  1. Good morning,

I filed my ROC back in September 2017 and have yet to receive my new green card.

While that is frustrating in itself, I find myself unhappy at my current job and would like to apply for new jobs.

I understand that my dream job at the post office requires me to have my conditions removed before I can apply, but am I allowed to apply for a new job and what would I use to prove I am a legal resident simply waiting for my new card?

The 12 month extension letter expired in September and I never received a new 18 month one (but since it has been more than 18 months anyways, it doesn't matter).

    Thanks in advance!

[1] Definitely you need to send the marriage certificate

[2] no harm, sending the bank statements from September 2017 to October 2018

[3] November, usually update the medical benefit , so any latest documents

[4] Any new lease documents update

[5] Both diver licence showing you live in same address

[6] If you open any credit card or store cards or any joint loan between September 2017 to October 2018

[7]  If you both went and stay in a hotel or air ticket to same destinations

I will definitely send 1, 2, 3, 4! We have nothing for 5 since we don't have cars or drive, 6 since we don't have credit cards or loans and no stays anywhere. I appreciate you taking the time to respond!

Does it say to submit just the marriage certificate? If so, you don't need to submit other things. It has happened to me once when they lost a copy of my certificate and issued RFE for that as well.

    It says
You have not established eligibility to have the conditions on your residence removed. Please submit your response to this request for evidence along with a copy of this notice.

The it says in capital letters and underlined:

    GOOD FAITH MARRIAGE, INSUFFICIENT EVIDENCE

To establish eligibility for removal of conditions on residence, please submit additional evidence to show you and your spouse entered the marriage in good faith and continue to share a life together. The evidence may include, but is not limited to the following:

LONG LIST OF THINGS WE MAY INCLUDE

    Then

    SUBMIT MARRIAGE CERTIFICATE

Submit a photocopy of the original marriage certificate for the marriage of ME and HUSBAND. The marriage certificate must be issued by an appropriate civil authority. In order for the marriage to be considered valid for immigration puproses, it must have been legally valid in the location where the marriage took place. The document must include the date of registration and signature of the registrar.

So does that mean both? or just the marriage certificate? (which I definitely included in the package I sent)

  4. I got a RFE this morning and I'm a little confused.

It says: GOOD FAITH MARRIAGE, INSUFFICIENT EVIDENCE and then on the next page SUBMIT MARRIAGE CERTIFICATE

    I have sent in

    • a bank statement with both my husband and I sharing a checking and savings account
    • tax returns showing we filed jointly
    • I sent in my marriage certificate
    • I sent a renting agreement showing that we lived with his sister and her husband
    • I sent photos (which I know are not evidence)

We have moved to a new house which is in my BIL's name. We pay half in cash to them but we are not on the mortgage.

Now I am a little baffled as to what to send to them. We don't have children, we don't have credit cards and we don't have any shared bills.

    I will send:

    • an updated bank statement from this year
    • tax returns from the past years since we can't file yet (or should I wait until we file and send that too?)
    • affidavits from family members to prove we are in a real relationship
    • a copy of my marriage certificate

  5. I never applied for N400, this is what I got recently:

My Case Was Transferred And A New Office Has Jurisdiction

On October 29, 2018, we transferred your Form I-751, Petition to Remove Conditions on Residence, Receipt Number EAC, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case.

I haven't received a notice in the mail so I don't know why they moved it yet.

  6. I'm getting nervous. I never received the second extension letter and the case inquiry has been stating the same thing since April:

Case Was Received At My Local Office

On April 9, 2018, we received your Form I-751, Petition to Remove Conditions on Residence, Receipt Number EAC1734XXXXX, at your local office. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Is there anything I need to do?

  8. Hello!

My I-129F got approved yesterday and I am facing the next step. I moved within Austria and tried to change the address online, but it would not let me choose the right state as all states were American states and I am not living in America.

Now that it is approved, I have no way of changing it at all and I don't know whom to contact.

Since the NVC is going to mail the petition to my embassy, do I have to contact my embassy or call NVC and let them know?

    Thank you in advance!

  9. Hey! Thanks for replying :)

We are waiting for the 5 month mark and then he is going to call USCIS to ask where we stand! I really hope we get the NOA2 before the 5 month mark, but it's only 4 more weeks until then..

My biggest question right now is about the language that the interview is going to be in. I wonder if it is going to be in German or English and somehow this is stressing me out even though it shouldn't as I am fluent in both :P

Please keep me up to date on your process, I am really interested to see what lies ahead for us :)

  10. Been looking for a topic in here for Austrian people who have either applied or are currently in the process of applying for a visa in the US.

My fiance (US citizen) and I have applied for a K-1 visa. We got our NOA1 on the 6th of March and we are at the Texas Service Center.

I know it is not yet time to worry, but I kinda hoped there would be some Austrian people around who went through this process and have some kind of tips or advice on the whole process or on the embassy. I have read all the feedback on them, but I suppose not everyone updated that :P

It'd be nice to get some insight from someone who has been through this :)

  11. Did you check online at USCIS? Our ARN was assigned within a few days of our NOA1.

Sometimes I think the "date watching" on Igor's is counterproductive for me ;) It just depends on what I read!

    Yeah I checked. It says:

On March 6, 2014, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you.

    No ARN yet :/

  12. Hello!

I used the search function, but couldn't find the reply to my question anywhere, so I'll try it this way.

I am filing for the K1 Visa and am filling out the G-325A for myself.

My parents were both born in Poland and both their first names and their birthplace use special characters.

Do I put the right symbols in (for example: Łódź instead of Lodz) or does it not matter?

I know there is a space to put non-roman letters in if MY name has different letters (luckily that is not the case), but there is no such space for my parents' names.

    Thank you in advance!

  13. Hello VJ!

I am member of a long distance relationship community and a couple of people said to make an account here while going through visa stuff, so here I am!

A little bit about us: I am currently living with my parents and younger siblings in Vienna, Austria! My fiancé is living in Connecticut and we just started to fill out forms and catalogue evidence! We are aiming for a K-1 visa and plan to get married in about a year judging by the approving times (CT takes about 5 months).

Stephen and I have been together for one and a half years, met online through a video game and met in person 10 months later in America. I have spent a summer with him and we plan on just one more visit before the wedding, so we can save up money for the wedding and the visa!

I will have lots of questions down the road, but so far it all seems doable. I know it is going to be a long way to get my visa and move to be with my fiancé, but I feel confident about it.

I am looking forward to talking to people who are going through the same things :)
