    I am a Dutch citizen married to a US citizen and was granted conditional permanent residency on 7/22/14. On 6/09/16 USCIS received our I-751 to remove the conditions along with a I-912 request for fee waiver. I had already been in contact with USCIS as I had not heard anything the day my card expired (7/22/16). Finally today (7/30) I get the whole package returned, with my I-912 being denied because of no proof of 2016 income ( we had only included 2014 and 2015 tax returns).

    On the form/letter on top of the return package it says to resubmit i-751 within the required filing period, but it is no longer within that 90 day window as my green card has now expired. I am probably over-stressing, but I just want to make sure that we don't make any more mistakes. Can we resubmit i-751, along with the other letters and an explanation showing it's late because I am only getting this all returned. I did set up an infopass appointment but it is not until 8/12.

    Also, should I send everything back before that appointment or wait until the appointment? I mostly just want to see if I can get an extension stamp in my passport so that I have proof that I am in the US legally.

  2. Hi everyone,

    I've tried for 2 days now to look for an answer to our situation, but get confused.

    We are both working students, he lives in Texas and I live in The Netherlands.

    However I am also planning on going back to the St. Louis location of my university, starting the Spring semester in January.

    Well here comes the problem: as I would go to St. Louis on a F1 visa, I am not allowed to use that visa already having the intent for an adjustment of status (after we get married in March).

    What are we going to do, knowing that we will get married in March, and there is no way that a K1 visa will be ready by the beginning of January...?

    This is the solution that I came up with: after we get married in March, my then husband would start the process of the CR1 while I would finish my semester in St. Louis. We would both move (back) to The Netherlands in May, awaiting the CR1 process. He would file my address in The Netherlands as current residence, which is technically right as under a F1 visa you have to maintain a resident in your home country. Would this be legal? Or are there better 'solutions' ?

    I appreciate in advance any feedback or suggestions!
