  1. chinita forget about what social services told you, the same way we lawyers don't have to give advices about social affairs, the social workers don't have to give advice about Immigration Law. You use your prima facie if want or need period! if you decided not to use it will not change anything in your Vawa case.We have here hundreds of people that never used any public benefits and their cases were approved.

    I don't understand why is your lawyer pushing you to file AOS now, and giving you wrong information about the Adjustment of status. You can file for AOS after your Vawa is approved, you don't have any obligation to submit your AOS now. If your Vawa is denied and you have a pending I-485 they will start with removal proceedings, if you filed just I-360 and your case is denied they are not removing.

    Social Services should approve benefits for you. Unfortunately in the rural areas like here, or where you live, the agency doesn't always know they are supposed to be able to offer benefits to you. Sometimes you have to assure them that you're legally here, have a Social Security Number and are eligible under the law. Another good reason to call immigration and get them to explain your rights. Whether or not they give you benefits though, that has nothing to do with you staying in the country. The papers you received that accepted your petition (I-360) are the ones that prove you are legal to stay here for that period of time on the paperwork. If you don't file for your next step...the green card or work visa, before that time period ends, then they can have you leave the country. So please get the paperwork in for your green card as soon as you can.

    can u help me so that i can understand what they trying to say... they said that if i dont applied for using 180 days in social services i might deported cause i need that to file for green card or fee waiver i dont understand makes me confuse... they said if i dont used it i wont have any record to immigration to continue my I-360 is that true.. thanks


  3. wow chinita the people helping you need to go back to college to learn about Immigration, first of all why did they file fee waiver for you? there is no fee to file form I-360.

    As far I understood your I-360 approved was not approved yet, then your I-485 will be adjudicated just after approval of your I-360.You can submit form I-485 but they will not adjudicate until final decision of your I-360.Your I-360 may take 6 months to 1 year to be addjudicated.

    You got already a letter from USCIS saying your I-360 was filed, the prima facie that you received proves you vawa was filed.You were not able to receive any benefits because the State you live does not recognize the PF for public benefits,many States recognize the PF.

  4. you don't have to use your PF if you don't need, they issued in case you need to get some benefits.

    Fee waiver it means if you cannot pay USCIS fee then you file a waiver to excuse you to pay the USCIS fees.

    It's up to you if you want to file I-485 and I-765, but keep in mind if you have just I-360 filed and your Vawa case is denied they are not removing Vawa filers from the US, but if you have a pending I-485 and your case is denied they will remove you from USA.In order to get a work permit you must file I-765 along with form I-485, and you can submit anytime you want.

    Your I-360 was the only thing you filed (along with the request to wave fees form). That form was only to allow you to stay in the country, not be deported, because you're a victim of domestic abuse. They granted this and gave you 180 days to now, file the paperwork for your permanent residency, also known as your green card. You can file that and wait...it can take up to six months or so..

    so yeah i didnt able used the PF cause im not approve to it.... maybe i just need to wait till i got a letter from USCIS about I-360 i filed

  5. Chinita are you concern because you applied for food stamp, is that correct? you won't have any problem at all, the prima facie was issued for you to get public benefits. If you do not have a work permit you should not be taking care of your friend's childrenm ,if you want to work then file form I-485 and I-765.

    im worried because i was thinking that it may affect to my immigration paper work that i filed the I-360 if i dont used that 180 days... thats what i thought..so im worried about they called it fee waiver? so can i still filed and I-485-and I-765 ? even though i already send the I-360 MAY 2013.. and my prima facie expired in JANUARY..2014..

  6. hello everyone i have filed for I-360 MAY 2013 and june got this RFE and send them the good moral character or police record cause that was on the list that they wanted so after send it to immigration i receive this prima facie 180 days so when i applied to social services i wasnt approve i did it two times but still denied so is it going to affect my self petition that i filed.. i just had divorce august 2013 but i was still be able to save a little by helping taking care of other babies from my friend but i dont know if it was allowed or ok to my immigration papers i am worried cause i didnt get to used this 180 days and then still waiting to my I-360 to get to hear from them.. dont know what to do.. am i still ok or what.. should i do? help

  7. hello everyone sorry dont know where to post a start topic since i am new here ahm i have some problem that i wanted to ask




    from k1 and got married 2010 then its a long story but to make it short his a very abusive person so i just left him 2012 he had all my papers.. i didnt get to have any green card so in 2013 after got an order for protection that i filed to him i did filed also for my immigration an I-360 that was MAY 2013 and then june got RFE then send it to them what they asking for is police record of mine in past months so i did.. then july got this spouse usc or LPR section self petitioning 180 days to help assist in receiving public benefits and also my divorce august 2013



    so my problem is my 180 days i been applying in social services for it and show it to them but still i am not approve to get any of it even food stamp what should i do? my 180 days will expired in january 2014.. i dont have a job since i dont have paper work with me when i left my ex husband.. i can still earn money alittle bit while still waiting cause the people that i was staying with is giving me a little bit money for taking care of their house and baby sit there baby... what is the best thing to do since my 180 days didnt used cause i been applying for like two times im still denied.. in social services so i been starting to earn and save a little bit money for my self.. but i dont know if thats ok to my immigration situation please give some advice or some i dea that u have knew thanks a lot.. godbless u all


  8. hi to ur friend.. she should relax her mind and not thinking about paper works in immigration since they just got married cause for me they are still in adjusting their marriage.if the husband is not really that abusive person tell to the husband that they can still work it i mean there are still lots of time to think how to save some money so they can applied for whatever they need to..they should talk heart to heart as a husband and wife so that they would know what is the real inside of them i mean the feelings of how they truly feels for each other thats how they can work things out.. forget about paper work for now i mean you can file whenever your ready not in a hurry because that will made him feels like you only worried about ur papers..you have ur social security number right then if its saying that valid for work only then maybe u can ask ur husband if its ok for him that u can find a job so that in the future when ur both ready to file the papers u need then u can do it.. but if the relationship is not working then dont be scared to left him.. just because u need him for filing legally papers in us doest mean he can do whatever he wants to and make u suffer..
