It doesn't help your case that you are unemployed at the moment but there are other ways to get around that.  Maybe consider adding a co-sponsor to your petition.  I wasn't making enough money to sponsor my fiance at the time of filing for the K-1 so I had a co-sponsor (family) to provide financial records and agree that my fiancee would not become a burden to the State during her time in the USA.  Everything worked out great in the end!

    Yes, searching luggage on occasion for dangerous or illegal materials is standard globally.  Searching luggage for the specific goal of uncovering evidence for a nationality conflict is another thing entirely.  I just think its unlikely they will do that (in the event they notice my son doesn't have an entry stamp into the US).

Thanks for your responses !!!  So the consistence is still ambiguous then.  Basically I will show back up in China with my son (without an entry stamp in his Chinese passport) and basically play dumb.  I think that will work but they might question me more than others.  What are they going to do, bar entry of a Chinese national.  I will just put his US passport in our checked luggage so even if we are searched there is nothing they can find to prove he has a nationality conflict.  (Its risky in the since that they could lose the luggage but ... we could always go through the hassle of getting a new one if that does happen. If they really wanted to they could search our checked bags too but ... i doubt it.)

To keep things brief I live and work in China with my wife (who is Chinese) and now my 4 month old son.  We wanted him to have dual nationalities for the time being and he currently does, two passports and what not. (I know I know "But China doesn't recolonize dual citizenship!" I can hear it now.) Anyway I got my son a pro forma visa to the USA to allow him to leave the country on his Chinese passport. 

        Now by law he needs to arrive on his US passport. This leaves me with a slight problem as when returning to China they will see that he has no entry stamp in his Chinese passport.  I have heard from someone (who did this recently) that they really wont care and just kind of let you by.  So my main question, have any of you all tried this before?  Getting the pro forma visa, traveling, and then returning?  If so when and how did you do this (mainly concerned about the return of course).      

    If you have knowledge about my question let me know!

    The CRBA is, in effect, the baby's American birth certificate. 

     

     

    Thanks for the response!!!  So I understand that the CRBA serves as a birth certificate for the USA.  That last part of your last sentence is the core point to my question, "may be allowed to enter a name of your choosing".  Are you saying you don't know and are just guessing??? Or are you saying you have heard of some circumstances in which you can make a significant change to the child's name on the CRBA???

  6. (TLDR version: will the US accept a name other than what appears on my babies Chinese birth certificate???  For example lets say my child has a name in Chinese characters with the mother's maiden name (Chinese) but on the CRBA we would like a middle name + my family name.)

     

    So I live and work in China and me and my wife had our first baby last month.  We plan on living here in China for a while and don't want to renounce our child's Chinese citizenship but would still want to file for a CRBA to make him a US citizen. (Yes, we want to be in that weird "pseudo" dual citizen ship category .... for now. I know China doesn't recognize dual citizenship.) The reason I ask this is because the people at our hospital give us two options for naming our child. 1.) You can pick a Chinese name, which would allow the child to get a Hukou. 2.) You can choose and English (foreign) name but they make you renounce the child's Chinese citizenship then and there. 

     

    Any insight on this would help a ton!

  7. Hi all,

    My wife and I got married within 90 days of her arrival to the USA. However, life happened ... and there was also a death in the family that stopped us from completing and filing all the paper work for the AOS. Also it was my mistake that I didn't get her a SSN when her I-94 was still valid. Her I-94 expired a few weeks ago. Here are a couple questions I have;

    1.) Does she need a SSN for AOS, or can I leave that blank and get that during or after her AOS ?

    2.) What is her status when they ask (on form I-485) "Current USCIS Status" ? Should she put "No Status"?

    The last couple months have been a roller coaster and any insight or advice would be greatly appreciated.

  8. I just have some general questions concerning 2 scenarios with a K-1 visa.

    I my fiance is from (and currently in) China. We are good, but I was wondering, if things don't work out and we don't get married while she is in the USA will there be any negative consequences for her because we didn't marry? As long as she leaves the country before 90 days (if we choose not to get married) she should be fine, right? Would not getting married hurt her chances of getting a different visa in the USA again (or other developed countries)???

