  1. my approved I129F petition was approved Nov 14th and received the Case Number on Dec 16th at the NVC, the same day I was told by NVC that the USCIS requested my file back. Dec 23rd my Case was updated on the USCIS website that it was received for a review. Is this common?

    Got my NOA2 and approval Nov 14th, NVC received my file on Dec 9th, assigned my case number on Dec 16th then file was sent back to USCIS for a review?????

    Does this ever happen?

  2. Your Fiancee's child under 21 years of age and unmarried maybe included in your I129F Petition for your Fiancee. The only required fee is for your Fiancee's I129F which is currently at $340. As long as the child has been included in the original I129F Petition, the child will also be able to apply for a K2 visa at the time your Fiancee applies for her K1.

    At that time, that is when the Visa Application Fee applies and it will be $240 for your Fiancee and $240 for the child, these are the fees set as of this writing.

  3. petition filed 10/02, ALIEN REG NUMBER chaged 10/04, NOA1 received shortly after, RFE RECEIVED 11/06, i responded to an RFE from CSC in a timely fashion ... CSC confirmed receiving the documentation requeste on 11/08. USCIS website updates my Case Status to "REQUEST FOR EVIDENCE RESPONSE REVIEW". Today I received a text/email from CSC re: Case Status Update stating that Alien Reg Number has been changed...or the 2nd time??? Upon checking USCIS website for case status it went back to INITIAL REVIEW!!!!

    my question is, is this odd or does this ever happen? isn't the process supposed to be progressive so why would my case go back to INITIAL REVIEW after a month or so of submitting the petition?

    please can someone shed a light on this issue???

  5. since she only started in october of thisbyear, her income might not meet the Poverty Guideline and you will need another individual (co-sponsor)to submit an Affidavit of Support aling with your fiancee's. You need not send this along with the original USCIS I129F packet but it will definitely be required at your visa interview.

  6. you would still have to disclose anyone that you have provided an affidavit of support for regardless as to wherher they depend on you financially or not. the Depr of State has a database that has the scanned images of whatever docs were submitted and they can reference to that during your fiancee's interview. your IRS tax documents can show that your grandmother was never dependent on you despite you providing her with the Affidavit of Support in the past.

  7. they are very particular about photos unfortunately. i am in a same sex K1 case also and awaiting my approval. me and my fiancee were not too hopeful either until doma was demolished but dont lose hope since i have seen approvals similar to our case recently. at any rate i would recommend having your fiancee take the photo again to meet the specific requirement.

  8. you need to put your given name at birth on the form if you never had any legal name change thru the court system. if you are the petitioner, you have to submit your US birth cert or your US Passport as proof of your US citizenship and you need to put whatever name shows on those documents. this holds true as well if you are the Alien beneficiary, you will be asked to submit a copy of your passport and your birth certificate .
