  1. Hi. All the AoS process is going okay, but we just have a hiccup in the meanwhile.

    As we expected, the I-864, with my wife as main sponsor, didn't go through. The last seven years we've been living in Argentina, so obviously the last three years of taxes were not good enough to prove that she can support me here in the States.

    My in-laws are willing to help us, but they haven't filed out their taxes in a while. The question are:

    What papers should suffice to attach with their I-864 (as joint sponsor)?

    The electronic tax submissions of the taxes?

    The confirmation of reception by the IRS (tax returns)?

    The receipts of the payments of all the taxes?

    The issue is that they want to help us, but they can't pay all the taxes they owe at once. They may need to finance their debt in several payments. Does the USCIS want prove of the PAYMENTS or just the returns saying that they have FILED them?

  2. Lol whoops i used acco. Because every other thread i read said to.

    I fastened the i130 as one and the i485 package separately. Then i put in tabs at the bottom for the forms and supporting documents. Ours was like 3-4 inches thick, so this was the most organized way to do it for me.

    Oh well, it was accepted, so i guess as long as its in order it won't matter what you use. Lol

    And it's maybe because right now I'm freaking out about every single detail :)

  3. Hi everybody:

    One simple question, should I fill out one g-1145 (e-Notification of Application/Petition Acceptance) at the front of the AOS package (I-130, I-485, I-864, I-765, I-131)?, or do I have to fill one for each form?

    I know that the answer must be pretty simple, but I have a blank in my mind with all the paper we are filling out.

  4. She can always try to provide as much evidence of her current income as she can and see what happens. They would not outright deny you if they won't accept her financials. They would send you an RFE and ask for her to show more income, assets or provide a joint sponsor. You could always wait to see if you will need the joint sponsor and have all their documents ready to go in case the RFE comes. That way you don't lose too much time.

    That's exactly what we were thinking, we don't want to bother family and friends unless it's absolutely needed. We know we can count on them but we don't want to impose.

    All the rest of the package we have pretty much cover and right now the only concern is this one. One or two affidavits of support... that is the question :-)

  5. The problem with her working freelance is that it is difficult to prove current income when self-employed. They tend to use line 22, Total Income, from your most recent 1040 to determine if your income meets the requirement. Since her last 3 years of taxes have fallen below the requirement, I would suggest you get a joint sponsor, even though she is on track now and currently earning enough annually. That would be your safe bet.

    Even with a letter from the two agencies she works freelance with, stating that they have been providing regular work while we visited in the past and they intend to provide with work in the present (for instance: one of the agencies she works with, provided her with a steady schedule for this school year with Deaf students that will go regularly up to next summer)?

    Is it a chance that they would approve it just with her I-864?

  6. Hi everyone:

    My wife and I are filling for an AoS in my behalf. We got married 7 years ago, and always lived in Argentina. We came 4 times to the States in all these years (I have a 10-year tourist visa), and stayed 3 months each visit.

    Every time we visited, my wife has worked as a freelancer (she's an American Sign Language interpreter and works for a couple of local agencies) but the amount of her earnings were under the required amount by the IRS to file taxes. This year we came to the Stated and found out that we needed to stay to help out her family. So now we are applying for my AoS.

    Considering the money she made these last four months (since we came this time) we are, proportionally, over the 125% of the Federal Poverty Guidelines.

    The question(s) is/are: Since we haven't been in the Stated the entirety of the last 3 years, but taking into consideration that CURRENTLY she's able to "support" me, should we fill out one I-864 (on her name)?, or should we get a joint sponsor and fill out an extra one? (In this case, is it really NEEDED or hers would be sufficient?)

  7. I'm filling out the AoS package papers (I-130 from my wife, I-485 and I-765 that I have to fill out). The confusing part is, since I don't have any plans to leave the country until the process is over, should I fill also the I-131 and include it in the package.

    Our main concern is what if we need to leave for some emergency with my family in Argentina. It would be a good idea to do it since filling it out and sending it with the AoS package is free. But when I started filling out the form in "Part 3. Processing Information" and "Part 4. Information About Your Proposed Travel" they ask for specific travel arrangements, which we don't have because we are filling it only as a contingency measure.

    How do I fill this out?
