  1. The legal standard to meet on a K-1 is actually 100% of poverty. But with a K-1, total discretion is given to the embassy to decide if the petitioner can keep the beneficiary from needing government funded support, so they often use the 125% figure, because the AOS requires the 125% level be met. It is best to file a 1040 with even zero income for some embassies, as they will issue a 221g requiring the latest tax statements. Again so much discretion is given to the embassy on K-1s, they can often demand pretty much anything they like.

    I also filed all my taxes, although I studied abroad for 2 years and I didn't work at the time, I made sure I turned in all my 1040s with zero income. So I am pretty much on top of that too!

    So I have all the tax transcripts needed, alongside with my employment/salary verification from my employer and copies of recent paystubs. Looks like I have sufficient amount of proof of financial support (I am going by what the US Consulate in Amsterdam requested on my part).

  2. Thanks again for the fast responses! I have another question, I was in school last year and did not work enough to file taxes. I'm going to include a letter explaining why I didn't file taxes and a copy of my transcript from school. I've read also of people filing a tax form with a zero for the amount. I appreciate any insight into this. Thanks!

    Hi Danebling!

    I am in the same situation as you too. I just finished grad school last October 2013 and started working late November 2013.

    So after reading many posts, I reached to a conclusion that most US Consulate preferred current stable income above 125% above poverty level, but some say 100% but I rather used 125% since we have to apply for the I-864 later.

    Anyhow, as for the tax transcript, I didn't work for 2 out of the 3 tax years but I am sure it will be okay since we both had a reason, COLLEGE.

    It would be a problem if anyone is still unemployed after graduating from college during the final stages of the K-1 Visa process, therefore getting a co-sponsor would help the chances for an approval.

    I realized that I don't need to send so many docs since I can send those electronically to my fiance, but as for the original I-134 form and the letter to intent to marry, I sent those 2 to him via post.

    I decided to send the letter via USPS mail on the 15th, hopefully it will get there by next week on the 28th. If not, then I will have to rely on DHL!!!

    His K-1 visa interview is on the 6th of May, wish us luck!!

    I am about to send my I-134 and the other documents to my fiance, and I wasn't quite sure which international couriers I should use to ship my packet overseas, such as the Netherlands?

    I heard that the USPS is the cheapest option but it may take between 4-14 business days.

    Ideally, I want my packet get to my fiance's hand no less than 7 business days :content:

    Can someone give some recommendations, and can you tell how much did it cost you and how long did it take for the shipping?

  5. Make sure to have a digital copy of a passport photo as well.. I got mine done at a local foto studio and they emailed me the photo in the correct size and all. I also immediatly 4 hardcopys as you will need 2 for your medical in amsterdam and then another 2 for the interview.

    After we returned packet 3 I received packet 4 within 5 days and my appointment data was for only 4 weeks later. 2 weeks from now :)

  6. Hi everyone, I am the petitioner and I was wondering if anyone on here has filled out the DS-160 online form, and if you can please give me a step-by-step process in how to fill it out?

    Well I am not asking how to fill out the obvious ones like name, address, etc., but the ones that are K-1 Fiance(e) Visa related questions that my fiance will be able to understand and answer.

    Also, are there any other important documents/info we need in order to fill out the rest of the form? I appreciate the help and thanks in advance!! :)

  7. If your NOA2 has the correct name, then I would not worry about it. The NOA2 is the important letter you need for filing AOS later. You do not need the letter from the NVC for anything else. Sounds like if your name was correct on everything else up to that point, then it really was just a simple typo by someone. You can contact the NVC about it, just to check and make sure your name is entered in their system correctly for your case, but I do not think it is a must thing to do.

  8. Hi there everyone!

    I received a letter from the Dept. of State and I noticed my first name was mispelled which I figured was a typo due to an extra letter added to my name (I am the petitioner).

