  1. How do you know that? What does this effect? the whole process or getting the case number? How long are you thinking from NOA2 to setting of the interview date?

    Kaylara was told 30 business days when she queried a NVC operator (probably because snow days there are no longer business days because its in new hampshire and hell has frozen over or something)

    30 business days taking into account holidays = 42 days = 6 weeks.

    This is to be able to get to a case number.

    Then processing to case complete assuming you have everything will take at least 1 month.

    So 2.5 months overall after NOA2.

  2. Have anybody been paying attention to court cases which DACA has been addressed? Several judges have ruled DACA is most likely Unconstitutional. Obama's Executive Order DACA is unconstitutional because it bypassed Congress. Only congress is supposed to make laws relating to immigration. Giving illegal immigrants priority over US citizens is unlawful. Period. Obama created this mess. His law created the backlog. US immigration law is clear. US citizens who petition for immediate relatives has priority. It's not a policy. Its the freaking law. This what's wrong with this country. Too many people don't know their rights and will accept anything. The immigration laws and not enforcing it is creating problems for US citizens and I will not stand by and tolerate it.

    You are referring to Crane v. Napolitano.

    That's ONE court case.

    Based on that ruling, the most they can accomplish is an order allowing ICE agents to formally initiate removal proceedings against DREAMers they happen to encounter. DREAMers=DACA Applicants.

    Once in detention, they can still file DACA for relief.

    There's a million lawyers wanting to facilitate that - just fyi.

    my case is straight forward n simple.

    They have the authority to close your case if they already conferred a benefit on you.

    My guess is that your i-130 MAY have actually already been approved.

    It probably just hasn't been entered into the system just yet.

    That is literally all it is.

  4. We'd have no basis to sue. If we're going to complain to anyone, it has to be to the USCIS and our representatives in government. It's the USCIS that chose to process the DACA filers instead of us.

    Do you know your rights under the US immigration law? Do you understand US citizens petitions filing for their immediate relatives legally are supposed to come first over all petitions. Do you understand Obama's DACA executive order is illegal because it is unconstitutional. Do you understand what is happening to our petitions is illegal? What do you mean we do not have a case? Please.

    We have looked through all options as there was several who were offended at the blatant political push to create more democratic voters. I understand your sentiment.

    He's from Chicago - this is what they do.

    Dead voters, inmates, vagabond college students - anybody who will definitively distract from their hard-left agenda.

    The man is not beneath devaluing american citizenship for positive electoral outcomes.

    The problem is that none of this is unconstitutional.

    To a judge, the fact that your spouse is facing an extraordinary delay in getting a visa is an imposition at best.

    It's not a violation of the law.

    His/her rights were not denied and the fact that he/she is supposed to legally be prioritized but isnt proritized is something that does not qualify for a class action lawsuit.

    A governor who wants to protect his state from Obamacare can tell Kathleen Sebelius to take a hike (like Rick perry did)

    But you can't do that with immigration - because its solely under federal purview.

    They are following no known pattern :)

    But if I had to guess, you should be all clear by Mar 10th (latest).

    If I had to guess and make a good educated guess, I am going to predict that you will likely get approved on mar 5

  6. So i called USCIS to speak to a tier 2 and ask if they can tell me the date my case shipped out. Tier 2 says that they will not have that info in the computer and no one will know anything until NVC receives the case!

    These people are either seriously DUMB or just liars!!

    Not really.

    CIS will post an update "We have shipped your case".

    They don't have a means to tell you WHEN - but they will post that update.

    Once its approved its all upto the NVC - so they are right in the sense that because its under the purview of the NVC, only they can confirm whether or not they got it.

    So it makes sense to call the NVC.

    Just FYI, it is now taking 30 business days (based on the experience of some filers on the NVC Feb filers)

  7. Yeah, I didn't understand it either. Maybe because it was a state of emergency? As an employee of the government, it probably did count as a holiday day. But in the real world, even with a state of emergency, they don't count as free days off. I know, back when I was working as a professional, if I had a deadline, there would be hell to pay if I missed it. (Unless there was an actual emergency, but they'd still want their stuff immediately upon my arrival, and might call me at home/etc. to make sure I was working on it in my "off" time.) If they know that they're getting backlogged, and it's likely that it will only get worse, I do not understand why they wouldn't want to get ahead of it and add in working days.

    ... well.. because they don't need to....

    Remember this is all being done to bestow a "privilege" on your spouse, that we are told "is not a right"

    Its like an oreo... honest arrogance and pompous honesty..

  8. They are offering it unsolicited. When I questioned why it changed after I hit 20 days, they told me Snow days and holidays. Well, federal holidays don't count as business days any way, so I was already taking them into account when I was counting. It's always been unsolicited after I give them my MSC #. As of yesterday, they were still quoting 10-20 days, with the caveat that it'll probably actually be at the end of next week because of snow days.

    So.. if it JUST snows ... its treated like a federal holiday and doesnt count ?

You will be notified by mail when a decision is made. or if the office needs something from you. We apologise for your wait, really wish we could do more but who are we kidding. Naaaaaa.

    The new office has jurisdiction over your case and we will send you a decision at an odd hour- or if youre super lucky a frivolous RFE to which we will take forever to respond to. As soon as processing is complete or you will be notified if further information or action is needed. Then it will take forever to get to the NVC so don't think to yourself that its all over
