For a household of 4 (you, the baby, and your two parents), the requirement is $32,750 per year. If you are making less than that I would seriously reconsider how you are going to pay for healthcare, especially with your father’s condition. Getting approved by USCIS is one thing, actually living on such meager funds is something else.

Yes, you can use a sponsor who lives in another state.

You also need their divorce papers.

Have you contacted the embassy of their country of residence to enquire about repatriation?

Thank you! As of now, we are keeping our options open, i just wanted to know some things about the aos. After i have everything i need we will see what we are going to do.. its hard as a daughter having your sick dad away and alone. So if i have to work 3 jobs, iwill. I will do whatever it takes

Current income is what counts. Presumably you can afford this? Parkinson's suggest they are older and will not be working? We are talking a MAJOR financial commitment.

Yes. I understand that! Its a major commitment no matter what, thats why my cousin will be my co sponsor. My dad is 63, not that old. He can still work, he have it under control with his medications. But is a degenerative disease, so i know it will get worse

  3. Hello everyone! Im in desperate need of help. I became a us citizen in december and i had a baby back in october. Both of my parents are here now on a tourist visa, due to the covd19 my home country closed the airport and they cant travel back. So we (my parents and me) that we are just going to the petition for them to stay here with me. My mom is helping me with my son so i can go to work. But my dad have parkinson and he have no one to take care of him back home. We were going to do this different, once they are back home, but now everything changed.. i have a couple of questions..

    1. I would need an sponsor because i did not make enough money last year due to me being pregnant and getting off of work in september, what form do i need for my sponsor? Can it be someone from another state? My cousin lives in CA

    2. They are divorced, do i need their dicorce papers?

    3. Can i do all the forms i did when i apply for aos

    thank you for your help,

  4. Hello Everybody! I feel like ive been out of the forum for about 3 years haha

Im about to be ready to send my N400 but i have a question, hopefully someone can answer me..

I will apply after being a resident for 5 years. But i am now divorced. My question is this, do i need to fill out any other forms beside the n400? I remember when i apply for the residency i needed about 7 different forms.

Thank you so much i advance.

  5. Interviewed today, Nov 26 @ Philly, we reach there 1 hr earlier, sign in and the IO called us probably 30 min after we get there. First she was kind of moody, she asked us to swear and the she started to loom at our papers and she asked us for the birth certificates, marriage license and my passport (beneficiary).. The she checked everything and asked us for everything that we have that prove that is a bonafide marriage.. She asked us for utility bills and we didnt bring it :( she told us that she really needed it but we moved on, then she started to look at everything we put on her desk. When she were looking at the pictures we were telling her the story behind the picture, she started to smile.. (A great sign) then, she asked me all the questions in my form I 485, and that was all.. She told us the magic words "ok im going to approve your application" exact words.. And my wife hugged me and we cried a little, we thank her and we left..

She didnt asked us anything about our lives together or anything like that. It was awesome, super fast and a great ending to this long process..

Im still saiting for the email/text from the USCIS. Hopefully i will wake up to it..

I want to thank everybody thata helped me out here in this forum..

And congratulations to all of you guys..

  8. i've been in the same situation, and let me tell you something, you wont face deportation based on OUT OF STATUS. so dont worry, you can show that you didnt really planed to get married before you arrived, is that your flight was the day before DOMA got overturned. so thats a good thing. i was out of status almost for a year, we got married last year in october and my i94 expired nov 2012, and according to my lawyer it was ok since i got married before my i94 expire.. i didnt pay any fine either (a lot of people told me that i would have to pay since i was here out of status for almost a year, NOT TRUE IF YOU CAME HERE LEGALY)

    this is what i sent,

    - I-130, Petition for Alien Relative
    1. Cover letter stating content of package
    2. Check made payable to US Department of Homeland Security for the amount of $420.00

    4. Form I-130, Petition for Alien Relative
    5. Form G-325A, Biographic Information for Petitioner

    7. Scan of Petitioner’s passport stating evidence of U.S. Citizenship
    8. Scan of the Beneficiary’s present and previous passports, non-immigration F1 visas an I-94 card
    9. Evidence of bona fied marriage
    Scan of Marriage Certificate
Photos of Petitioner and Beneficiary with descriptions

Scan of our previous debit cards showing same cards numbers from our joint account

Currently bank statement showing joint account

    I 485 package

    I-485, Application to Adjust Status

    2. Cover letter stating content of package

    4. Scan of the Beneficiary’s present and previous passport, non-immigration F1 visas and I-94 card

    10. Form I-693, Report of Medical Examination and Vaccination Record in sealed envelope
    11. Form I-864, Affidavit of Support including supporting documents

what i think you can do about the taxes issues, is make a copy (certified) of her W2 forms for all the previous years and put it with the transcrips if you are going to get it.

ok, i hope this helps, theres a same sex group too in here, you have to look it up and have answers from somebody that actually knows about this.

    good luck

  9. hello guys..

im kinda freaking out now.. its been awhile since i got my NOA1, i already did the biometrics 3 weeks ago and still nothing..

this waiting is killing me.. and i cant even check my case status because my account in uscis is locked.. (wrong password). ug..

oh well, i hope everybody is having a good day though..

one question, who is adjusting from a turist visa???!!

lets stay positive and keep waiting. :)

  10. This is very wrong and I am really surprised that your cases got matched up. Someone did that last year and one case got refused and it was a nightmare for them to sort it out.

To anyone else reading: don't do that.

Send all of your forms in one big envelope. There is one address and that address can be found in the instructions. It is worth your while to look in the instructions because there is important information that you need to know. If you missed the address then you probably missed a lot of other things. Good luck to all.

I sent my i130 in one envalope and my i485 in another envalope.. But both of them in one big one together. I guess you didnt understand what i was trying to say. If you out all of the forms together, is really big amd it doesnt fit the envalopes. And in my cover letter right in the bottom i put that im sending both petitions together in separates envalopes.

    And is not WRONG..

  11. My fiancee and I have our NOA1 and intend to marry next year as soon as she gets to the US. Once we marry, she intends to take my last name. However, we also plan on returning to Peru approximately six months after our marriage to visit her family. Once her last name is legally changed to mine, her Peruvian passport will still have her maiden name. Peru doesn't recognize gay marriage...so all her US identification will have a different last name than her Peruvian identification. How do we get into Peru and back to the US with two different sets of identification/last names? Does anyone have experience with this and/or recommendations?

    Hi Susysteele..

i am from Paraguay and i asked about this before i got married.. and what the guy at the office clerk told me is that i can change my last name in my marriage certificate but if i want to change it in my ID i need to go to court and apply for a name exchange..

i dont know if that helps you, but thats what i know so far.. in Paraguay gay marriage is now legal YET.. i just wish it was legal all over the globe already.. is just non-sense..
