  1. Hi. I applied for my EAS based on a pending asylum in January 2019. Last week I received a denial letter based on the fact that I have not had my case pending for 150 days. 

     

    I applied for asylum in February 2018. I had my biometrics appointment on March 30th, 2018 which I did not attend for personal reasons. I ended up going to my biometrics on July 5th 2018. 

     

    I went to the asylum office and they checked that the system never recorded that I had my biometrics done. The office suggested that I filed a motion to reconsider and that I should send my biometrics sheet as a proof that I had them done and that the ead clock should have restarted on July 5th

     

    my question is: Is it better to file the motion or should I send my application again along with biometrics sheet as a proof?

    Could you please share more about your process, I filed a joint petition in Nov 2016 and got divorce 2017 and im waiting to receive a notice with the date of my interview (its been almost 2 months since a receive a notice saying my case was transferred to NBC and an interview would be scheduled)

     

     

    when did you file for ROC?

    Was it joint petition and then you switch for waiver? If so, when and how you switched?

    Did you get an RFE

    Did you get a notice that your case was transferred to NBC and an interview would be scheduled?

    if so, how long did it take from that notice to receiving the notice with the interview date?

    Did you ever use a lawyer?

    I filed on October 2016 the petition with divorce waiver. 

     

    In April 2018 I received an RFE which I responded to in June. After that I got the notification that my case was transferred to the local field office in the beginning of July.  On July 29th I received my interview letter, which was held on Friday. 

     

    I used a lawyer since the beginning and I would definetely recommended using one. His support was very important.

    I just wanted to share that finally I had my interview on Friday. I filed I-751 with divorce waiver. 

     

    The interview lasted about 30 minutes. The officer was very polite and asked me a lot of regular questions about my marriage and why it did not work out. 

     

    At the end he told me he had to review everything again before making a decision. 

     

    Around 3pm I received a case status update “New Card being produced”. So I guess my case was approved and I have to wait for my 10-year GC to arrive in the mail.

  4. At our interview the IO asked to see my original birth certificate as we sent in copies. All other documents where we had sent in originals she was fine with. If you sent the original - they has it already in your file. Ask to get it back and supply them with a copy instead. I told them we had my wifes birth certificate but she said passport is enough for my wife.

    You are saying "your original translated". Is that an original that was translated by the issuer or is it the original translation of the original certificate? They want the ORIGINAL certificate and a translation. If both are the same - that's fine, but if not - they will require to see you original birth certificate. I had a hard time finding mine since it was issued when I was born 35years ago.. :)

    I had my original certificate translated and that what was sent. I have a copy. I will ask the officer to give it back to me and hand her the copy I have.

  5. Hello, my interview is coming up on the 28th. In the letter says that me and my wife should bring our birth certificates. The thing is that my lawyer sent my original translated birth certificate by mistake, should I just bring a copy? And as for my wife we didn't send her birth certificate with the application as we sent the naturalization certificate. Should she bring her venezuelan birth certificate or with the US passport is ok?

  6. We had out interview yesterday.

    The I-130 part (which I guess deals with the Bona Fide-ness of the marraige) of the interview went smoothly.

    However, we hit an expected hitch during the I-485 part, which was due to my wife's (the non-Citizen) membership in the communist party. The officer was pretty nice and patient, he asked my wife to fill out a questionnaire regarding her membership.

    After that, told us that "as with all other interviewees, some one will review our file and make a final determination within a month"

    As we walked back to the car, we received a text that the I-130 got approved, while the I-485 went into initial review again.

    I will post a more detailed review of the interview for those interested.

    What did they ask you? How long it took? I have mine on the 28th at the Hialeah Office.
