly)... and the 1 year time limit is virtually upon us....Lucita was approved April 26th, 2006 at the consulate for her K1..... we wish to file the papers for our children and would greatly appreciate any advice and the precise papers to file. We (after reading visajourney) believe the I-130 is the correct papers..... but Please help us be sure...and tell us anything that may be of help....

  5. We have a home we own in Northern Ontario (near Sault Ste Marie point of entry) whcih we have owned since before I met my beautiful wife, Lucita (and I Thank God for the many Blessings that he has allowed me and my family to recieve)! Our main home is in Southwest Florida.....

    Lucita has a Advanced Parole good for multiple entries (we stated the random dates and times of our vacations to there and of course the reality of the current hurricanes hitting florida more frequently forcing us to consider our northern home our "sanctuary" - After hurricane charley hit in 2004 we were forced to flee for 1 month as we had no electricity or anything)....

    MY QUESTION IS..... How easy or complicated will Lucita's entry INTO CANADA be? I had never really considered this aspect of traveling there since it is a non-issue for US citizens...

    Lucita is in the process of Adjustment of Status (in fact we have gotten a RFE so we are certainly being looked at) and Biometics was in October..BUT clearly at this present moment she has NO Green Card. What she does have s a valid Philippine passport with the k1 visa stamped....a marriage certificate of our marriage in June 06, and all the other USCIS papers such as the NOA1s from EAD, AOS, and AP. and the RFE from AOS, the approved AP notice (which I assume means her AP papers will be here anytime now).... we truly will likely not travel til summer which will mean green card is approved...but if we were to travel in say Jan or Feb...ws just curious what we should anticipate.

  6. I'm glad things worked out for you! That would have been incredibly stressful. Way to go! Congrats! I have a question since we'll be heading to Juarez, most likely later this summer. It sounds like they let you into the Consulate. Was that because of the extenuating circumstances with the consulate closing or have they started letting in the USC? Thanks in advance.

    Yes i think it was due to the circumstances and gods blessings....things could have been FUBAR!

  7. Just wanted everyone to know that Lucita was approved on April 26th in Juarez Mexico..we crossed overed the following afternoon into El Paso, Tx and flew home to Punta Gorda, Fl on the 29th!

    BUT THINGS ALMOST went HORRIBLY WRONG!

    Called the Juarez Consulate a week or so before to verify procedure and to make sure there were no problems with the weeks of the 26th (no holidays etc and yes I read the website but never trust those!) Arrive on the 25th in the afternoon and Lucita arrived in the early evening from Merida....

    Plan is simple... Wednesday - medical, Thursday - Interview, Friday - extra day in case a delay occurs for interview

    Wednesday morning Lucita goes to medical (the one directly next to the consulate)... I am walking around nerviously outside and meet a couple of guys waiting for their fiancees already in consulate...after a brief exchange I realize the consulate decided like one or two days ago (literally the day before my flight I guess) to close on the 27 and 28th! They were almost screwed by this change.... so now I am in a Panic!!!!!!

    Went to medical and whisked Lucita out of the place (she was just finished....come back at 2pm for the envelope they said.I wanted to smack them as there was no more than 2 or so people there that day....clearly word was out in Juarez about the consulate closings BAH!)

    talked to the first security guard at consulate I found..... sorry sir you are out of luck (screwed!!!) was more or less the attitude.... so I went to the main door and pitched a fit (more like a whine!) about how we followed all the procedures etc on verifying consulate closing dates etc and that none were for these dates when checked the week before. He said I was correct and that they made this closing decision only literally the day before I traveled to Juarez and that he sympathized.....happened that this guard was either higher up than some of the others or perhaps he was more forceful...but he GOT US INSIDE and in the Queue. Of course now our money order from bananamex was well STILL AT BANANAMEX (afterall as Visajourney guide says, get this on day of medical - a nice relaxing day before interview) fortunately they gave me a PASS so I could leave and go to the banamex and get the money order (also had to go to our rooms to get rid of all our electronic gear phones etc....)

    I asked another guard for directions to Banamex and he said its "only 2 blocks this way" so I decided to walk it...... well more like 1 or 2 miles THIS way was the truth and I was none too pleased since I was terribly afraid any delay would cause Lucita to be tossed out of the consulate! So upon arriving that ask for Passport Please....sure thing here is My passport...nope they wanted HER passport.... Great THATS with her in the consulate!!!! Well they really wanted her passport number....so now Taxi Ride to the hotel to drop off electronic gear....then to the consulate...got the passport number (the guards were great about it!) and taxi BACCCCCCCCCCKKKKKKKK to bananamex and got the money order...taxi back to consulate!!!

    BY the way tip on taxis.... never let them set the price...I paid $10 Total to go to bananamex to the hotel and back to consulate (10$ for the whole trip taxi driver waited for me)which is much better than the rediculous prices they all wanted to set which was like a lot more...

    In the consulate now...finally...but still no medical cuz its still not 2pm...so they give me another pass to go when the time comes...after gaining the medical we proceed through the various waiting rooms...and queues.....

    In the evening (lol I am usually the most impatient person in the world in lines... but like i said time and time again to Lucita "When God provides you a miracle you wait patiently as long as you need to" and I did!) Interview window was called with our name (hard for you to hear the names depending on the noise level and the person who calls it out).... after a couple mins we are told to wait some more..then they call us up again (nervous level is high of course!) and guy asks questions.... I ask if I may ask a question and when given permission I ask and his answer i realize is "As if she is approved" which she was! :)

    We were the LAST Approved Visa to walk out the door.....literally!!!!!!!!!!!!!!!!!

