  1. Please let us know what Tier 2 says when you are done.

    Just got off the phone with Tier 2. No further information, but she did say that NSC is now working on May 20 petitions. Gosh, while I was waiting for one hour to speak to them, they finished one whole month of petitions (see above). So, by that rate of speed, I should get my NOA2 in two hours.... I won't be holding my breath.

    She did say that we will have to wait two more months at NSC. I was a bit testy with her, and she had nothing more to add.

  2. Anybody still waiting on the July thread or am I the only one?

    I'm still waiting, also, and have a July 11 NOA1. I'm on hold right now, on the telephone, with USCIS level 2. Level 1 said, Nebraska SC is still working on April 13, so they still have three more months of petitions before they get to ours. When I said that over half of July filers in our online community have reported NOA2's, his response was...... nothing.

    Visited USCIS field office several weeks ago. Our dialogue, verbatim, was...

    USCIS rep: You come here often.

    Me: We've been waiting 7 months.

    USCIS rep: That's normal.

    Me: 'Normal' keeps changing.

    USCIS rep: Wait here.

    [uSCIS rep returns]

    USCIS rep: Your petition has been transferred to the NSC.

    Me: I know.

    USCIS rep: You have to wait. It should be just a few more weeks.

    [i leave]

  3. First time I feel really, really pissed about this whole damn thing.

    Got 3 emails and one hardcopy letter, one undated, two dated Jan 2, and one dated Jan 3, telling me four messages: 1. my file has been transferred; 2. my file has been transferred to another office; 3. my file has been transferred to the Nebraska Service Center; 4. my file has been transferred to my local USCIS field office. Huh? So where's the damn file?

    Meanwhile, October and November NOA2s are ahead of July NOA2s. I suppose I'm happy the approvals are ticking upwards, but jeeeesh.

    Still no help from my local field office - 5 visits later. Their stock answer after 5 visits? Just wait, you need to wait, just wait. And if I raise a pointed question, like, "So what's the deal with the unstaffed/understaffed National Benefits Center in Overland Park?" - then they interrupt before I can finish and say, just wait, you need to wait, you don't know what you're talking about, just wait. That's after they told me prior to sending my I-130 to the Phoenix lockbox, 'Wow, this petition is well done. I wish all the petitions were this well done. You should get your NOA2 in 2-3 months'. Funny, every time I go there, and hear that line 'you should expect to get you NOA2 in x months' the x keeps growing so that it's always just a little more beyond my current waiting time, you know, like x is always about 2 months beyond the amount of time I've already waited at the time when I visit the damn office.

    So, I visited my Senator's office yesterday. Spoke to senior staffer. Gosh, she was kind, because until her response, I didn't realize how stupid and boring I am, and that I know nothing about anything. It was good of her to let me know. I had assumed that with all my advanced degrees and everything, that I at least know when I'm getting hosed. I didn't realize how uninteresting it is for her to hear the tale of USCIS / Obama Admin abuse of power, putting us married US Citizens at the back of the immigration line so that they can pump the paper of DACA and Provisional Waivers through the system for their beloved new voters. Wasn't interested, didn't want to hear it. So, the prez flouts INA and Article I of our Constitution and screws us over, and when I ask whether she can help me, and what's the Senator going to do about this, how am I treated? Yawn. You're stupid. Take this form and Go Away.

    Then we get treated to enlightened news hacks and other friends of the current administration telling us that opposition to legalizing people in huge numbers - without legislation from Congress - who came here illegally is racist.... Gee whiz, I wonder how many foreigners or their US Citizen spouses here on these forums are non-whites - and waiting longer, separated from their spouses because we were dumb enough to actually follow the law, and as a consequence, put at the back of the line. The real news story should be, putting people who followed the law at the back of the line is racist - because we're from every country under the sun. But no, that doesn't fit someone's political agenda, so the lie will continue. We're just racists. How does that feel, my friends from Africa, South America and Asia and your US Citizen spouses?

  4. I don't think we should keep sending this letter. From USCIS' perspective it has been responded to, and sending it over and over again won't spur them to say anything different.

    I respectfully, but strongly disagree that we should fold up the tents and go home, so to speak. In fact, I recommend the opposite. Let's start another campaign. I am happy to write the letter.

    should we continue to send those letters? If they are now processing March or April, 4 or 6 petitions a day, we are still waiting 7 to 8 months for NOA2... where Texas is processing them in 2-3 months. I think we should keep pushing, holidays are here, which means more days off and longer wait. Just thinking out loud...

  5. Sorry for my ignorance. What is NBC? I just assumed that it would all be sorted here in London. I had no idea it would be routed to America. hmmpf. ALso, what is an I-797? Again, apologies for my ignorance as I just started researching yesterday!

    No problem... The National Benefit Center processes I-130s. It used to be only at Lee's Summit, MO, but they created a new site in Overland Park, KS, and they decided that all standalone I-130s would be processed there, and not at Lee's Summit, and not at the usual regional service centers.

    I don't know whether your I-130 will be processed in London or not - my guess is no.

    The transition to the NBC at Overland Park has been terrible, as has been this influx of Provisional Waivers. For more info about what is happening see:

    The I-797 is the usual hardcopy letter that we get back when we have filed an application or petition. It tells us where our I-130 petition is and some other information.

