  1. So my wifes green card is coming up on her 2 year anniversary. We are putting together evidence of our marriage. The thing is most of the addresses on all our information uses my parents address whom live close by. We use there's since the mailing address is safer and easier to find for mailman. We do have have something on our actual physical address. Should I write a letter explaining the circumstances and place it in my packet for when I send it out to have her conditions removed?

  2. So my wife and I are about to file to have her conditions removed on her green card. Her W2 has the current address we live at, but my W2s (I have more than 1 for this period) has my old address which is where my parents live. I don't live far from them and I leave most of my billing information at that address to keep things simple for us and since the address we currently live at isn't the most secure for mail.

     

    I did fill out an update for when we moved and requested that anything mailed would be sent to the address she lived at upon entering the United States. So USCIS does know our current physical address.

     

    On the form I-751 I put our current address as our physical address and then put the mailing address as our old address.

     

    Second, We have a joint account in my banking, but the joint account uses her old last name and not my last name. Her green card and everything else has my last name. I put her new last name on the i-751 form and then put her old last name under "other names" she uses.

     

    I plan to send pictures of our health insurance cards since we both share the insurance and have the same last name.

     

    I feel like these things relatively minor, but wanted to ask anyways.

  3. So we received our employment authorization card today. My wife had a social security number from a previous employment in the past and we requested to keep that number for this new employment card. So I want to know since we have this card can we call to have her name changed on her old social security number to her new married name? We have been waiting to for the EAD card to do the name change on her old social security card that we decided to keep rather than request for a new social security number..

  4. I'm not sure if this answers your question but i'll tell you our circumstance and hopefully it helps.

    She came over on a K-1 visa. We got married. We then filed for her SSN, once that came through, I had her added to my existing insurance policy. By law, they had to add her to my existing policy due to what they call a "major life change". Things like marriage or birth of a child are covered here. The one thing that caught us a little by surprise but wasn't really a big deal is that they had to cover her proactively, so the policy had to be paid back to the date of our wedding. If there had been any medical in that time frame, we could have filed claims retroactively on them.

    Now with that said, all circumstances are unique, but that is how it worked for us. We married in October, got her SSN and put on insurance in December (retroactive to October) and we are just now filing for AOS (filed in April).

    If you are getting insurance through an employer, check with the human resources department of your employer. They should be able to assist you with this.

    Not really. It just confuses me more honestly. If I understand though she needs to wait for her SSN. Although I will say she has an SSN from a prior employment opportunity in the past. This was before we knew each other though. From my understanding the SSN is not active and we have to wait for the I-765 EAD to be approved first. So I'm guessing once that's approved she can apply for insurance??

  5. So I will be turning 26 and will need to get health insurance. My wife and I just got married at the end of feburary and sent our AOS mid April. We did finger prints for her last Friday. What I want to know is... Am I able to get health insurance while AOS is pending? Or do I have to wait for the Employment Authorization to be approved in order for her apply for health insurance. Or am I able to apply for both us due to being married and just put her under a plan for both of us together?

  6. I think I understand your question and had a similar question. I didnt want to rely on USCIS sending copies of everything from the I-485 with my EAD and AP so I just made copies of everything. For example this is what I included:

    · Form I-131 Application for Travel Document

    · Copy of Passport with nonimmigrant visa

    · Copy of Form I-797 Notice of Action (Approval Notice)

    · Copy of Electronic Form I-94

    · Two (2) Passport size photos

    · copy of Marriage Certificate (to note the name change of my wife)

    Thank you. One more thing though. Because I'm sending the I-131 in the same envelope with my I-485, which has the I-797 Notice of action, I-94 and my marriage Certificate do I need to make second copies to go with the I-131? My package is just becoming kind of thick due to having multiples for each form.

    That doesnt answer my question or I just dont understand this stuff from reading them in the instructions. All the evidence should be the fact I have the I-131 in the same envelope with I-485 and filing at the sametime. The only thing I added was passport copies for Identification purposes.

  8. It looks good. I ended up doing a separate cover letter for each form because trying to have it all in one was going over a page.

