    There are a lot of ground works done prior to filing I-130, some of the forms and documents were transfer from my K1 files to I-130, we have gone through a few discussions with the port consular in-charge of my case before our filing of I-130...

  2. To me, it is really not about the law, it is really how this law being rollout and implement... Simple to say, if the process is not ready and in place for the law, it should not recall cases that already in the path and pipeline...

    I think added with an additional classification, Form or VISA type might be a better solution to accommodate the law instead of impacting everyone applying for K1 VISA.

    IMBRA, by the name shouldn’t it be just applicable to the International marriage broker? Why does it impacting everyone in the K1 path?

  3. My fiance is flying over to Malaysia on 25 Jun, we plan to marry in Malaysia and filing for DCF... he will be here for 3 to 4 weeks.. It is costly on to get unpaid leaves for him... we just wanted to move on with our life...

    And yes, the process of marriage is complicated in Malaysia, we are still trying to find a way to reduce the wait time...

  4. Well, I woke up this morning with some sad news. I have have to be notified that our case was send back to the US. I emailed the consulate about 2 1/2 weeks ago, and they finally responded this morning.

    OUR CASE WAS RETURNED MAY 12.

    Our case went thru Vermont, who do I contact to make sure they have received it?

    Do you having something like this?

    If this is for an I-485, or I-698 application

    USCIS WILL SCHEDULE YOUR BIOMETRICS APPOINTMENT. You will be receiving a biometrics appointment notice with specific time, date...

    It is printed on my NOA1 too... this is nothing to do with IMBRA.

    I suppose that is a general statement for I-485, or I-698 application.

    Correct me if I'm wrong...

  6. I'm just stuck.... I wish to do something to move on with my life... something that will bring me to my fiancé in the US....

    The standard for the I-130 might took about two weeks after having all the required document such as Police Certificate, Medial, as per my consular I already have those...what additional we need is I-130 Form, I-864, Marriage Certificate...

    To obtain the marriage cert will took about 2 to 3 week locally plus another 2 week (maybe) it will be around 1 + month to get my Immigrant VISA... would that be a better option?

    Of course, during the process, K1 might alive again, as long as I'm marriage, I will no longer entitle for K1 anymore...

  7. There is no answer until today... no one know when is the USCIS will start moving again... the new LAW is impacting everyone apply for K1 after 6 Mar...

    I looking for the places that have easier way and least time to conduct the Marriage registration and proceed with DCF...

    And, yes, I agreed that there are no hard and fast guarantees this will work better than K1, but at this point this is the only option that show me the things will move and I know where I'm heading to...

    Is a difficult decision to make... but not knowing what to do is killing me...

  8. Please try to check again on your First K1 application.. in the Appointment Letter for Interview, they did mention that

    "If you CANNOT KEEP THE APPOINTMENT, please notify the office at once"

    Some way in the letter (Packet 4):

    IMPORTANT NOTICE:

    Section 203)e) of the Immigration and Nationality Act requires that an intending immigrant [pursue his or her visa application within one year from the date he or she is informed that it is possible to do so. This is our notice to you that it is now possible for you to pursue your application for a visa. If you fail to do so within ONE year from the date of the attached letter, your application and any visa petition approved for you will be cancelled.

    Would it be posible that your first K1 application is still valid in the system.. and all you need to do is just schedule for a new interview appoitment with the Embbasy.. just refer to your first K1 case #?

    It might be an option to just try that out... check with the local embassy... hope this help...

  9. I check with my consular yesterday if the Embassy in Malaysia could help us to file I-130 for my USC fiancé who is not resident of Malaysia?

    He told me he will need to check further. He then called me back and told me yes the embassy can do the I-130 for us after we marriage and submitting additional documents (I-130, I-864, Marriage certificate)

    My question is... my K1 is pending for issuance, my K1 interview have approved on 11 May… case was hold back due to new law…IMBRA… we have no idea how long USCIS will hold all the case petition after 6 Mar 2006.

    My concern is that, if we would to file I-130, we would need to abandon my K1 due to the fact that we need to get marriage in order to file for I-130 with the embassy… K1 is only for fiance status.

    Anyone have any suggestion or idea to this situation?

  10. The Embbasy suppose to send the packet 3 after receiving your case. Foar situation if you have waited too long and received nothing.. You should contact the embassy to check on status....

    For my case, I just can't wait, I communicate with my Embassy and they allow me to pick-up my Packet 3 from the Embassy Service counter.