  6. I did read on another site that filing the I130 in foreign country if you are a US citizen speeds up the process... Wish someone that lives in the UK that has petitioned their spouse to move to the USA could confirm this..

    It states :

    Residency Requirements

    Filing the I-130 abroad may shorten the total immigration timeline. However, this option is only available to US citizens living abroad. The DHS office on London has set the requirement at six months minimum residence in the UK -- both legal leave to remain permanently and actual residence.

    Could be.... But I would check to see how 'current' that information is. The median processing time for standalone I-130s was taking 90 days as recently as January, but then everything changed.

  7. Does this apply to everyone that is doing the I130? And, what about those that do not live in the USA currently? I petitioned my husband to move to the US and we both live in the UK so obviously the application was send to the Embassy in London.

    Dear MLD,

    This problem probably applies to you, because your wait may be extended for the same reasons. However, you are currently together with your family, which is great. Hopefully, you can remain together there, until the green card for your husband and children comes through - but don't expect an immediate turnaround. If my memory is correct, your I-130 will be routed to the Chicago Lockbox, then probably to NBC. Look at your I-797, and it will say whether it's at the NBC at Overland Park, Kansas.

    A few things -

    • Fiscal Q2 is from Jan-March, so the latest report is through March 2013
    • That 1,000,000+ pending for immediate relatives at the end of March is a very wonky number.

    I can follow the math from the Q1 report: pending from last quarter + receipts from this quarter - completions this quarter = pending this quarter.

    That math checks out, and even in the Q2 report, the receipts and completions sums work.

    However, basically, using the equation I have above, we should have at the end of Q2: 176646 pending from Q1 + 254974 received Q2 - 168258 completed Q2 = 263363 pending at end of Q2

    However, the report shows over a million. That's 750,000 that are not accounted for anywhere in the table.

    More simply - how can you start with 175,000 pending from Q1, receive 250,000 more in Q2, complete 170,000 in Q2 (essentially completing all of the pending from Q1), and then still end up with 1,000,000 (!!) still remaining at the end of Q2? It doesn't match.

    Maybe the missing 750,000 were pending previous to Q1? - which would mean that they ran in the red by 300,00 petitions from October 2012 - March 2013?

    Then check out the March 2013 pdf (the most recent published). Look at the backlog after the end of the 2nd fiscal quarter, the exact number is: 1,062,526. About half are at NBC.

  10. How will this work exactly? Is someone waiting for enough replies to send it to USCIS? Do you know when that would be?

    1. generate more page views, more comments from affected spouses and supporters via email or links using social media (FB, etc.)

    2. email brief cover letters with the link, to elected representatives, news editors, etc. (see my post) - the hope is, to get attention that will be noticed by the powers-that-be.

    We have email addresses to Blackburn, Mayorkas, and Obama and we should get Rand Beers.

    The right time to send the cover letters to them will be when we have generated more attention - I don't have any set recommendation for when that will be, but it would be nice to have 10,000 page views, and maybe a longer "CC:" list of influential people to add.

    It would be nice if a reporter ran a story on what's happening, even a blogger, and linked back to it.

    The point is, the more attention that has been paid to this letter and the issues it raises, before we email Blackburn, Mayorkas, Beers and Obama, the more weight this letter will carry.

    Personal note: I have just emailed friends and family, asking them to take a look and consider leaving a comment. There's nothing stopping any of us from at least doing that, or posting on FB.

  12. I have been hearing a lot about DACA being the reason for I-130 approval delays. Could this really be true??

    So now the American government is too busy trying to "legalize" illegals that it can't bother to look after its own citizens?

    It really says a lot about their priorities.

    It's DACA and especially, the "Provisional Waiver" program. I posted recently about my study of the USCIS data on that. It does appear to be the case that the Provisional Waiver program affected us more.

  14. those numbers aren't even current. They are reading a chart that is updated with information from August. There have been April, May and June approvals. Check out Igor's list. VJ is just a small percentage of files but if 3 April approvals come about on VJ, imagine how many others were approved who aren't memebers here.

  15. Since our cause doesn't really matter to most people, reaching that 100,000 seems impossible. The only way would be to go viral, or get real media attention. The best possible way would be to get some airtime, even on a political or immigration podcast. Again, since most people don't care about our cause that much, traditional media may not give the attention we need. Instead, we will need Twitter, Facebook, and YouTube. They are our chance.

    I think unaffected people will support us, but I agree that without them being affected, reaching 100,000 is impossible. Plus, I don't like how the existing petition is written.

  16. I endorse this 100%. As a matter of fact I am planning starting a petition for the establishment of an oversight body for the National Visa Center (NVC) analogous to the Ombudsman that presently exists for the USCIS. It is my opinion that NVC contributes significantly to the inordinate delay in the visa process as their emphasis appears to be on delaying matters the processing of visa petitions as long as possible. In addition, the unprofessional and disrespectful manner in which their first responders deal with applicants needs to be addressed urgently.

    Oh, crud. So, when we get our NOA2s from USCIS, we will have to fight the same battle against NVC? Crud.