    My only concern about your documentations is only having the tax transcripts for 2013. I believe you need the past 3 years. If you can get 2012 and 2011 transcripts that would be good.

    I read you only need to submit your most recent the last 2 are optional. I did put my salaries of those years on the form, but wasn't going to submit the transcripts and instead just the most recent like it said.

  9. You only have to include a copy of your most recent tax return transcript + 3 most recent pay stubs. SO in this case 2013. Tax returns for 2012 and 2011 would be optional as it states on the I-864. They only care about your current slary and emplyment the past employers shouldn't matter. You would only need a co-sponsor if your commission or how ever way you make money is below the poverty guidelines.

  11. I'm performing a joint sponsorship with my father. I want to know if I can have him just fill out another I-864 or should I have him fill out I-864a. I technically make more than the poverty guidelines as of right now around 28,000 a year. The problem is I haven't been working long enough and my 2013 tax return will be well below the poverty lines since I only worked for 3 months that year. So I won't have enough evidence to show I'm over the poverty guidelines. Also my wife and I are currently living with my father.

    I don't plan on trying to combine salaries, so can I have him just fill out another regular I-864?

  12. My wife and I are sending the I-485 and all the paper work soon for her green card along with the I-765 and I-131 at the sametime. My question is she isn't going to leave the US on a planned trip, but wants the advance parole just in case of an emergency and has to leave to go see her family. What I'm wondering is what to put for "date of departure and intended length of time" SHould I put N/A since we don't know since we are filing I-131 just in case of emergency? Should we just make up a date?

  13. 10. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name and A# on the back using a soft felt tipped pen or pencil. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the G-325a.

    This question confuses me. My wife and I just got married and we are getting our paperwork together to submit for her green card. When it says "write full name and A#" I'm not sure where to find the A# is it the Admission number from her I -94? Also it says "Non-US Citizen's spouse, I guess that means me? Why though I'm a US citizen why do the need photos of me or am I reading this incorrectly or perhaps a typo.

  14. As for the passport you'll have to follow the guidelines for getting a new Colombian passport with her new name. I know that for the UK that means filling in forms for renewal, paying a fee and sending in evidence of name change such as the marriage certificate.

    On our marriage Certificate it has her name before we married, so I'm guessing for the passport change we submit like a copy of our green card once we have to show proof of her name change? Like you said follow the guidelines. Ugh all this is so confusing some with name changing.

  15. A green card is not a visa and not affixed inside a passport. It is a permanent residency ID card. You fill out all the AOS forms in her new married name and then go to the SSA office in person when she receives her EAD/AP or green card card in her new married name to get the name on her SSN changed. The # will be the same.

    Ok because we were thinking about going to SSA office before her green card comes to change her name since she has a SSN already from a previous employment she had in the US before we met in the past. Although I would imagine changing it now effects nothing. We were also going to set up a join account. All of this in her new name.

    The number on the SSN doesn't change only the name. After I was married they wouldn't change the name on my SSN card until I had my EAD so you'll probably have to wait until she has that.

    So should I get her passport changed before she gets her green card approval? Im wondering because I feel like if wait until her green card comes they will put it in her passport and then we will have to get a new passport and new green card issued afterwards, even though the green card will have her new name on it, but her passport will be different do you know what I mean?

    Thats great! Although my next question would be is how do I CREATE a translated copy? I get that we translate it, but I don't know how or what to create to present in the package. Do we just copy our original and write translated words all over the certificate?

  19. Do both my wife and I need to send this form for AOS package or just my wife?

    Also for the applicant employment of last 5 years section. For the first part i put "In process of AOS" from 01/2014 to present time. and then I list her last 5 years of work before that. Is that ok since she ins't currently allowed to work?

    She is also changing her name and putting my last name as hers now. For Family name at the top of the form I put my name then her first and middle, but in the example form at the very bottom they have the persons name before they were married. Should I stay consistent and put her name or just do what the example form shows. Just for the record the example form has both the new name and the old name.
