Admitting Drug Use and Inadmissibility for Permanent Residence by Michael Cho.

Depending on exactly what the applicant admits to during the medical examination, and what the civil surgeon or panel physician explains to the applicant about the illegality of drug use, the applicant may be inadmissible under INA 212(a)(2)(A)(i)(II). This section of the INA states that an applicant is inadmissible if he is found to have admitted “committing acts which constitute the essential elements of . . . a violation of (or a conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)).”

Notice here that mere admission of drug use that would constitute a controlled substance violation is enough to make a person inadmissible. A conviction is not required. There is no waiver available.

Well i had a pretty disastrous interview yesterday - i was found ineligable for my Immigrant Visa as they found elevated levels of Gamma GT in my blood - and for this they have incorrectly presumed that i have an alcohol addiction, and refused the visa under section 212(a)(/)(A)(3). I think i just made the mistake of having a few beers the night before - silly me.

So, at the interview they asked me to fill out the I-601 waiver, as i am married to a US citizen, which i gave back to the guy there and then.

I'm just a little unsure now as to what will happen - when he was explaining it yesterday my head was all over the place. The guy at the embassy gave me his telephone & extension number, but he said they will call me back within 6 weeks?

Can anyone shed some light on how long this process may take - my wife is now back in the States expecting our 1st child in January, I think we've resigned to the fact that i'm not going to be back for the birth.

Same here. Same thing. You might want to take a closer look at what an elevated Gamma GT level really indicates. PM me if you would like some reading matter.

We've been waiting well over 10 weeks now. Just got to be patient I suppose. Best to get busy with something else to take the mind off it.

We are both resident in the UK right now ( I am ukc pursuing IR-1).

Part 4 section C asks for us to submit evidence that we have taken "concrete steps to establish you will be domiciled in the United States"

Neither of us will be working for the while after we enter so we don't have any job offer to provide.

We will be staying at my wife's parents house at first so we will not have any form of lease agreement.

We really do not have any written form of evidence that we intend to move there.

Any ideas folks?

I understand the visa is valid for 24 months but I believe I must enter the US within 6 months of issuance.

Ok, interview is coming up in two days and I've spent all my time sorting this HSL out. Never thought about filling out the I-601 form. Anyway, I'm just a bit stuck on what this "A number" is on question 5. Is that the LND number? Or is it the "Alien registration" number (of which I aint got).

I posted my packet 3 to London by recorded post on the 27th March. Still haven't heard anything yet.

Does anyone think this is dragging on a bit and if so how could I find out why there is such a delay?

I also have another I-134 Affidavit of Support form in there. What do I do with this? I suppose I could fill it out again but there are no instruction to do so.

I was expecting a number of jabs equivalent to the list on the sheet, perhaps 10+ ... I'm much more comfortable knowing it will only be a few jabs.

Well, I'm 32 so judge for yourself as to whether I'm old or not

They have the TB and tetannus record only.

A very nice receptionist spent a quite considerable amount of time trying to locate my records but could only to be advised they were destroyed.

I can go on Tuesday to get the ones done I need. That's quite a few jabs by the look of the list. I'll be like a teabag when they've finished!!

Just have them all redone at your local GP's office thats what I did and so did many others on this site.

Go to the GP with a list of the jabs that you require and they will do them, if you wait to have them done at Knightsbridge you will be charged for them atleast at the GP's they are free or alot cheaper that waiting till ya medical.

When you have had them done ask your doctor for a vaccination report (mine is a international vaccine record card)

I've been having a hard time locating my records for the jabs I had as a youngster.

The last thing I've been told was that the records are destroyed after 25 years.

Does this mean I have to take all the jabs again in Knightsbridge? Anyone else had difficulty in sourcing their immunisation records?

Anyhooo, you got the name, case is K-3, I've got packet 3 but know I've got to file a waiver for CIMT. I aint that bad, honest, I think I'm just in the same predicament as y'all. I got in a fight 13 years ago and 12 years ago, respectively.(I'm 32 now).

So, I've got this packet 3 thing-y-me-bob and unsure whether or not to keep on pursuing it. My wife is here with me in the UK for what we thought would be a temp stay until we could relocate to the US.

Things have gone a bit "Pete Tong". The boys (my two step-sons) are being bullied like ####### at school and on the street we live on. My eldest step-son has had his arms punctured to heck with some kind of sharp instrument for being American. He's only 13 and a really placid kid, shy as you can get. I've contacted the school and the Police but nothing seems to transpire.

Seems now we cannot go to the US as a family as we planned due to these CIMT thingys.
