  1. Good morning, i have a question on this form, if someone could please help me out.

For this form, the immigration notice stated that two needed to be sent - one for my husband (Which is the one adjusting his status) and I needed to send one (i am the US citizen and he is ajdusting thorugh marriage with me).

Do we need to send two forms or one. Also, for the fee - do we need to send one fee of $505 and the additonal fee for the Biometrics???

thanks in advance for your time

  2. WOOOOOOOOOOOOOHOOOOOOOOOOOOOOOOOOO

EARLY TODAY WE TOOK ALL THE DOCUMENTS THAT THE OFFICER REQUESTED, AND SHE DIDN'T EVEN WALK US BACK TO HER OFFICE, SHE STOOD US IN THE HALL WAY BY THE DOOR, LOOKD THROUGH, AND SAID, OK, THANKS! ( I WAS ABOUT TO DIE) WHEN SHE TOLD US, YOUR CASE HAS BEEN APPROVED AND YOUR CARD SHOULD BE IN THE MAIL WITHIN TWO WEEKS..............

SUPER HAPPY AND EXCITED FOR MY HUSBAND........!!!!!!!!!!!!!!!!!

I am in the same boat, just make sure to send all the documents as fast as possible, even though you have 90 days to send it but you also have to keep in mind that officer can still take good amount of time after getting your documents.

  3. My husband had his interview today, and it did not go well, (or so i think) we did not have bank statements and the officer requested a revised copy of his birth certificate to be re-translated........

I hope that with the information that she requested - that he will get approved, i feel like we took more than enough evidence and all the documents that were requested.........any advise???????????????????????

    thanks

  4. Do not fill out supplement A. Doing so would basically be admitting that your husband entered without inspection, which he did not. We sent back the yellow RFE notice along with the supplement A they sent (leave it blank). Our attorney also sent a letter explaining why supplement A is not applicable to my wife and we completed an affidavit explaining her entry circumstances. I really think you will be okay with the passport stamps. We didn't even have that, so you're ahead of the game.

Awsome, thanks again for the info, i will mail that out tomorrow, and will await their response.

  5. You can try filing an FOIA request here:

    http://www.cbp.gov/site-policy-notices/foia

Like I said though, it takes a long time to get a response. We are going on 6 months now for ours, so you likely will not have enough time to wait for that. You can try resending a copy of the passport page with the visa stamp again. We responded to our RFE with the same exact documents we sent in the original package and USCIS accepted it.

Great, (i have requeste an appt with immigration, because i was not sure what to do about the supplement A form) but that can be cancelled, i was just not sure if photocopies of just the passport stamps would suffice for evidence...

Also - what did you do with the supplement A (did you fill yours out?????) or should i send a cover letter saying it is not applicable to my husband???

Again - really appreciate your adivse.

    thank you.

  6. DO NOT complete supplement A. Your husband entered the US legally, so it is not needed. Copy the Visa in the old passport and mail it in. Also check the following link for his entry info:

    https://i94.cbp.dhs.gov/I94/request.html

Thank you for your response, do you know how i can obtain records that are older than 10 yrs, i have tried searching his passport info, and nothing is coming back because the data base only hold 5 yrs of info. thank you both for your response, i have search the I485 and i was filled out correctly, now i need to optain the records.

  7. Good Morning, I need some guidance/advise.

I have submitted AOS package (late April) for my husband - he has already received his appointment for his biometrics, however, yesterday in the mail, we received a letter "Request for Initial Evidence I 485" with it, they are sending me "supplement A to Form I485 for me to fill out.

My first question is - my husband came to the US with a Visitors Visa and has his passport stamped - they are requesting "evidence" -----can i just send a copy of his Visitors Visa / stamped old passport ?????

Also - is there any reason to fill out supplement A (my understanding was that this form was not suppose to be submitted if you entered legally into the states)

if anyone can please guide me.

    Thank you

  9. Will do, thanks so much for the information ;-)

    Congratulations to the recent approvals!!

Within a couple of weeks your petition will be shipped to NVC, and then it'll take probably 4-6 weeks for them to assign your case number and invoice identification number. Use this time to start preparing your I-864 and assembling your documents for the AOS and immigrant visa packets. Head on over to the March NVC thread and read the first two posts for a lot of great information!

  10. Thanks BOS for your prompt response,

I am the petitioner for my husband - (I-130) - that is what we are waiting the approval for, I believe you answered my concern and by looking at the spreadsheet, it takes about 2 months to get a response from the Nebraska center - after the case has been transfered. thanks

I just want to verify because your profile says you're going through adjustment of status. Is that correct, or are you awaiting approval of a stand-alone I-130 petition for an overseas beneficiary?

Assuming the latter is the case, both Nebraska and Texas are pretty slow, though Texas may be marginally better. We've been keeping track of where June filers have been transferred to and who has been approved on this spreadsheet. If you take a look you'll see the approvals for June filers so far have generally been either from California Service Center, or for special cases (expedites requested, auto-expedites for Philippines beneficiaries, etc.). Nebraska appears to be processing mostly April filers right now based on approval statistics here on VJ.

Visit this USCIS site to review the criteria for an expedite: http://www.uscis.gov/forms/expedite-criteria. It's pretty strict, and with the current backlog, USCIS has stressed that they are rigorously enforcing these criteria.

  11. Good Morning, i am a june filer PD 6/27/2013; I received a transfer notice to the Nebraska Center on 12/27/2013; my question is, is the approval process slower at this center, I have noticed that people that were transfered around the same time to the Texas Center have already received approvals.

Can someone please let me know, if you are still waiting like us?

Also what form or what are the requirements to submit an expedite ....

    thanks

  12. Hi Everyone, and thank you for your responses,

he is in the US, and entered with a Visitor visa, i am trying to get his Adjustment of Status (resident card) not sure if this is a visa or what its called.

some people i talk to say, it doesn't take that long, but waiting for a response on a I130 for me seems quite a bit of time, but thats why i would like to know if anyone has any information, thanks

are you chasing a visa or hunting a green card?

is husband in USA with you, not to leave till green card in hand, or something else?
