  1. Hey guys!!!

Im back with some good news. I was busy. Just got the time to update you guys.

My wife had the interview on Nov. 3rd. She got accepted and she is in the US with me.

The process was a bit different than what I expected ( or rather remembered from my case and my dad's case).

She had her interview in Abu Dhabi UAE. I had mine Italy couple of years ago. In my case NVC scheduled the medical and it was a day before of the interview. With Abu Dhabi we had to call the hospital directly. Also in Italy, the result was sent to the embassy by the clinic. In ABu Dhabi she had to go the next day and get a sealed packet.

Oki doki, so let me breakdown the whole miserable trip :D

2 days before my flight they emailed us that the embassy is closed on the day of the interview (sigh...) and that they have moved the the date from Sunday to Wednesday. My wife was already in Dubai and this was kind of unacceptable. I emailed them and explained to them that she is there and we will be leaving UAE on Saturday. There is no way they can prepare everything in less than a day since Friday and Saturdays are the weekend in UAE. They were super cooperative and moved the date from Wed to the previous Monday.

We showed up at the embassy and they kind of refused to let me in. I explained that this a marriage based interview and I am the sponsor. The Indian guy in charge of the entrance acted like he is doing me a favor by letting me in. We got it, got a number and sat there. In 25 minutes they called her number. We went by the kiosk and they asked me to sit down and have her be alone!!! (No one likes me :D). Basically they wanted to talk to her alone. After that they asked her to do the biometrics and sitdown. In 10 minutes, they called her name on the speaker. We were directed to a room for the interview. I got in and the officer was behind a glass. I spoke English and he responded back. He was this blond blond American dude. As soon as he saw my wife he switched to Farsi. I have not been this shocked in a while. His Persian was so good:D He basically said "Ms. XXX? Come in and sit down". Then you looked at me and told me in English to go out and wait (again no one likes me:D).

In 4 minutes she got out and told me that she is approved.

The office did not look at any of the documents we brought. Not a single one. No financial documents, no pictures, no proof of marriage. We brought 4 albumbs of pictures, skype and Oovoo chat and call logs and etc. They did not even look at the original docs.

    He asked her:

    1) How did we meet?

    2) whats my job?

    3) Whats her education?

    4) Why havent we lived together?

Her response to the last question was that we were waiting on the GC process to be done.

Thats it. He told me that she was approved.

He gave her pink slip and told her to come in 3 days and get her passport, visa and the packet.

Weird part, they made everyone register for Postal services as they mentioned specifically that no packet will be given in person at the embassy. Everyone has to retrieve their docs through the postal station...

Any how, we had to make another trip to that city to get the stuff. I got the ticket for the same day and we flew back on the 9th.

I want to thank you all for all of the support and the information that you shared. VJ is a great community. I hope all of you are joined by your loved ones soon. Wish you all luck and tons happiness.

    Stay strong;)

Freaking finally. I called them and NVC told me that my wife got a date. Her PD is 19JAN2013. The interview date is Nov 3rd in Abu Dhabi UAE. Thanks guys for all of the support. Oh boy this is gonna cost me around 6K. This is a downside of not having a consulate in the beneficiary's country. I wish you all luck wink.png

  4. What exactly do you mean KiwiPouPou?

I'm F3 and my PD is 07/30/2003 (current 01/22/2003) I'll submit my DS-260 tonight and if everything is right my case will close in a few days(I hope), may I receive I/L before my PD become current?

Your Visa category is F. Looking at the Visa Bulletin, you can see that there are limits for each category and there are PDs established.

Visa Category IR do not have limits. For example spouse of a citizen can start the process of AOS and IV packages as soon as NVC receives the case. This is not true for an LPR. NVC will only send in the AOS and IV fees only if they feel the category of the applicant is getting current. Hence if an LPR PD is 3 years behind, they wont start working on his/her case unless they know it will be current in less than 6 months.

Your category has annual limit. Based on your comment, your case has started in NVC. The PD comes into play in this scenario:

    1) NVC notifies you of the interview date. If PD is current you get your Visa (assuming you are approved at the interview)

    2) If PD is not current, you wont receive a Visa until your PD is current.

This does not apply to IR category. Their PD is always current and there are no annual limits for them.

