  1. How old is your wife? Does she live with her parents? You either need to be under 19 or if you are a full time student under 24 in order for your parents to claim their daughter as a dependent and they can't claim you as a dependent, there are also income requirements -

    The basic answer is her parents can't claim you both as dependents and you should just file MFJ.

    Ok I see...yes my wife just turned 24, and she was a full time student last year, so I think her parents can claim her. I thought maybe they could claim me because they provided for a lot of our living expenses last year, and I read online that they could claim me since I am their son-in-law but maybe that wasn't correct.

    I received my Green Card in December of 2013 after marrying my US citizen wife in May 2013. We were told at our interview in September 2013 that when we file for the Removal of Conditional Green Card status in 2015, we should submit more evidence that we've been married for those years after our initial interview. The USCIS interviewer suggested joint tax returns as some of the evidence. However, my wife's parents supported us financially for part of last year, and we also used them as our co-sponsors on our I-485. It would be financially easier for her parents if they could claim us as dependents for that year (2013), but I am wondering if this would affect my status in a few years if we didn't just file MFJ this year. Would we be turned down if we submitted tax returns from her parents claiming us as dependents for 2013, and then joint tax returns for 2014? I don't want to do anything that looks suspicious to USCIS. Thank you.

  3. uh oh. please find an i-130 and the instructions, read up about showing proof of bonafide marriage. There are 6 types of evidence to submit. Assuming you not submit stuff with the original submittal, you need to show stuff on interview day.

    So is "all documentation establishing your eligibility for Lawful Permanent Resident status" this same as "supporting evidence of your relationship, such as copies of… bank statement,, insurance,,"?

    because interview notice is asking these supporting documents as well..

    And Yes I did submit all these documents when I applied. Im confused..

    From instructions for I-130

    E) Documentation showing joint ownership of property.

    F) A lease showing joint tenancy of a common residence.

    G) Documentation showing a co-mingling of financial resources.

    H) Birth certificates of children born to the two of you together.

    I) Affidavits sworn to by third parties having personal knowledge

    of the bona fides of the marital relationship.

    J) Any other relevant documentation to establish that there is an

    ongoing marital union.

    So are these same category with "Supporting evidence of your relationship.."? because they are asking supporting documents in another section too.

  4. besides what was mentioned above,

    go back to the I-130 instructions, and study about the 6 types of evidence.

    If you not submit that stuff with the I-130, well, now's the time to collect it, prepare it for interview day.

    if you got married then take your marriage certificate and all the documents prove that you are married for real love smile.png

    Im having my AOS interview in couple weeks, and I've been reviewing the items that I should bring with me.

    One of them was

    "All documentation establishing your eligibility for Lawful Permanent Resident status"

    I'm currently under F1 visa, and doing my OPT. I was gonna bring my F1 visa, and OPT (EAD card). Do I need any other thing than these?

    I had a quite similar situation like you are at right now. I would go ahead put any physical addresses that you had stayed. Also, it would help for them to understand better if you attach separate sheet and give them explanation, why there is overlap and stuff. I think it would be better this way than listing just certain address.

    I had applied for I-765, got approved, and got OPT card (March 2013).

    My spouse and I filed I-130, 485, 131. When I filed these document, I put my USCIS number on OPT card for Alien number section on these files.

    I've got NOA letter lately, and I got my new 'USCIS Alien Number'. Is it possible?

    I wasn't 100% sure when I file my alien number, but I guess this NEW alien number would be the right one? Would I get RFE for this? What does this mean? Please let me know if you are/were similar situation

    2. That's what I thought, but I read from some where and I-485, and I-130 might be separated, so I just decided to put birth certificate for I-130 just in case

    3. You are right, they don't unless I'm a K-1 fiance visa which I'm not. I'm still contemplating about his. Also,one marriage certificate from my country and it shows I don't have any marriage history before.

  11. Hello All, we filed concurrently our Forms i 485, Form I 130 and Form I 765 Last week. We forgot the petitioner's (My wife is a US citizen and I am a student) passport photo. The rest seems to be in order. I am very worried about it anyone dealt with such a situation before? Should we wait till we hear from them? any thought and experiences will be greatly appreciated.

    It seems like that you would get RFE, but once you submit what they are asking for, it wouldn't be a huge problem.

    Also, I have a question for you.

    You mentioned that you are a student, and have you attached all the i-20s that you had before? People were debating whether putting all or not, but I couldn't figure out. If you have any advice, please let me know. Thank you.

    I'm applying AOS (I-485, I-130, I-765, I-131), and I just found something about I-20. I'm came to United states in 2001 as a F1 status, and since then I've been F1 except for 2008-2009. I'm currently under F1 OPT now. I don't think any form instructions say about I-20. I was gonna attach just current I-20, but some people recommend to all I-20 you had before. I mean I don't even know if I have or not. Is it required at my current status?

    I'm applying I-485 AOS concurrent with I-130.

    In number 15a it says,

    ""Served in, been a member of, assisted in, or participated in any military unit, paramilitary unit, police unit, self-defense unit, vigilante unit, rebel group, guerrilla group, militia, or insurgent organization?"

    In number 18,

    ""Have you EVER received any type of military, paramilitary, or weapons training?"

    My country required mandatory 2years of military service for all male. I would go ahead put YES for these questions.

    My question is that should I attach something for this matter?

    I googled, and people say I should explain what i've trained, and stuff. Is there any format?

    I'm under F1 status, and now on OPT. Graduated college, and married to USC.

    My spouse and I are filing I-485, I-130, I-131.

    My question is

    "should I go head REAPPLY for I-765 again even though I have OPT right now, and is still valid?"

    I mean, what would be the choice?

    1) Reapply I-765, and get new EAD

    2) make copy of current OPT card, and attach

    3) Just don't do anything, since they are not asking about OPT

    If you are/were in similar situation, your advice/help would be appreciate it.

  15. You should apply for an EAD anyway. 1) It's free. 2) It allows you to work in any field, not just your major like OPT, and you don't lose it if you have too many days of unemployment. and 3) Even if you get it, you don't have to use it. So it cannot hurt.

    If not, why would you need to attach your current EAD? I see no place that wants that, except when applying for a new EAD.

    Actually, I never thought about applying 765 again, but I think that's a good point.

    I was gonna make copy of OPT card, because that shows that I've already applied for before, and let them know I'm under F1 OPT.

    Do you think sending/filing another I-765 wouldn't make them confused though?

    I'm currently under F1status with OPT (Employment authorization), and applying for AOS.

    My spouse and I are filing I-130, I-485, I-693, and I-864.

    Since I'm under OPT card, I don't have to apply for I-765. In this case, should I go head make a copy of OPT card and attach to I-485? OR should I attach I-797C, Notice of Action from I-765 for evidence?

    If you are familiar with this situation, your advice/help would be appreciated.
