  1. What are the requirements for applying EAD before AOS?
    If Filing as a category (a)(9), K-3 Nonimmigrant Spouse of U.S. Citizen then:

    -Copy of evidence of admission such as an I-94 (front/back), passport, and K-3 Visa. Use as many of these as possible (I-94 is required); including a copy of the K-3 is recommended. Make clear copies.

    - A copy of your last EAD (front and back) if any

    - Two passport-type photo's

    Are they talking about the k3 form? Or just the NOAs? I am confused :unsure:

    It would be a copy of the actual K3 visa on the passport. Also, you don't have to pay the biometrics at this time, you would only need to send the $180 for now. The biometrics fee of $70 will be collected when you file for AOS.

  2. Hiya all,

    I have the court decision in my hands now so off to the embassy I go this afternoon. I don't have a Certificate of Finality yet but I'll take my chance and submit the decision just the same. Who knows, out of pity for poor little me who's been waiting forever and ever, the embassy might grant me the visa even without the finality document. I know that's wishful thinking but hey, I can always hope :yes: If not, then wait 15 more days for the finality thingy to be issued.

    And so I have to patiently wait again... :clock::cry:

    But I'm happy with the way things are developing. This will be over soon :yes:

    Hope these help:

    1. How long did it take you to complete your visa and get approval from the date the paperwork was submitted?

    For our K3, we filed our I-130 and I-129F on 11/2005 and got the K3 visa just recently, 5/19/2006, so I would say about 6 months. When we started, the wait time for Manila embassy from the date they receive the case until the actual interview was 6 months, but by the time it actually got to us, we only had to wait for 4 months... I heard that it could even be less than that, so maybe you'll be luckier :D You can check out my timeline below.

    2. What were the problems you encounterd, if any, and how long did they delay you approval.

    We were blessed to have not encountered issues during the process. I've read, however, that some people get delayed because of missing documents, late registration on birth certificates, and CENOMAR checks.

    3. How did you keep from going out of your mind longing to be with your new bride.

    In my case, I was the one here in the US and my hubby was in the Phils. Anyway, we just talked on the phone almost every minute (since we use Vonage, it was really inexpensive) and just prayed that the process will go smoothly for us to be together again. It was really tough, I tell you! But we managed, and I know that you guys will too.

    We finally received the letter from NVC stating that they are forwarding our petition to the US Embassy in Manila within a week. They also gave us our MNL number.

    Does anyone know how many weeks from now should we call to see if they already received our documents? And what number should we call?

    To find out the exact date your case was shipped to MNL embassy, you can call NVC at 1-603-334-0700 and choose the option for K visas. Once you get the date, wait about a week and call the US embassy in Manila at 63-2-528-6300 ext 5184 to verify if your case was received. Sandy and Lorraine are usually at this extension and they are always very helpful. Just be sure to have your case number when you call.

    Thanks! .... Yup, it was DEFINITELY worth waiting for :D Rommel got his visa yesterday and I'll be flying to the Phils on the 26th for a short vacation... coming back with my hubby on June 3rd... Life is good!

    PW - you are right, they didn't look for IDS since I'm on a K3 category. Thanks for all the advice :D

    Thanks Sheila! I also checked with my hubby about the IDS... He said he didn't see anything on the CFO paper... At least now we know it doesn't apply to K3....

    Andrea, was your hubby required by CFO to submit Immigration Data Summary (IDS) like Nakashima? I'm wondering if this is maybe a new requirement for CR-IR because this is the first time we've heard of it.

    Nakashima, let us know what CFO tells you about IDS.
