Excuse me, but most of this is irrelevant at this point. You are a non-conditional permanent resident, you can travel, become a citizen when eligible, get divorced, do whatever you want. You are past the burden of having to prove a bona-fide marriage. Your divorce-related concerns should be discussed with a lawyer, this forum can't help you well with those.

I'm getting ready to file for N400 and have a name change question. I have a long name, let's say "A B C D", where C is my "given" name and A & B are my middle names (common in my culture to put the middle names first) and D is the last name.

In my passport, birth cert, GC the name appears as: A B C D

My SSN, driver's license, marriage license, credit cards, diplomas, etc: C ( A ) ( B ) D (various combos with "C" being the first name)

I'm planning to clarify this mess by changing my name simply to "C D" during the n400 process. And then I worry that I might have to change my native records too, in case I travel internationally. It might appear that I have different names in the 2 passports and if I buy a plane ticket, it will only match one of the passports.

Any input or similar experiences would be appreciated. Thanks.

REMEMBER: "Date of I-751" is the date you sent your petition - NOT the date it

arrived at the service center. "NOA1 Date" is the 'Notice Date' shown on the NOA1

NOT the date you received it.

Don't bother with the stamp. I was not only refused a stamp (because I had the letter) at the local office, but they almost confiscated my expired GC. If they do give you a stamp, they will most likely keep your old GC. To this date, I have not heard of anyone who could not come back to the US with the letter and expired GC. Take the original letter, not a photocopy.

Has anyone successfully received an I-551 stamp in Boston office WITH a valid NOA extension letter. I'm considering this because of aggressive airport personnel in my home country on my return flight. I am not worried about POE in the US. Thanks.

It could take 3 to 6 months for I751 but maybe even longer. You can file for Citizenship after three years of marriage (minus the 90 days) or five years if no longer married to the USC. So, if the I751 is still pending - and a year has passed - you are at the three year mark to be eligible to file for citizenship. Good Luck

This is incorrect - you can file for citizenship 3 years (minus 90 days) after the issue date of your green card (approval of AOS). When you got married is irrelevant. There are separate requirements about actual time spent in US, etc. which you can find on the N-400 application instructions.

Question for those who've been following VSC aprroval patterns: It used be 6 months from the NOA1 date; what is the current estimate with the transfers in the mix? Is it entirely unpredictable at this point?

All this talk about suing the employer is really bad advice. Is this a contracted employment or is it at will, the latter giving the employer the right to terminate the employment w/o a reason?

The best option is to improve the communication with the HR dept. or whoever is dealing with your immigration paperwork. Give them a file with the copy of the letter, copy of the greencard, and an excerpt from the immigration law explaining the 751 and the extension letter. If you are seriously concerned about keeping your job, don't even think twice about the I-551 stamp. Getting it will clear up this mess instantly, why are you waiting??

I mean...we are TOGETHER at this point....and all we are really doing is waiting. Most of us have the receipt already, so the GC has been extended, so the PR can do whatever he/she could before with no interruption....what's the big issue?

To those who might say...I don't want to be in limbo or I want to just move on with my life and not worry about immigration...you're not in any sort of "limbo" and once you have that receipt, there's nothing you DO have to worry about. Get the bio letter, go do it, and then wait some more! Wait, wait, wait...the USCIS theme.

While I personally do take this process lightly and have learned not to check my case status every day, I disagree with a few assumptions you have made:

1. A lot of things are in limbo, including your very status in the US. USCIS might send you an rfe, invite you to another interview, or your application could fall through the cracks to be never found again. That RFE or interview notice might get lost in the mail (it happens) and your application can be denied and you could find yourself in removal proceedings. All of these might happen, because your residency is "conditional" and that still has a very heavy bearing on people.

2. A lot of people get stressed, because they don't have all the evidence required for 751, children's birth certificates if no children, lack of a lease or a mortgage, lack of financial documents. It is in fact quite possible to remain as a legal married couple while lacking these documents and face an RFE.

3. Some people don't even get their NOAs or renewal letters. They have no legal proof of their status, in case it's required for an ID, job, international travel, etc. This also causes a lot of stress.

Last, the people on these forums represent those that are in fact worried. Otherwise, there is not much reason to be on here. There are tens of thousands of people who are in a similar position, yet are not regulars on the internet forums. If you are not worried at all about the 751, what are "you" doing on this forum?

I've heard from several people that their application was "touched" right after biometrics (my AOS application was the same way). During my biometrics, the person administering it was distracted and several finger scans said someting like "no match", she ignored several of them. Anyway, I am just wondering if something is wrong or if there are others whose applications were not touched after biometrics.

You do realize that one can commit or attempt to commit fraud without having an accompanying criminal record, yeah? People pretend to be married to get residency all the time.

I'll reserve my comments about whether or not you suffered abuse at your interview.

Being a North American, it is very likely that you might not have gone through a treatment similar to USA1234's or that you would never understand his feelings and observations about how he was treated. I think that your comments are unnecessary and condescending. If you don't believe him, you certainly don't have to post here and imply that this person, who has obviously gone through an experience that is deeply troubling to him, is essentially not telling the truth about how he was treated. This is a forum where people help and support each other - if you enjoy doing the opposite of that, perhaps you should consider "reserving your comments" period.

They will not deny you through mail. You might have to go to an interview. If they are even more suspicious, they might question you separately in that interview. In the end, you have nothing to worry about if your marriage is indeed genuine.

1. He can't cancel anything, because he has no auhority. I guess he could tell USCIS that the marriage was fake, but then he would go to jail. Don't believe this threat.

2. Don't sign ANYTHING without a divorce lawyer. You have certain rights and you want to make sure that they are protected. And certainly don't sign anything before you come back to the US.

3. After the divorce is final, you can file for the 10 year GC just by yourself, within the 90 day period before your 2 year GC expires.

4. If he does petition someone else, they will have a very tough time getting approval.

It sounds like you applied already, so this might be useless, but I think that:

-Nos. 7, 9, 11, 13, 14 are very weak.

-Nos. 8 & 10 are de facto evidence that were relevant to the initia GC application, the don't contribute to 751.

-No. 15 actually works against you.

-There is no evidence that you live together (lease, etc) and especially that you live together in the US.

If you gave a foreign address as your contact, you might have triggered a whole other potential problem, which (if you haven't gotten a re-entry permit) is that you are not permanently living in the US. You might lose your green card.

If you did give a US address and the USCIS ignores the fact that you are currently living outside the US, they might send you a Request for Further Evidence letter and ask for more proof of marriage. In that case, send only what is relevant to your life in the US. Of they might send a letter saying that you will get another interview. Or they might just approve you.

I think the way you interpret the affidavit evidence is interesting. The problem is that one might be introducing a whole range of evidence that doesn't directly relate to the primary evidence that is about the marriage itself. For example, if my friend writes that he knows us since a certain date from a certain school, etc., I would be including evidence that he attended that school and something that proves that he really knows us such as invitations, letters, etc. It just seems like clutter to include this "side evidence" that only serves to prove statements made in the affidavit. I think the whole point of the affidavit is that it is based on someone's sworn word; evidence included just to prove it would be redundant. I think when the instructions say "Affidavits must be supported by other types of evidence listed above", they are talking about the evidence above, not evidence that is now about the affidavit itself.

It is not "United States Customs and Immigration Service". The correct name is "United States Citizenship and Immigration Services".
