  1. This is exactly why why I asked the question the way ai asked it. No I am not a resident of NY because I entered through this state, but because this is where my current address is, even though I do not live there. I am not coming back to NY before heading to Cali, so there is no way I can get NY license. All I need is to be legal those 10 days, where I will need to rent a car and get my Cali license. And there is absolutely no point of paying for my QC license because best case scenario Cali cops will never care if it is paid, worst case they will ask me how come I don't have my NYC license. Thanks for clarifying it NLR.

  2. The problem is, I am "technically" resident of NY now. We crosses the border, activated my visa and left USA for 6 months. We will not come back to NY, will go straight to Cali and will live there. I know very well about 10 days rule, but it does not apply to me whatsoever. This is precisely why I asked the question the way I did. For Cali I will only become a resident in Feb, but by that time my Canadian license will be UNPAID. So I will not break any Cali rule, as long as they do not care and cannot find out that my license is not paid. This only has to do with agreements that MAY exist between states and provinces.

    What I meant is that this 10 day rule does not apply to my situation.

  3. You need to look up the requirements of when you need to get a license in California. Every state is different. For some reason I don't think they'll just let you not have a license because you're travelling.

    What I read is:

    So unless you're homeless, you need to get a driver's license. If your other driver's license isn't valid, then you're not allowed to use that either.

    Sorry but your answer has NOTHING to do with your question. My question is "will Cali know that my QC license is unpaid" and I specifically mentioned that it did NOT expire. "Valid" is a very broad definition. What is not valid in QC may be perfectly valid in Cali, since they have no idea that I did not pay to the thieves (if they don't know it and if they don't care). My friend went to Japan and could use his UNPAID license because Japan does not care if the crooks in QC got their money. US is not Japan, and for some weird reason Cali and QC may exchange this data, so my question was: Do they actually?

  4. Ok, so I got my green card and moved to Cali. I will not need my drivers license till February because I am travelling, so I will apply for Cali license in Feb. Of course I did not pay for my license back in Quebec for this year, because I do not want to give a penny to these thieves anymore ($120 for a license fee) and because I will not use it for almost half a year.

    Question, will DMV of Cali know that my license is UNPAID? Note, it says on the card that it is valid until 2018, so there is no way to know from the card itself whether it is paid or not. Basically, do they have Quebec database to see who actually paid this year? I will need to rent a car in Feb with my old license before ai apply for the new one in Cali.

    What is the best way to ship it Montreal-San Diego?

    I do not care if it takes 6 months to get there, as long as it gets there in the end. Any advice/experience?

  6. Dear Visajourney, I need your help. Tried to look for an answer here, but did not find anything.

    I am Canadian and finally got my CR1 visa, need to activate it before Nov 10th.

    Few very important questions:

    1. I am going to USA for few days on July 4th. Can I enter without activating my Visa?

    2. On August 7th we are going to South America for about 5 months. The plan is the following:

    - On August 7th, drive Montreal to Plattsburgh, activate my visa,

    - Fly Plattsburgh-Miami-Lima

    - In January 2015, fly Lima-LA and start my new life in USA (so I will not come back to Canada at all from South America)

    Does it sound like a good plan? I will activate my visa, but will be outside of USA for about 5-6 months.

    3. Taxes for 2014. Do I file in USA or Canada? I will have no income starting August 2014, so I will have 0 income as US resident for 2014?

    4. Any other potential problems with either USA or Canada by doing all of the above?

  7. Need your advice please. Do I even need to worry about the domicile?

    My wife is USC and has residence in USA, but she comes to visit me often, because of that, she does not work, I basically support her. We have an address in USA where she resides now, but there is no lease.

    Will the question of domicile even come up considering that she lives in US and only comes to visit (very often though)?

    I am going through Electronic Processing.

    I sent AOS package, it was approved. Got checklist for IV which was false.

    DS-260 and 261 also approved.

    I've emailed them IV supporting documents on March 25th, they finally loged them in yesterday.

    Today, I get a checklist for: ELEGEBILITY DOCUMENT which basically says they a scan of my Canadian Passport (which I sent of course).

    I call the operator and she says that everything was approved (marriage certificate, birth certificate etc). They also HAVE a scan of my passport, BUT there is a checklist on the file asking for... passport scan. So she says "it was most probably overlooked and a supervisor will take a look at it".

    Did someone experience something like that? Should I just call and ask to talk to a supervisor to speed it up?

  9. Sent mine on the 6th NVC got it in their system or it showed as received on the 12th.

    NVC told me on the phone they got it on the 12th. Them telling you can't tell until it is complete is made up.

    Did you do Electronic Processing? It is actually easier to track by snail mail because you have tracking info and files have to be scanned, but for EP there is nothing to scan and they review it as is, at least this is what I have been told on the phone :(

  10. Ok, I am confused. All bills paid, all packages sent we are just waiting. However, I never got a confirmation that NVC received our email with AOS and DS260 packages. I called and they said "there is no way to tell if we have received it until we complete the review of it"... I heard that people actually get emails confirming that their packages are received... For people who went EP, how long did it take for your AOS package to be approved? I sent mine on March 10th.

  11. I am sure someone asked already, but I can't find it:

    I did send ENROLL email, then paid my AOS and emailed the AOS package on March 10th. Only 4 days later (on March 14th) I got my ENROLL confirmation and another ENROLL confirmation email yesterday for some reason...

    The guide was updated on March 14th saying not to send the packages before getting ENROLL confirmation. Should I resend AOS package? I called NVC, but of course did not get any clear answer except some "blablabla everything is good", the operator clearly had no idea what I was talking about.

  12. Ok, so we sent the package for I-130 in May and now waiting for 2nd letter. Meanwhile my wife is visiting me in Canada and I have a job here, so we are not in a rush, we were planning to move to Cali in August 2014.

    Now, I got an opportunity to actually go and work in San Diego. I will still be working for Canadian company but helping our US folks. Assignment can be anything from 3 to 12 months.

    So my question now is, we applied for my immigrant visa from Canada, but will be residing in the US now. I will need some king of work permit to work in the US, even though still working for Canadian company, will this be TN visa? If yes, will I be given TN visa while I-130 pending? Say my assignment is 12 months and by that time I will get my NOA2 and will be invited for an interview in Montreal... Is there any way to actually "readjust" my I-130 to let them know that I am legally in the states now. This is a golden opportunity which I do not want to miss, since we will be living in the city where we actually want to move and all the expenses are paid.
