    • We anticipate it will take weeks to resume full visa processing capacity.

    We continue to prioritize immigrant visas, including adoption cases. So far, we have been able to issue most cases with few delays. (emphasis added)

    • Nearly all passports are currently being issued within our customer service standards, despite the system problems. We are able to issue passports for emergency travel. ..."

  2. Hello...this is the "short form" question... :goofy:

    If you are in 221g administrative processing due to "unlawful presence" issues (section 212(a)(9)(B) of Immigration Law)...

    please share...

    1. -What type of visa were you seeking?
    2. -How many days of unlawful presence for you?
    3. -How long in AP?
    4. -Embassy location?
    5. Any details of what they are actually doing on your case while in AP?
    6. Any follow up actions requested of you? Did you get Visa? When?

    Please note...our case...we are under the 180 day threshold and have been in AP for approx. 1 Month.

  3. 1. Anyone dealing with 212(a)(9)(B) "unlawful presence" issues under 180 days and 221 g Administrative Processing status? Please give us details on processing times and what they are doing.

    2. We got all the docs submitted (see timeline below) - however - we can get no details of what they are questioning or the status of their analysis...Nor can we get a sense of how much longer our 15 month process will take to complete. A lawyer suggested that I as the American can schedule a interview at the embassy and present the information...has anyone done this? How about contacting the Dept. of State - effective in moving process along?

    3. Does anyone know if while in AP - is the embassy just focused on the issue stated in the 221g letter OR is it possible other items are being looked into which can drag the process out longer?? The CO did not "like" it that my Indian husband has not told his parents about the marriage...nor have I met any of his family...can this come up to haunt us?

    4. Clerical mistake? - My husband went to pick up his passport and inside there was a July 2, 2014 "ineligibility" letter under 212(a)(9)(B)...which does not apply to us as his unlawful presense days are well under 180 days...only 26 days. Does anyone think this is a pseudo processing mistake...like they haven't fully analyzed our 221g submission but wanted to return the passport under some reasoning - albeit wrong reasoning according to a discussion with an immigration attorney? We are eligible and cannot file for a I-601 waiver because he was not unlawfully present for more than 180 days.

    We so appreciate your help!! This process is so stressful on a new marriage...and so uncertain. We are thankful for all the support and sharing here.

    ========TIMELINE FROM SPOUSE INTERVIEW DATE========

    June 17, 2014 Spousal Interview in New Delhi - both my Indian husband and myself attended. He was issued a 221g letter requesting for more information regarding possible "unauthorized" or unlawful presence days in the USA related to a denied L1B visa extension application.

    By June 19, 2014 (two days later) we had pulled together the sworn statement and proof that he left the USA in just 26 days after the L1B visa denial was received. We submitted his passport as the 221g letter requested.

    July 7, 2014 - Received SMS that passport is "Ready for Pickup"

    July 8, 2014 - Received passport back (NO VISA WAS ISSUED) and a letter folded inside dated July 2, 2014 - stating we were "ineligible" under section 212(a)(9)(B) - Unlawful Presence and if eligible, file for a I-601 waiver...

    July 9, 2014 - After research, we discovered that his unlawful presence number of days is just 26 days - well under the 180 day threshold to bar issuance of the visa. We discovered he IS eligible for the visa and that filing a waiver request would be wrong as the number of unauthorized days is less than 180. After talking with the embassy phone workers, we were told our case is under Admin Processing, NOT "DENIED". They told us to email the July 2 "ineligibility" letter. We sent email and asked for clarification.

    July 11, 2014 - We got an email from the embassy just stating our case is under 221 g processing - there was NO explanation of the July 2, letter... We called, they said (after some pushing) that we are not ineligible and that the email from July 9th was forwarded to the customs officer. They said we are just under AP and do not have more details.

  4. You were right bkghosh...the NVC had completed our case. We called yesterday on May 16th...and they told us they had scheduled the embassy interview for June 17th!!! We also got a copy of the "P4" interview letter within 24 hours of our call. They told us they were preparing to send the file to the New Delhi embassy for the interview. Finally...in the home stretch...it's been 15 months since filing the I-130. Thank you. :dance:

  5. We got a letter from NVC yesterday (May 12, 2014) that said:

    "We have finished reviewing your case. We will tell you when we set an interview date for your case. Please do not contact the US Embassy or Consulate in NEW DELHI, INDIA about the interview until we give you the date." (**)

    We are trying to gauge how long to get the interview date and hope you can help.

    Looking at the other processing times for IV-130's...ours seems to be lagging by a couple months in processing...(now at 15 months...and no interview date). We have submitted all documents as soon as notified and after the reviews, no issues with any of the information submitted - the reviews just taking long time.

    If you can shed some light with your own experience with the following that would help...

    1) Does the above notification (**)mean that NVC has "case complete" status?

    2) What are the "status" benchmarks, if any, that we can track from here to visa issuance? Both at NVC and Consulate?

    3) How long to get the interview date with New Delhi from this type of notification?

    4) Any idea as to whether we will get a quicker date - or how to quicken process - due to the slow processing time of our case?

    Thank you....waiting, waiting, and waiting anxiously for this to proceed.

  6. Hello,

    I am married to an Indian. We are finally in the last stages of the IR-1/CR-1 process for my Indian husband. We think his visa interview will be scheduled at the Indian US Consulate in the next two months.

    I have been living in India for a year - both of us waiting for this immigration process to complete. I may have to travel back to the USA during these final two months.

    We are debating on whether it is "worth" the cost to have me return primarily to accompany him to the interview at the Consulate for the visa.

    • Any experiences out there where you really felt it helped to have both husband and wife present at the interview?
    • Or, was it a neutral factor in getting the visa approved?

    Please share the any details...we'd really appreciate it.
