    Does anyone know how long it takes for Malaysia to receive electronic file or give an appointment? I requested a transfer for my husbands case 2 months ago to Malaysia and got a new case number but it still says at NVC and my case has been complete since July.

    And also I've been hearing a lot of people talking about contacting their Congressman. How does that work? Would they be able to help me? Or is it only for specific cases or if you're running into a problem with your case?

    And congratulations to everyone whose spouse has came in or gotten an appointment.. :D now just waiting on my turn and everyone else's In Sha Allah

    Hi ,

    I contacted my congressman but to be honest they didn't do anything for me to this point. I can't even get them to reply to my emails. However, I have also contacted them regarding my friend's case and they have been helpful and have at least been caring and understanding. I think it really is up to whoever ends up helping you. I have a different representative from the one my friend has and I think that makes a difference. Also it doesn't hurt to give it a try, you have nothing to lose.

    I am in the same situation . My EOIR 29 was remanded back to the USCIS on 1/20/2016. I have contacted the USCIS since then several times and they tell that my case is with the BIA even though it has been remanded back to the USCIS. I mailed a letter to my congressman for assistance and received a reply that they would assist me but I haven't heard from them for a few weeks now. I think it won't harm you to ask them for help. It might be a good idea to ask them to expedite your case and see if that helps. They usually respond back in a maximum of 5 days.

    P.S. Can you tell me how long did you wait between when you received your notice from the BIA and the one from the USCIS?

  3. Hi, I recently submitted a letter to expedite my EOIR 29 due to humanitarian reasons. We were initially denied our I-130 application due to failing to submit a document that we couldn't access due to the war in Yemen. Since then we have submitted that document. Our EOIR 29 was submitted in June 2015. I contacted the BIA office for an update on my case and to check if they have received my letter. They told me that my case is with the panel and I should hear something in a week or two. Should I believe this? I feel like over the last month, I've heard random things from each person I have spoken with. Do you think I should wait the 2 weeks or should I continue to contact them? They were even unable to even tell me if they had received my letter to expedite which is frustrating.

  4. An expedite sounds unlikely and I can not work out what it was that you did not do.

    Ohh and I am assuming neither of you are Australians?

    No, I don't have a lawyer ( I can't afford one). I have received a phone consultation from a lawyer that said I should've never appealed and just reapplied for an I-130 since I had my documents all straightened out. Neither of us are Australian residents; I am just studying.

  5. I received the email below from the USCIS after I called to expedite my case. Can someone tell me what to expect next? Are the going to deny it? Why couldn't they resolve at the center before forwarding to the BIA? I am a bit worried :(

    So in a gist, in November 2014 I filed an I-130. Sometime in January they asked me for some information I couldn't send to them because I had left the country after the outbreak of the war in Yemen. Anyway, I sent them what I had and in April they denied my case. In June 2015 I appealed using the EOIR-29 and was able by that time to have a family member still in the country forward me the document the USCIS had originally requested, which I sent them with my appeal. It was now November and I hadn't heard anything and I am currently studying in Australia with my husband on a student visa which will expire in 3 months time. I contacted the USCIS a few days ago to expedite my case so that my husband can come with me to the USA with me. I filed under "humanitarian reasons" since there is a war in Yemen and it is unsafe for my husband to return especially since his family has lost their home to an air strike and now live in a refugee camp. I just don't understand why they are doing this to me and should I not have appealed and just re-applied. Also, what is the BIA office and what do they do?