    Now the AOS begins.... hoping I can get Lucita permission to travel to Canada fairly quick as our nothern home is in Canada PLUS when the hurricanes come anywhere near us in Punta Gorda, Florida we evacuate that way....Hurricane Charley made a direct hit here as a cat 4/5 storm in aug 2004 and I will never again allow my family to "ride out another" storm like that....

  8. Ive read all on the official Juarez site and I must admit I am confused... WHAT do i need to bring??? And what form do I use for the support? I know each consulate wants specific forms... which does Juarez want?

    Here is what we are bringing:

    Originals of....

    NBI Police Papers (philippines)

    Mexico Police papers

    Birth Certificate of Lucita

    and even though the children not coming to USA we have their birth certificates too

    marriage certificate & death certificate (she is a widow)

    Official NOA2 from USCIS

    Official Approval from NVC

    Photos of us together

    some envelopes (fedex) of us sending to each other... MOST of our correspondence has ben online or on phone cards

    Pictures (but arent these already in K1 packet we submitted?)

    Passports (both hers and mine)

    Lucita's Mexico FM3 visa

    I also have still two complete "backup copies" of everything.....and I will take ONE of the two with me also to Juarez....

    ALSO what is best place to stay close to consulate? and do they have Internet in rooms? :)

Lucita & I are getting a pre-nup...we wanted the blessings of my family and that was the only request they had... of course in my heart I know we will never seperate from each other... but my family seemed unanimous that sometimes life tosses you a curveball that ends up being a hand grenade so consider a pre-nup as body armor lol... and I do have some assets (25 acre waterfront ranch on florida - http://www.pantherranch.com and a home on lake superior in paradise - Sault Ste Marie ontario http://www.goulaisriver.com) websites are old and not finished....lol

  10. Congratulations to the both of you! :dance: let me see, you said 94 days, that's the average number of days to receive the NOA2. May i know when was your receipt date (NOA1)..? Our (my fiance and I) receipt date was december 8, 2005.. so it should arrive 2mrw or march 12 already. Still no signs regarding our NOA2 though.. it's driving me crazy! :wacko: If you would pls tell me what's your receipt date? It would probably make me feel better. Thank you very much.

  11. After 94 days of nailbiting and praying... Lucita & I were greeted with our NOA2 Approval email this morning (Dated March 9, 2006)...and this was after a RFE a week ago....so itis true about the quick approvals when you respond to the RFE...

    So hopefully the NVC will forward our case to Juarez, Mexico fast...so we cab get our airline tickets and go as soon as Juarez acknowledges that they have the papers (thank God no appointment required at Juarez!) And after a successfull interview (God Willing!) we will fly back to Florida together to begin our life together (and all the other paperwork but at least no more Time of Seperation)

    Well after 94 Days from our NOA1 I am VERY HAPPY to report that we got our NOA2 email last night dated March 9!!! Thanks God! And also Thanks to you all for your support in the CSC/TSC List!

    I guess now NVC soon and then off to Juarez Mexico for the interview (I guess I get to stand across the street, But I shall be there for moral support for Lucita!)

  13. Sent RFE back to them overnight on Thursday of last week...

    RFE is they wanted more evidence that we met... I guess the 15 photos I sent were not dated (and yet they were)......

    I sent my passport pages with dates of enty/exit stamps... copies of the credit card bills showing charges in Merida, Mx... and I actually located 3 receipts which corresponded to the credit card itms on credit card bill which has my name on receipts (typed by the machine they printed my receipt on in Mexico. I sent some of the same photos again...

    And included a narrative for the officer to read that explains what they are seeing and showing them the Unrefutable conclusion that we have met within the past two years..and in fact THIS evidence shows Nov 2-8 of 2005 visit...

  14. Aye, I called their Customer Service Line (a Joke that name is lol) and it was like talking to a Goat in my pasture... BAA BAA BAA....

    Here is a question... WHY ask for our email addresses and send us the notices in the email (without the information we need!!!!) and then not have the information availible....

    Ive seen 3rd rate companies have better access to their data than the USCIS...

    AND .... they wonder WHY people decide to Illegally enter the US... its because the screw the Legal ones at each & every step...

    WHY am I upset????? Because the company my fiance works for is Unhappy that she is leaving them (even with several month notice) and they are replacing her and hinting that they intend to kick her out of her house (company rented with 5 other girls).... So much for working for this company for 15 years and being a manager of well over 100 people....

    SO NOW combine that with the totally uneccessary delays by the USCIS, and you have a looming disaster in the making if they do not apprive her soon.... RFE is no problem as it is part of the process...making me wait several days to two weeks for the RFE info is rediculous. Odds are it is something stupid as mentioned in so many other RFE posts on here...and regardless I will FEDEX overnight whatever they need. Too bad the USCIS does not consider overnighting to us as "customers" as God knows we pay enough to them in $ and suffering.

    Sorry if I vented too much...

  15. RFE : Good or bad sign?

    NOA1 12-5-05 and got a RFE email 2-24-06

    Naturally the email comes Friday night so I have to wait until Monday morning to call the customer service to find out about the details.

    Is this a good sign or a bad sign? :) or :( ?????? (L)
