  1. that does make sense, its pretty impractucal and unneeded at this time to have a joint account or have her own any assets with me. and i dont have insurence to add her to..so thats not possible.

yes, she is 10 years older than me, weve worried a lot about that too, but surely they cant deny us based only on that. and in any case it would be different if i was the older one in the relationship. and ive never married before, im 26 yo. all i can say is when i saw the woman of my wildest fantasy there was no superficial thing that was gonna stop me from getting her for myself. i just hope we get a nice level headed american guy to interview us that will understand this!

that was something else we worry about, it makes sense to me that in an american embasy, the interviewers would be american, right? id hate to get an indian on who is just an american citizen :(( they have distorted views of what married life is about and why people should get married. all i was is an unbiased inverviewer

  2. cr1 visa, wife in india, aprroved by uscis and nvc, dad is cosponsor, relationship running on 2.5 years now, visa process nearing 16 months i think. (there were delays that were due to waiting of some docs and a few money issues) interview scheduled for 6th may

so i think with very little doubt that i have sent them enough proof, and TO ME i cannot think of any good reason to be denied now, but of course we fear all sorts of things, and we do have a few major things missing or weak. i have only really been conveniently able to send her money thru westurn union, and we dont have a joint account due to her not having ss or itin.. we learned of the itin about a year ago, but only 4 months ago did we learn how important it was to have that. weve had a lot of road blocks to this joint account issue, the banks wont do it without her numbers and SEEING her passport and HER in person, so i gave up

however we do have a credit card on my chase account..with her name on it, shes an authorized user of my credit account, but i never sent her that card for fear of her family members getting it and abusing it (the dont have much respect, her parents i trust but not her other siblings)

so yea, the credit card, we also have her on the rent agreement here and on a car title with me, though again with that shes not actually authorized to drive it of course due to no US drivers licence..uugh

several other typical things to, and of course all the normal relationship proof, contact, certificates and biographicals. a long list of all my money transfers to her was sent as well. hope its all enough..

but nvc passed us on to the embassy, so that has to mean something right?? and i think it will be very clear that we love each other and know lots of little things about the other that no fraudulent case could know. assuming im allowed into the new delhi embassy, things will be way easier, cuz i know she is not going to be good at this, she gets VERY nervous and cant think strait without me there..

  3. I have received a checklist from nvc that says they need wifes birth certificate and police cert. but im pretty sure I included at least the police, may have left out the BC. but now im very confused if they want simple scanned copies or certified copies. in the checklist instructions is says

    "______3 - BIRTH CERTIFICATE:_______________________________________

Please submit this applicant's photocopy of the original document listed above. Each applicant must send

a photocopy of the original birth certificate issued by the official custodian of birth records in the country

of birth, showing the date and place of birth, and the parentage of the alien, based upon the original

    registration of birth.

Documents must be from the appropriate issuing authority. Failure to provide the correct document will

delay your case and may result in rescheduling of your interview or refusal of a visa.

The certificate must contain the following information:

    Person's date of birth

    Person's place of birth

    Names of both parents, and

Annotation by the appropriate authority indicating that it is an extract from the official records

(the following section caused my concfusion)
If the certificate is a photocopy of the certified original document, it must come from the issuing

government authority and it must contain annotation by the issuing authority indicating that it is an

    extract from the official records."

and yet this is what it says in http://travel.state.gov/content/visas/english/immigrate/immigrant-process/documents/Supporting_documents.html-

"You and each family member accompanying you must obtain an original (or certified copy) of your birth certificate(s)..
You must submit a photocopy of each birth certificate to the NVC.
You must submit the original birth certificate(s) (or a certified copy) and a photocopy of each birth certificate to the U.S. Embassy or Consulate at the time of the interview."

so my confusion comes from them giving seemingly contradiction instruction, in this instruction it only ever says to send plain copies to nvc.

naturally im having great difficulty getting them on the phone, so hopefully someone here know about this

    thanks!

  4. my Cr1 case is at nvc and last week they told me that my case is being reviewed, I still have to pay IV fee and AOS fee and send the affidavit of support packet. my problem lately has been that I only last week filed my tax return, filed as married, filing separate in hopes of not needing a tax payer id for her..i simply put NRA in the field for social num. but today ive decided that 3 weeks is way too long to wait for tax transcripts for 2014, so I THINK I can send AOS packet with W2 forms only (I also have my father as a sponsor and he will be giving me his 2014 trans and other things anyway). so does this sound doable?

wife: indian citizen, CR1, Married apr 2014, filed with USCIS oct 2014, NVC Invoive date may 7th 2015. so we are almost there! but things keep stumping us and delaying the process.

  5. ok, maybe this is a good post for me to tag along on. i just joined, and im engaged to a 30 year old indian women-im 23. she lives in india right now. i cant seem to figure out which one i need to do, k1 or k3? im thinking k3 because of this info about it-

"The K-3 nonimmigrant visa is for the foreign-citizen spouse of a United States (U.S.) citizen. This visa category is intended to shorten the physical separation between the foreign-citizen and U.S. citizen spouses by having the option to obtain a nonimmigrant K-3 visa overseas and enter the United States to await approval of the immigrant visa petition. K-3 visa recipients subsequently apply to adjust status to a permanent resident (LPR) with the Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services (USCIS) upon approval of the petition. Because the spouse of a U.S. citizen applying for a nonimmigrant K-3 visa must have a immigrant visa petition filed on his or her behalf by his or her U.S. citizen spouse and pending approval, a K-3 applicant must meet some of the requirements of an immigrant visa. It should be noted that under U.S. immigration law, a foreign citizen who marries a U.S. citizen outside the U.S. must apply for the K-3 visa in the country where the marriage took place. Learn more in theApplying for a Visa section below."

this leaves soo much to be answered. what if we have not yet met, which is the case? can we even apply for either of these?? we would love to be able to meet in toronto canada, file from there, and actually be able to BOTH come back to salt lake city (my home) while we wait for approval..but i fear deeply that we may both have to go home before we can even begin filing! makes me really sad. do i have to file the k1 first? i read something alone those lines, that a k3 visa was for someone who has alread filed a k1 but was rejected for some reason. last think i want to do is file the wrong things and/or at the wrong time.
