  1. We haven't checked since my spouse was still transitioning, but as chance would have it, he's moving here today so I'll be able to let you know within a few days if his SSN is active since we'll try opening accounts again.

    One update I have based on my initial post is that while CA DMV allows you to make a state ID with a freshly minted SSN, they actually require your green card to verify your legal presence. You will only find this out after starting to call them (after waiting the requisite 6-8 weeks) and being told they are waiting for "legal presence check" to clear, which they can't tell you how long it will take. If you mention you've read on the internet that you can fax in a copy of the green card (e.g., http://forums.immigration.com/forum/advocacy-efforts/issues-related-to-obtaining-driver-s-license-from-dmvs/331873-ca-driver-license-delayed-due-to-legal-presence-check-pending) they will let you do so, and then you just have to gnaw your thumb for couple more weeks.

    Although the above doesn't really relate to your question, just wanted to show that DMVs are not the best indicator of whether your SSN is active. In retrospect, it seems obvious, but at the time we still believed the DMV must be running the SSN through something before taking our money and promising ID cards within x weeks.

    As for your other question, the impression I was given was that the only way to really speed things up would be start building a credit history ASAP.

  2. Looked around on these forums and on the internet generally, but we couldn't really find anything that fit our particular case.

    We got the SSN fairly quickly after POE (within a week), but when we try to use the SSN for opening accounts, we are told the SSN is not yet active. Does anyone know what is a reasonable amount of time to wait before we should expect a number on an already-issued card to be active in the system? (When should we start bugging the local SSA office?)

    How long did it take before your SSN became active? Did you have to do anything special?

  3. My husband just arrived in the country on an immigrant visa. He applied for his SSN and received it in the mail yesterday. Today we tried to open up a bank account with it and it said the number wash´t active. Has anyone had this problem before? Shouldn´t he be able to use it right away?

  4. Hello, I am thinking of ways to officially propose to my Girlfriend after filing K-1 visa application. I already proposed over Skype but want to do it in person the right way and put the ring on her finger.

    I was thinking of proposing with a huge sign at the airport when she arrives in a few weeks. As she comes out of security and getting her luggage I would be kneeling on one knee with a sing that says Will You Marry Me holding open the ring box.

    Is this not a good idea to propose when she walks out and into my arms at the Airport?

    Any advise is greatly appreciated.

    I think it is a great idea!! She will be so excited to finally get through immigration and all that and see you, it will be the perfect culmination to this whole long process!!!

  5. WRONG, WRONG WRONG!!!!!!!!!!!!!!!!!

    An I-130 petition is NEVER closed by the NVC, ever. If an I-129F survives the NVC, it could still be closed by the Embassy or Consulate if they receive word that an approved I-130 is on-station at the NVC.

    OP, since the CR-1 is your preferred route keep after the NVC to obtain a case number for the I-130; once received, notify the Embassy that an approved I-130 is on-station at the NVC so the K3 route can be administratively closed.

    THanks for input. What happened is both were approved but the K3 arrived first to the NVC so was given a case number and sent directly to Madrid embassy They are still waiting to give the 130 a case number. After speaking with my lawyer and a supervisor it is clear that I am able to pursue the K3 route until the NVC gives my I-130 a case number, after that will have to go with the I-130. Since my case is already at the embassy and ready to schedule an interview though things could move fast in either direction. The supervisor assured me that even if I was rejected for the K3 I could still proceeed with the I-130, so that will never be cancelled.

  6. Can someone pursue both CR-1 and K3 to see which one gets a faster interview date? Our K3 survived through NVC and it will be at the consulate soon, I can't decide which route to take since I have no idea which one will be faster at this point, because we want to take whatever route reunites us faster and don't care about the advantages of CR-1 at this point...I just want my hubby sad.gif

    If that's not possible and you have to just go with one...does anyone know if we can expedite our CR-1 with the NVC right now? since the k3 will be at the consulate and I-130 still sitting at the NVC to be logged into the system (no case number yet) I know they don't like giving K3s out, if one asks to expedite the case so that they can take that route and not the K3, do you think it will be approved?

    I am in the same boat. My K3 went to the Madrid embassy before I got a case number for the I-130. Did you end up doing the K3? We are thinking of scheduling the K3 interview and while waiting for the I-130. What happened with your case?

  7. So I filed both a K3 and I-130. They were both approved on Oct 7th and both received at NVC on November 12. On Nov 13th my K3 petition was given a case number and send to the Madrid embassy where it is now ready for an interview. My I-130 is waiting for a case number at NVC. Anyone ever have this happen before???? I would rather go with the I-130 right now, can I schedule an interview with the K3 and still keep processing the I-130?

    Got NOA1 - Oct 8th 2013.

