Hello VJ members, kabayans, everybody.

My USC/Fil co-worker/friend will petition her mother from the Phils. Her Father and Mother are still married but no longer living together for 2 decades now. in short, Father is "sumakabilang-bahay" (english >> went to other nest) (grins). No contacts at all with the dad. For them, He's a total stranger.

Her Mother wants to use her maiden name on all the papers. Can they do that? Will it affect the whole immigration process? As i look at the requirements, they won't be needing a marriage certificate and she's not intending to petition the father any time or in the near future.

On behalf of my shy but sweet co worker friend, thank you for all the response.

I think it's ok to use her maiden name but her paperwork should match all the documents such as Passport, NBI, Foreign Police Clearance (if applicable) and her name on Petitioner's Birth Certificate.

I petitioned my Mother and her name on my birth certificate is married name but she and my father is not married at all. I used her maiden name on all the paperwork and all her documents is on her maiden name.

Hello, my mother's IR-5 is almost completed, I am just waiting for the case to be completed. I am just wondering what to expect next....will they send me some instructions in the mail, like what was sent with the 129F? Or complets that will schedule the medical?

NVC will email you when the case is complete and they will email you when the Interview appointment is set with the instructions. Based on my experience NVC emailed me two days after my case completed then emailed me the Interview date with the instructions four days after the case was completed. Your mother can have the medical when you receive the Interview Letter because she needs to show the Interview Letter in St.Lukes or she can have an early medical.

Medical is a walk-in (pre-register online) first come-first served. Two day process. ~as what Hank said is correct.

Hello. Thank you for your reply! She used Arnel Minda on her visa application and put the Arnel-Minda on other name used. So do we still need to get a NBI Clearance and Police Clearance with her name Arnel-Minda with an a.k.a. Arnel Minda? What if my mom have already a NBI Clearance and Police Clearance with her name Arnel Minda with aka Arnel-Minda instead. Is this just the same?

USEM will only follow the name on her birth certificate and passport. She needs a NBI Clearance and Police Clearance name Arnel-Minda with an a.k.a. Arnel Minda. She will be question why on her visa application the primary name is Arnel Minda and the other name used is Arnel-Minda but all of her documents is Arnel-Minda.

On her visa application did she used Arnel Minda or Arnel-Minda? If she used Arnel-Minda she should get a NBI and Police Clearance on Arnel-Minda name. The IO wants to see Arnel-Minda on NBI Clearance and Police Clearance Certificate.

If an instance, she also put on her visa application "other name used" Arnel Minda. She should get a NBI and Police Clearance using her provided/primary name Arnel-Minda with an a.k.a. Arnel Minda.

Hello everyone. I would like to ask something regarding my mom’s name on her passport and birth certificate. She’s using Arnel Minda, but on her birth certificate it was written as Arnel-Minda as well as her passport. She used Arnel Minda on her Police Clearance and NBI Clearance. Is this a big issue on her interview? do we need to authenticate this at NSO?

My fiancée worked in Malaysia in 1998 and no longer has the passport used when she worked there. Lost as to what to do. Any suggestions?

She can check www.kln.gov.my/ for info and apply online. After they received her application online for Certificate of Good Conduct they will email her to submit the supporting documents at the Malaysian Embassy. My mother kept her old passport so it was easy because they asked the information of her work visa that stamped in her old passport such as name of employer and employer's address.

I'm also wondering if I can request to expedite my case but my Mom live in Manila, far from the affected areas so I don't know if I will be qualify to request but I will call on Monday to give it a try.

I would like you to know a little bit of the story. Everything changed when he came in the USA and when he also got a job. He came May 2013 and on the first week of November he confessed that he don't love her and had a mistress in the Philippines. She is willing to work out the relationship and move on with their child but he told that the mistress is his brother's wife and pregnant that's why forget about moving on! They talked in a nice way that he better go back home (Philippines) he agreed, bought a ticket and the day before the flight he back off and told them he will not leave the USA because he is a legal permanent resident!

That day they had a verbal fight, they lived in a friend's apartment and one of the neighbor's called police. After the police interrogation he left. They still talked to him for the last time to ask him to go back in the Philippines in an open public place and he refused to go home. They don't have any communication at all after that.

I will tell her to report the issue to her local FDNS officer. Thank you!