    Also, what if we got married in the USA and then I went to China for 2 years. Would bringing her over on a K-2 visa for the second time (after those 2 years) be significantly easier for us (compared to others) because we were married in the USA?

    Thoughts?

    I already planned on bringing her here on the K-1 which was all ready approved and sent to the embassy in Guangzhou. We are both flexible with our plans. We just felt the K-1 visa would give us the best chance to see if the marriage would work. She is open to moving here but we both are toying with the idea that after we get married (and or get her a GC) we might move back to China for a year (or at most 2 years). I do know its a lot easier to prove that you are married to someone if it is done in the US. So even if we shift when we get her a GC I think its a good thing to get married in the US.

    idk what recommendations or warnings do you all have.

    I am traveling to China to be with my fiance (3rd visit), I have already submitted the 1-129f for my fiance in China. I had to quit my job in order to go on this 6 month trip, (they will hire me back when I return) but as far as the "Affidavit of Support" goes do I have to say I am currently unemployed ??? In addition I am not sure if I meet their requirements for supporting my fiance, in which case I will get my parents to co-sponsor my fiance. Do I submit an Affidavit of support from myself and one of my parents ?

    What are your thoughts on this?

  11. Ok, so we are going with her fake name which is used on all her official stuff and we will just list the other name as an alias. However her fake name doesn't have a birth certificate. (Each name has a hukou book.)

    Uhhhhh does she have to show them a copy of her birth certificate or will her hukou book and or passport due ??? As the petitioner they don't even require my birth certificate as long as I supply one of the following other two options, "a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back)" (K-1 Visa guild).

    Which is it !?

    Don't I have to be interviewed here in the US in addition to just my fiance in her country or is it only my fiance ? OK, here is my concern, what if I indeed need to be interviewed before her visa is approved and I am in a China at the time they want one ? Sorry I am still hazy on all the steps.

    So my girlfriend and I want to get a K-1 Visa. I will be submitting it in the next week or so. I have visited her within the past 2 years, however I plan on visiting her in China (where she lives) in late January. I will stay there for about 6 months with her and also work there. I was wondering if my

    I-129F is approved after I leave, could I go to the interview at a US Embassy in China ? Could both be interviewed together if that is the case ???

    Any advice or insights are greatly appreciated !

  14. Quick back story:

    Me and my Chinese girlfriend are looking to get a K-1 visa. We have been "together" for like 4 years now I have visited twice, (the last visit was a year ago). It just so happens that my girlfriend (lets call her Anna) was a second child for her parents. Her birth was back when the Chinese government was cracking down hard on the "one child policy", so to avoid getting an abortion, paying a huge fine, and or potently loosing their job(s) her mother fled to a rural part of China to give birth to her. She had to live with her aunt for a number of years registered under a fake identity (lets call that one Lily). However, her real identity (Anna) is also registered too; real age and name she prefers to go by, but she uses her fake one (Lily) in official instances such as employment.

    So where does this come into the K-1 visa process you may ask ? Well as you probably know we need to establish proof of a existing relationship. All I have to show for that are the hundreds of pages of chat logs we have accumulated. (Proof of visiting isn't an issue). However her other name, Anna is on the chat logs and she wants to use the name Lily to avoid any conflict with the government and her parents.

    I don't want her parents to get in trouble for having to use her alternate identity (which is actually her real one ... I know its confusing).

    I don't know what to do. Any advise would be greatly appreciated.

  15. I really need some advice...

    Brief description of my situation:

    I am a 23 year old recent college graduate, US citizen. I am looking into the logistics of marrying a long time pen pal / girl friend who is a Chinese citizen (in which I have visited twice, and currently on that second visit). Because I have been full time student the majority of my life I know I will not meet the required specifications of sponsoring my fiance under an Affidavit of support. My parents are considering becoming a joint sponsor for my fiance, but want to more about this.

    My Questions:

    What are the complete responsibilities of a joint sponsor?

    When do these responsibilities end?

    What are the biggest risks in being a joint sponsor?

    How long does this whole (K1 Visa) process take, from mailing of the petition to arrival of my fiance? (Remember, she lives in China.)

    How much does all this cost, legal fees and stuff, (if I do not employ a lawyer to do it for me) ?

    If any of you can answer these questions, it will help me a ton. Please give advice if you can think of something that might help me.
