I applied for H1B and got approved and received the stamp on Dec/2007. I travelled to US on Feb/2008, worked for 9 months and returned to India in Mar/2009. As per my understanding, H1B is normally issued in 3+3 years format. I have used only 1 year in the first 3 year slot and second 3 year slot is completely unused.
My queries are as below.
(1) Am I eligible for H1B cap exemption and can I Recapture of Unused H-1B Time? (2) If yes, how many years I can get?
(3) If no, can I apply fresh H1B in Apr/2014 subject to cap?