    Mine was changed twice, once shortly after NOA1 and then after 9 months it was changed again and I was approved that day.

  10. October 3 NOA2 here. Just called DOS. The lady said that they don't have my file yet and to call next week. Glad to hear that it's now "next week" not "8 weeks".. hehe.. Getting excited.. dancin5hr.gif

    Mine was processed by CSC..yours is from TSC and might be faster but yes, just hang in there...

    I have some data that might be useful and helpful to some.

    My I-130 petition (with an MSC number) was approved in 110 days (NOA-2 on March 11, 2013). Then it disappeared into a "black hole" between USCIS and NVC. Multiple calls to the customer service numbers and emails to NVCResearch to no avail (including asking a "second tier" USCIS rep whether the petition had been adjudicated at a local field office). As of April 17, it had not been received by NVC (and I have not yet heard back from NVCResearch or the promised USCIS research). So, I went to my U.S. Congressional representative, and within a FEW days, learned that the petition had been sent by MSC (NBC) to the Houston field office (as I had suspected).

    USCIS told my Congressman: "This is an update to your April 12, 2013 email regarding the Department of Homeland Security's (DHS) Office of Citizenship ad Immigration Services' (CIS) receipt number MSC___________. We researched this case with the CIS' Field office in Houston, Texas. They indicated that although this case was approved on March 11, 2013, it was not forwarded to the National Visa Center until April 9, 2013."

    Based on my observations so far, it appears to me that petitions actually adjudicated at MSC (NBC) are generally sent in a timely fashion to the NVC. It also appears that the petitions that disappear for prolonged periods between NOA-2 and receipt by NVC are being adjudicated at local field offices.

    A knowledgable official (a division director) at the U.S. Dept. of State in Washington recommended that I write USCIS "...to determine when the case was sent to NVC and to request a tracking number for the shipment in which your petition was mailed to NVC." This is exactly what I have done. And where to send the inquiry? More on that below.

    So, what I suggest is this. Anyone whose petition has not been received by the NVC after 30 days, go to your U.S. Congress representative. Ask to talk with the aide that handles immigration issues. Fill out their Privacy Authorization Form. Find out where your petition was actually adjudicated (remember, even if you have an MSC number, it may well have been adjudicated at a local field office). Then write the Director of that local field office.

    Here is the letter that I have just sent to the Houston field office:

    Dear Ms. _________,

    This letter is in regard to an I-130 petition which was approved with a Notice Date of March 11, 2013 (MSC__________; petitioner ___________, DOB __________; beneficiary ______________, DOB ______________). A copy of the I-797 Notice of Action is enclosed.

    The NVC has not received this petition (as of the last time I checked, 04-17-2013). My U.S. Representative, ________________ has informed me that this petition was adjudicated in the Houston USCS field office, and that although it was approved on March 11, 2013, it was not forwarded to the National Visa Center until April 9, 2013.

    Mr. ______________, Bureau of Consular Affairs, United States Department of State advised me in a letter dated April 16, 2013, to “...contact USCIS to determine when the case was sent to NVC and to request a tracking number for the shipment in which your petition was mailed to NVC.”

    Please confirm the date when this petition was sent to the NVC and provide me with the tracking number.

    In addition, assuming that the information provided to Congressman ________was correct, please provide me with an explanation or rationale for the delay of 29 days between the approval of this petition and its mailing to the NVC. Is this time period the standard operating procedure of your office or does it represent an error or exception?

    Does anyone else need info for their local field office?

    I am sick of USCIS treating people like this --- people who are carefully following all the rules. Causing agony and anguish when an approved I-130 disappears into a black hole, sometimes for months at a time. It would not be so bad if there were an efficient and courteous liaison between U.S. citizens and USCIS and NVC. But, as many others have experienced, the customer service people are frequently ill-informed and/or borderline rude. I would not mind waiting if the customer service people could tell me in a timely fashion, "don't worry, it is not lost, it was adjudicated at your local field office and they batch approved petitions and send them once per month or six weeks to NVC. If you have an emergency situation, please contact ________________"

    Finally, they are trained to respond rapidly to congressional representatives (I have their published guidelines on this!). It is clear that they virtually ignore U.S. citizens (who do not happen to be members of Congress). This is particularly galling around the income tax deadline...

    Parenthetically, if the Directors of the field offices ignore your letter, I know what the next step should be (complaint to the Office of the Inspector General, which I have found effective in the past in other bureaucratic nightmares).

    Is there a downside to writing the USCIS field offices to ask them for a ship date and tracking info (as a Division Chief at the Dept of State recommends)? I doubt it. Your I-130 has already been approved by the USCIS. They are just being negligent in sending approved petitions in a timely fashion to the NVC. They need to know that they are not anonymous and unaccountable. (But, be factual and courteous.)
