  1. I truly do not understand how they are legally able to do such a thing. Especially given our country's current status regarding immigration matters. It seems extremely unjust to impose an additional cost on consumers who are following the law and paying for a service, and then turn around and blame a heavy work load and inadequate staffing as the cause for the backlog that pushed the consumer's application into a time frame that would necessitate such additional cost.

So basically, since USCIS is unable to process documents for paying customers within normal processing - they are going to impose an additional $300.00 cost on said customers due to their inability to provide customers with what they paid for within their specified timeframe? It is my understanding that these exams costs about $250.00 - $350.00 up here. It is also my understanding that form I-485 I supposed to be processed within 8 - 10 months, depending on the office processing your document, according to their processing times. Finally, it is my understanding that despite the processing times that they post on their websites, they are verbally providing a timeframe of 12 - 18 months to process form I-485. Am I understanding this correctly? I hope I am misunderstanding something. I do not see how it is possible for a company that is not government funded, but funded by paying customers, to offer a service for a specified price and due to their inability to perform according to what they advertise - the customer incurs additional charges. I am not saying that I expect them to perform within the timeframe they provided despite how much I would appreciate it if they did. However, I do not see how any company can impose an additional cost on a customer due to an error or inability on the company's part.

    Please feel free to correct me if I have misunderstood.

  3. Why is everyone getting a request for a new medical? Doesn't the instructions on the form (I-693) specifically say that if you came on a K visa and had the medical completed within one year of the time you filed form I-485, you are not required to have a new medical so long as you have your vaccination record (DS 3025)? It does not say that your application has to be approved within 1 year of the medical. It says that it needs to be submitted within 1 year after the medical.

    Or am I missing something?

  4. Yes, you will need tax returns. Not necessarily three years. Definitely the most recent one, maybe two.

    We had all proof and evidence I was making well over the guidelines with pay stubs and job letters. I had started my job in Feb. 2013 and our interview was December 2013 I even supplied them with bank account and asset info which put us way over. They denied us at the interview because of tax ttranscripts and told us we needed a cosponsor. In February 2014, after I filed my 2013 taxes I emailed them my tax transcript and BOOM Lance got the call to come drop off his passport. No cosponsor, no updated job letters or paystubs, Lance said they didn't even look at that at the interview. All they wanted was the transcript.

  5. Either way you have to register with DHL, but unless they recently changed it, you had the option of either picking it up at the DHL office in Montego Bay or Kingston. I noticed the people picking it up at the Kingston office seemed to get theirs within a few days of the interview and the people who registered to pick it up in Montego Bay got it within 2-3 weeks.

  6. We got our NOAH October 11, 2013 and our interview was December 13, 2013. (If approved) The visa "typically" takes 2-3 weeks to be processed and delivered. I have seen the production process go MUCH faster for those who elected to pick up their visa from Kingston (some as fast as 2-3 days after interview).

  7. Eh, it is hard to say what day we actually got approved. I sent in my 2013 Tax Transcripts via email on February 3 and the embassy called Lance on Valentine's Day and asked him to drop his passport off on February 18. Then his status was updated to NON IMMIGRANT "Administrative Processing" on February 26.

    I would say give it about a week and see if you have any changes on CEAC.

  8. A bit weird, current income is what counts.

    It does appear that in most, if not all, other countries that seems to be the case. Unfortunately for me, the consulate in Jamaica only really looks at your most current tax transcript and neglects all other proof and supporting evidence. My current income for 2013 was way over the 125% guidelines but they didn't even look at my current income information. All they wanted to see was my tax transcripts.