    How do I go about this? Should I give them a call about the mistake? I know my NOA1 and NOA2 had my name spelled correctly,

    but I don't know how significant this is and whether I need to contact the Dept. of State, U.S. Consulate oversea or NVC about it.

    To me, it seems like just a regular letter notifying me about the status of the K1 Visa petition, how it is being forward to the U.S. Consulate in Amsterdam in order to continue for the next stage (Packet 3).

    The letter has the Case number, USCIS Receipt number, Principal Applicant's name, Petitioner's name (mispelled) and the Interview Location.

    I figured mistake like this has happened before and I hope someone can shed some light on this issue. Thanks!

  9. I appreciate all your reponses and best wishes! I didn't expect this so soon but I am happy that so far our K1 Visa journey is going smoothly.

    Kitthekat, I sure hope to get that letter from the NVC but if not, or not anytime soon, I will go ask my fiance about the case number on his letter. That way I can have that with me (peace of mind) and for any furture case statuses.

    But If he does not have the case number on the letter, then I will give NVC a call biggrin.png

  10. It says follow instructions from package sent..is nvc sending me a letter?

    I am curious about the same as well. My fiance got the letter from the Consulate today for packet 3 but is the NVC sending me a letter too?

    That way I have an update on what's going on, such as get that hard copy that shows the case number, etc.

    I have a question, I received my NOA2 on Jan. 13th (so happy that part is done!), and also, am I suppose to wait for a letter from the NVC on my part as the petitioner?

    I am confuse on what to do next after the NOA2. I read on several posts that it is recommended to call the NVC to get a case number and register for the CEAC?

    Furthermore, my fiance over at the Netherlands received a letter today from the Amsterdam US Consulate regarding the steps of the K1 Visa process (Packet 3).

    So does that mean, there is NO any sort of letter mailed to me from the NVC and/or call them for a case number?

    I hope you guys can help answer my questions and guide me through this because I am getting confuse on what to do next on my part here.

  12. For my I-129F packet, I copied and paste all my photos to a word doc. and wrote a short caption with the date, place and what we were doing there underneath each photo.

    I had put 4 photos per page, for 4 pages (16 photos total for me, just in case) on plain white printer paper from color ink.

    On the header, I put my name as the petitioner, his as the beneficiary and other notes like "evidence for meeting in person", etc.

    Paperclipped and sent those in with the application and other neccessary evidence. Waited and our petition recently got APPROVED!!

    So no worries! Just as long as the photo doesn't look photoshopped and the photos are clear enough to make out your faces.

    While I was browsing online, I found a couple of online articles that could be useful for couples who are close to their marriage-based green card interview dates.

    Forgive me for these articles were written a few years ago, but I felt like the topic was still relevant since they mentioned a few sample (and some silly/random/catching you off guard) interview questions and etc.

    I found it funny how one author relates these interview sessions as "The Newlywed Game"... but of course the real thing is more nerve wrecking, like an episode of the interrogation scene from the movie "The Proposal" so to speak!

  14. Thank you everyone for your helpful advice! It has been a hectic week gathering all the important documents for the I-129F form, but I know it's worth it, especially without the help and cost of an immigration lawyer because of this VisaJourney!

    As for the waiting period, I hope the process goes along quickly, but if not I can wait and keep checking and checking and checking.....

    Moreover, it is a good idea to wait for the K-1 visa approved first before I get things rolling over here. Oh my gosh, I just realized how real this is!

  15. Hello everyone! I am new to this and I wanted to know how long the waiting period will be after I submit my I-129F packet. I did some research and read that it will take around 6-9 months or possibly more. I have a question for those who petitioned their significant other over from the Netherlands: how many days and/or months did you both wait until you receive a letter for the interview and the approval for the visa? The reason why I am asking is, of course I cannot wait to see my man, but also to get things organized over here on my side, e.g. wedding planning and other appointments. Plus any advice would be useful to this newbie! Thanks in advance!! content.gif
