Sorry but it's not my idea.. and yas, i didn't talk about only how to get EAD. I heard these things from my lawyer.

My lawyer told me that i have to choose apply VAWA with I-485 or apply only VAWA at this time. Also he said i can cancel my I-485. But i don't know what that mean.

So i tho maybe if i apply VAWA with I-485, I can get EAD soon but if i get AOS denial, they remove me.

If i choose another way, apply only VAWA then apply I-485 after i get VAWA approval, i can't get EAD for year but they don't remove if i get AOS denial.

Also i can choose that way, apply VAWA with I-485 then cancel it I-485 after get VAWA approval, apply I-485 again. If i choose this way, i can get EAD first, i can work until cancel I-485 ＋ If i get VAWA denial, they don't remove me because i cancel it I-485? That's why my lawyer recommended cancel I-485?

I don't know that why i wanted ask...

I just want to get to my Status, I don't want to any Illegal things. I didn't Illegal work or nothing. I just waiting for apply VAWA almost year... But even my lawyer doesn't give me a correct information. I called every hot line but they said they can not answer because they are not lawyer or they don't know, now i don't know how can i get correct information n witch way should i choose.

I really sad about you thinking that i just trying to play with USCIS. I had Domestic Violence as a everyone, i trying to get new life. That's all...

Can i apply VAWA with I-485→get EAD→get VAWA approved→Cancel I-485→apply I-485 again?

Or if i canceled I-485 one's then i can't apply I-485 under the VAWA?

I Understand i can't use EAD if i canceled I-485. My question is if i canceled I-485 one's then i can not apply I-485 anymore?

The EAD is tied to the I-485 app. After you apply for the I-485 you are eligible to receive the EAD (if you qualify). If you withdraw the I-485 or if it is denied your EAD is no longer any good. You might still have the physical card but it will come back as not valid if run through e-verify. Also you and your employer could get in a ton of trouble if you work with and expired or cancelled EAD.

No pending or approved I-485 = no valid EAD.

But how about apply VAWA with I-485→get EAD→Cancel I-485→get VAWA approved→apply I-485 again?

Because my attorney saying that i can cancel my I-485 n i don't know why he saying that...

If i apply VAWA with I-485 then i get denied my AOS, they remove me but, If i apply only VAWA then apply I-485 after get VAWA approved, they don't remove me?

VAWA doesn't give me a SSN or EAD. I will get SSN n EAD because i will app I-485, n if i get I-485 denied i can't use SSN n EAD, they will remove me, That's why a lot of people app I-485 after get VAWA approved, but if i choose that way i can't get SSN n EAD for year or more, Is that correct??

I mean, if i get only VAWA, denial I-485 n Uvisa, what happens? ICE doesn't deport me but i have to go back to my country anyway? Is it possible to find a another way to sty in US? I used VWP when i came here, so i can't get any visa if i couldn't get GC or Uvisa this time?

You have the option to wait your Vawa approval and then file out I-485 and I-765 and receive your work permit(it may take one year)or file out I-485,I-765 along with form I-485 and then receive your EAD (30/90days).To stay legally here forever you have to file for adjustment of status(I-485).

He said, I have a two options. I apply VAWAI(I-130) with I-485 n I-765, or i apply only VAWA(I-130) That way, maybe i receive Vawa approval one year after, then i can apply I-485 n I-765, maybe i receive work card n SSN 3-4month after i apply those, but even if i canceled it I-485, still i can use work card n SSN, because those are with VAWA.

I have a VAWA mean's i have a little possibility of deport, VAWA is not Status but i can sty in US n i can use SSN n can renewal my work card every year, that's what i hared from my lawyer.

If it's not the truth, do u know how long can i use work card n SSN if i have only VAWA?

I going to apply VAWA ＋ Uvisa too, my lawyer said if i apply for VAWA with I-485 n I-765 then if i get denial, still they can't deport me if i in the process of Uvisa at that time, It's that correct?

Dose immigration check my Bank account in China or US? They could suspect my Illegal work if i get money to my Bank account? Or immigration never check my Bank account? USCIS and ICE don't have public records of deportation.I mean if someone wants to know has to file a form called FOiA ,it takes months to receive the answer,and the Consulates do not ask this form ever.But when you are inside the US and you apply to get a visa to go to another Country they will see your status inside the US and they will notice your visa expired or your authorized stay expired and then your chance to get a visa is not good at all.

Removal proceedings is "deportation". If you had the AOS denied you will receive a NOTICE TO APPEAR(NTA) in Court, in your case if you don't have a Vawa pending they will remove you from the United States and send you back to your Country,if you have a Vawa pending they will not remove you until adjudication of your Vawa.

If you fear for your life going back to your Country then you should seek the assistance of a qualified immigration attorney to help you with this matter.

All kind the people can be removed from the United States ( criminal and no criminals), in your case if they remove you from the U.S is because your AOS was denied and not because you are a criminal, if you are not one of course.

It's gonna hard to get another country’s VISA? Is deportation or court has some record here? It's not criminal, but mean's i did an oversaty?

Because my job is easy to find from another country then my country, if i get deportation n that mean's lose my chance to live another country then that's really hard to me...

If you file vawa alone you can't apply to getwork permit before vawa approval,it may take 1year,and if your vawa is denied immigration not start with removal proceedings. IF you file for adjustment of status along with vawa then you can file to obtain work permit,but if your AOS is denied they will start with removal proceedings. Join the thread Vawa part 4.

Your juvenile record is still available for the government to see, not regular people but the government... so in my opinion you will need to disclose it.

But US government can not see my juvenile record. China government can see only my Arrest history.

I had a Vawa case approved a few months ago and the girl was forced into prostitution by her husband, but no criminal record of prostitution, her vawa case was approved without any problem, you can't have a criminal record that's all.

Hi i from China. I married Navy guy and had Domestic Violence from him. I want to the DVshelter for 4months and i working with a DVcaseworker and lawyer. My attorney told me that i have a Enough proof app for VAWA. But i have a past that was in the juvenile. My ex boyfriend forced me a Drug use and Prostitution. He took my all money then if i try to run away from him he hit me so bad... I couldn't get away from the situation at that time. One day i got arrest and I taked a prostitution but they just put me in the juvenile. I was under the age so i don't have any Criminal record in China or US. I got a documents and letter from a probation officer. The documents and letter didn't say that it wasn't my own will. Also i explain it on the my status document.

It's just a Arrest career for immigration...? Someone got GC who has Arrest career or Criminal record from VAWA ...?