At this point, there is not much they can do. They can contact ICE and report the admissions but unless a 3rd party can corroborate, little if anything will happen. Additionally, the Affidavit of Support cannot be withdrawn and will remain in force until one of the following happens:

He becomes a citizen

He is credit with 40 quarters of work

He voluntarily leaves the US and surrenders his green card or is deported

Death of one of the signatories of the I-864

I have the same status like yours when I checked online today and I received the Official Transfer Notice on Monday said that my application will be transfer to Nebraska Service Center from NBC. I called NCSC today and the first representative was so nice that he forwarded me to Tier 2 because he can't give me more information regarding my application. When I spoke with the Tier 2 he told me " Your I-130 application is in transit to NSC and you have a long way to go before approval because approval for petitioning parent(s) is up to a year " I am disappointed of what he said but all I can is to wait again. sigh....

I would like to ask an advice to anyone have knowledge of what to do of my best friend's situation. I have a (USC)Filipina friend and married to a Filipino that came in California on May 2013 and on the 2nd week of October 2013 he confessed that he did not love her, have a mistress in the Philippines that currently pregnant and he told her he only married her for him to get a Permanent Residence. He moved out after that conversation.

They were married July 2009 in the Philippines.

After she became a USC on May 2011 she petition him under CR1 visa on November 2011.

The AOS was co-sponsor of her Aunt.

The petition was approved May 2013 and came to California.

He do not have a Green card yet because they did not pay for it.

He have a SSN card and currently working.

What are the options she can do because she want him to go back in the Philippines in a legal way?

Can she and the co-sponsor pull out their AOS?

They have a one year old child, can she file for Child Support?

Thank you! My local office is in Charlotte, NC. I know how you feel waiting for this petition that seems like forever. Mama asking me every time we talk if how long she have to wait? Can't give her a definite answer. I would really like her to be here on Christmas but I don't think it will happen.

Not sure what kind of news they are, but any news are good news to me! I got this email today from USCIS:

"Your Case Status: Initial Review

On October 17, 2013, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at1-800-375-5283."

When I checked my status yesterday, this is what it said too! They finally noticed my application after 7 1/2 months!!

Even the employees in lcr told us that it's the school where I graduated high school which is responsible with the annotation, because they want me to graduate with my father's surname but my father refused. Because the year in my annotation is the same with the year of my graduation. They even advice us to file a complaint to those people who are responsible with the annotation.

Your High School is legit to file the RA 9255 but it should have your father's permission which he declined. I was wondering how your HS did the annotation because requirements for them to use (AUSF) Affidavit to Use the Surname of Father are two handwritten documents such as ;

1. Employment records;

2. SSS/GSIS records;

3. Insurance;

4. Certification of membership in any

organization;

5. Statement of Assets and Liabilities; or

6. Income Tax return (ITR)

Hi,

My sister is a US citizen who filed a petition for our mom. My sisters birth certifcate has a typographical error on her first name. She had never really tried to correct the error before. We just recently filed for the core tin of her first name. And unfortunately it would take a few months, as per the civil registry office the earliest they could correct her birth certificate would be by end of November. My mom is schedule for consular interview. I would just like to ask of someone has had the same experience before. Would she be out on administrative processing for this? Or is there other documents we could bring to the interview?

Probably if they notice your Sister's name typographical error. They may ask for the NSO BC certificate with annotation of the correct name.After the civil registar release your sister' s BC you will forward it at the NSO office to apply for the annotation. It seems that USCIS/NVC didn't notice your sister' s BC typhographical error becauce they would have requested (RFE) other documents. Possible your mother can bring is your sister's Baptismal Certificate, school records, etc. But if on the interview they didn't notice the error, well, don't tell them. I'm already in the US and everything and I found out few errors on my BC. Good luck!

But I'm worried now because we found out last month that my birth certificate has an annotation already it says that "The surname of the child is hereby changed from Agustin Guero. The child shall be known as Ann Agustin Guero pursuant to RA9255." But the original surname 'Agustin is still there it's just, there's an annotation. Will it be a problem in proof of documents or for the interview in embassy?

So the NSO annotated your Birth Certificate without your knowledge? Has anyone in your family requested the annotation? I requested an annotation on my BC due to my mother's name that had a missing letter but we went to the city hall to request the changed and after that we made a request at the NSO office and paid the fee.

I do not know that NSO is now updating BC's under pursuant of RA9255 law without the owner's knowledge and FREE! ;-)
