  1. FILING a tax return is different then OWING taxes. You can file a tax return with zero income and get a refund if you qualify for any of the income tax credits. He needs to state that his income was zero and as a result was not REQUIRED by the IRS to file taxes. Go to the IRS website and look under "who must fiel taxes". Just to wanr you, there are cases where a person has zero earned income yet still is required to file a tax return based on their situation--i.e. a young child baby-sitting and making anly $600 must file per IRS rules or some one with mare than $400 of interest income to name two.

    Since he was self employed, he pays himself a salary correct? He must report how each employee is paid to the IRS and complete the paperwork as part of his business taxes. There are a few choices of how to pay yoursef--i.e. salary in the form of a paycheck requiring a W-2, compensation that can be paid using the 1099_MISC form, net profit from operations, or on Schedule K-1. So he should have copies of this information that his business gave to him so he could file his personal tax return. If he is using Schedule C (net profit from operations) for the business than he does not have the W-2 or 1099_MISC. He just needs to show that his net icome was above the 125% of the poverty level for his family plus the immigrant and he will be good. Tax transcripts contain all the information needed by the USCIS so if he has those and the income is sufficient than he is okay.

    and as for now the petitioner sponsor doesn't have tax transcript so now i need a writen explaination for that and i dont know the way how to write an explaination :(

    can u give me an example? and on what kind of paper we should write that

  2. Are you talking about the table that shows how much income tax someone owes based on adjusted income or are you talking the basic From 1040 with all the atached schedules? I would personnally get a tax TRANSCRIPT to show what that person filed. If self employed, that person should have completed their own W-2 or 1099_MISC depending on how they are paid from their company. A tax TRANSCRIPT is what they filed with the IRS and will show the information that the USCIS requires without supporting evidence.

    i dont really know what irs tax schedule is but we have tax return transcript. we recieved chechlist in that they are asking for the irs tax schedule?

    and the person owns the company so how he can issue him self a w2??

  3. Theyre gonna care about 2013, 2012, 2011, so everything before 2011 I don't think theyre gonna care about.

    so for the past three years if your father hasn't worked just put zeros in q13. and write a letter that says its zero because he hasn't worked or he haven't been in the us etc.

    and again since you have a co-sponsor I wouldn't even worry about your father's I-864 too much. when I sent mine they requested information about the co-sponsor they didn't even care about my I-864

    so make sure the co-sponsor fills out their I-864 and sends proof of income

    the co sponsor is self employed so which documents will be required for him and what is IRS tax Schedule.

    after waiting 60 days i got an email from nvc about AOS
    so i want to know few things about AOS (i-864)

    my father's frd who is filling AOS for me so does my father also have to fill AOS for me????
    and am little bit confused in i-864 part 1
    if my fathers frd is filling it so which option have to be marked??

    and which documents will be required for the frd to submit????

  5. my father file i-130 for me and now our status is in Post decision activity and here is what it actually say:

    On August 18, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.
    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.
    Now i want to know whats next and how much processing time is remaining and which documents i will be required by nvc

    A check or money order from a US bank in US dollars.

    If your father does not have a US bank account, then you will need help. You need a US friend or relative to write a check from his bank account or is willing to get a money order here.

    You cannot use a foreign bank. You cannot use an international money order.

    my father has a U.S account so i should mail that check with my petition..?????

  8. YOU NEED AN IMMIGRANT VISA. YOU NEED A GREEN CARD. YOU NEED THE GREEN CARD TO GET US CITIZENSHIP.

    YOU CANNOT USE ANY OTHER VISAS TO IMMIGRATE TO THE US.

    AT THIS POINT, IT IS IMPOSSIBLE FOR YOU TO GET AN IMMIGRATION VISA BEFORE YOUR 18th BIRTHDAY.

    YOU CAN IMMIGRATE TO THE US THROUGH YOUR FATHER, BUT YOU CANNOT GAIN US CITIZENSHIP THROUGH HIM BECAUSE IT WILL BE IMPOSSIBLE FOR YOU TO GET A GREEN CARD IN 4 MONTHS.

    YOU DON'T SEEM TO GET THIS. I HAVE TOLD YOU MULTIPLE TIMES IN DIFFERENT THREADS WHAT YOU MUST DO AND YOU IGNORE ME.

    1. Father needs a US domicile.

    2. You need an immigrant visa in order to get a green card.

    3. NO WAY CAN YOU GET US CITIZENSHIP THROUGH YOUR FATHER BECAUSE YOU CANNOT GET A GREEN CARD IN 4 MONTHS. NO ONE CAN GET A GREEN CARD IN 4 MONTHS.

  9. You will not be getting US citizenship through your father.

    You need a US immigration visa. This will take 6-12 months. You will not be entering the US before age 18.

    Your father can still file the I-130 for you. Read the instructions for the I-864 very carefully. You father will need a Joint Sponsor. Because you will not be a US citizen when you enter the US, your father will need to file the I-864.

    Since you will be 18 by the time you immigrate, your father must file the I-864 and you will not qualify for US citizenship through him.

    After you have a green card for 5 years, you can apply for US citizenship.

    bro is it important that i should have green card. i mean can i go there with any other visa and then can i apply for citizenship

    1. Be under 18; and

    2. Have a US Citizen parent; and

    3. Live with that US Citizen parent; and

    4 Be an Legal Permanent Resident (green card holder)

    You meet requirements 1 and 2. Do you meet requirements 3 and 4?

    Your problem is requirement 4. You need a green card to get US citizenship. To get the green card, your father must be domiciled in the US to file the I-864.

    YOU HAVE TO UNDERSTAND THAT YOU CAN ONLY COME TO THE US IF YOUR FATHER IS WILLING TO ESTABLISH A DOMICILE IN THE US. IF HE REFUSES TO RETURN TO THE US, THEN YOU CAN NOT GET TO THE US THROUGH HIM.

    brother me and my father has decided to go to US together so i want to know if i get permanent residence and i file N-600 for citizenship so how long it will take and what if i file N-600 and i turn 18 during the process...???? in 4 months i will be 18...???