  5. I'm new here .. I have a question, I'm also waiting my cc and expecting it this month.. I received aos checklist on sep 19th and i sent everything on sep 22 , now my husband called NVC they said they didn't start processing yet.. What does that mean? I thought they r already processing my papers since they asked for missing documents .. sad.png

Once it is in the system, operators dont have any insight on the process. All they see is that it is entered in the system. They cant tell you if someone is working on your case or not. I know that it is a bit stupid but there is this gap between case entered and case complete. I was told this numerous times that they dont know if someone is working on the case or not. Last time I called, Sept. 5h they told me the same. I got case completed on 6th lol

  6. thank you s much this is such a big help . btw my pd is 7/6/2012 my noa2 9/25/13.also i passed the citizen interview and i;m waiting for my oath ceremony this month October i hope after that the process will speed up thunks again and good luck to you and everybody .

Once you become a citizen, your category changes. You basically skip the wait list. As of now, NVC will only starts the process of documentation gathering if they feel your PD is close to be current. With citizens they start the process right away as there is no PD for citizens. Good luck. I suggest calling NVC and letting them know as soon as you turn a citizen

  7. hi everybody , my case just got approved 9/25 yes.gif and i got an email next day my case sent to nvc would anybody tell me whats next ?and how long will get interview? and what documents i need now for this process also how do i know my case voice number should i call the nvc or they will call me ? sorry for these too many questions any help i will appreciated . thanks

    Congratz!!!

This is only the beginning. It usually takes 2-4 weeks for your case to be received and processed in NVC. After that NVC will assign you a case number. The first three letters of the number will be your embassy code. After that. 7-10 days, they will send you an invoice of $88 for the affidavit of support form I-864 (Check to see if you are eligible to fill out the EZ edition which is the simple one). Read the instructions and have it ready. Once you get the invoice, use the case and invoice number and access the ceac website. Pay the fee and print out the coversheet. Next step is to send in your documents. Payments usually gets accepted in 3 days. After that depending on your PD date, they will send you another fee which is the IV fee of ~240. Do the same as AOS, pay and gather all of the docs and send int the physcial documents and translations. You also need to fill out DS-260 form (which is online and available on the ceac website).

After this it is usually 20-30 days to review all of the submitted documents. If no issue is observed by NVC, you will get your case complete.

To give you an estimate, my I-130 submission was Jan 2012. USCIS accepted my case in June 2013. Got my fees in July and sent in all of the docs in first week of August. I got my case complete on Sept .6th. I have not heard anything back for Nov in terms of interviews. Crossing my fingers for Nov. otherwise I have to wait for Dec.

    Good luck

  8. What about the AOS package? Is that still mailed to NVC in "physical form"?

DS-260 is not the same as electronic processing. DS-260 only replaces the paper based DS-230. All of the physical documents still need to be sent to NVC unless directed by NVC. As of now there are only 6 embassies that ask the applicants to submit files online.

  9. I have received the invoice for my wife, but haven't paid it. It doesn't say anything about either DS230 or DS260.

I am waiting for the birth of my baby, to send the birth certificate to NVC, so they can generate a new invoice for her. Then I would pat both invoices and send everything together, AOS, and IV info, unless it's done online.

Got it. When you pay the AOS fee, it gives a you cover sheet. On the cover shee it directs you to a link on the NVC that shows what you need to file. Before Sept. 1st, they had DS230 and DS260 on the webpage. They removed the reference to DS-230. Now everyone is required to fill out the DS-260. I started my DS-230 before Sept. 1st so I was not required to fill out DS-260. I filled it out no matter what, but I got case complete a day after filling out DS-260.

  10. I haven't received an email instructing me to file DS-260. I received the invoice for DS-230, but haven't paid it yet as I am waiting for my baby to be born, probably in the next 2 weeks, to send her birth certificate and get an invoice for her DS-230 and send my wife's and baby's DS-230 at the same time. I have paid the AOS fee, but haven't sent it yet, as I am waiting for my baby to include her in the form as well.

So my question is, if I haven't received and email instructing me to send the DS-260, does it mean I should send the DS-230 when I have received and paid both invoices?

    Thanks for the help guys.

DS230 is obsolete as of September 1st. Have you received the IV fee? If no, then you should wait. Check the Ceac portal. If the DS-260 is enabled, fill it out.

  11. AS long as I remember, if married and have kids, they are automatically eligible to receive permanent residency. I think this occurs when you fill out form DS-230 (which is obsolete now. NVC uses online DS-260 since Sept 1st 2013). Best bet would be calling NVC. I got my GC through my mom. My aunt petitioned for her before I was born. By the time USCIS processed her I-130, I was 17. My dad and I became eligible automatically. AS long as the kid is under 21 he/she is fine. If it is close to being 21, you have to notify them.

I dont think US recognizes the common law. NVC asks for marriage license. Again check with NVC
