  1. Hello everyone. I am really glad for everybody that the process started moving fast after noa2s. We are also a july filers and our papers is already in a Warsaw US Embassy. Yesterday I recieved a letter from NVC which said that they have sent our petition to the embassy and it also stated that "In meanwhile, please have your fiance(e) and his or her children visit ceac.state.gov and complete form DS-160 to apply for K visa." I am confused now about onlne DS-160 form, because Before I read that for those who apply for K-1 visa it is not nessecerely to fill it out, but recently i found that info -

    "Visa applicants must submit a completed DS-160, Online Nonimmigrant Visa Application for all nonimmigrant visa categories, including applicants applying for K visas.

    NOTE: For K visa cases in process at a U.S. embassy or consulate, the DS-160 is not required when, prior to October 7th, 2013, one of the following situations exist:

    The K visa applicant is already scheduled for an interview.

    The K visa applicant has already been interviewed and has been requested to submit additional documentation or is pending administrative processing.

    The K visa applicant has already submitted a valid, signed, unexpired DS-156, DS-156K and/or DS-230 or received instructions to do so. "

    This is from travel.state.gov website. Please anybody new about it or that is only me who was surprised about it. Back in 3-4 month when I sent our petition to USCIS I remember reading about that for k-1 visa aplicants this form is not needed. But I see that they renew something recently.

  2. Hello everyone. Just got some updates for my case. as I am a july filer, I decided to post my updates to see if anybody from july f got the same message. So the message is "we transferred your I129F, PETITION FOR FIANCE(E), to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed." I am not sure exactly what does that mean bad or good, but at list I see that something is moving on with it :)))

  3. I don't think you are looking at it incorrectly.. nor am I trying to scare you.. I had something similar, but different and ordered my criminal report from the state just in case which came back clear.

    Go forward with your filing .. should be ok.. it's just those types of crimes I know can be scrutinized a little differently

    Thanks. I am note sure how to get the criminal record for myself I mean about thefederal one. I did two last year for for the delawer and new york state. which was clean. Maybe you know how to obtain the criminal record the one which uses the uscis?

    I checked the USCIS website today and got the following message

    I'm not sure exactly what this means, but I assume it means our case is not sitting around in a file box???

    It means the USCIS has assigned an alien registration number to your fiancee... And yes it wasn't sitting in the box. It just got there on july 24th and now you just in the line for the nearest 5-6 month until NOA2 as they say... Good luck to all of as in our journeys! Jahh Bless.

    what will you do when your pending turns into a conviction whilst your petition is pending?

    Don't know yet. But still this kind of conviction that I might get is not on the list of the instruction for I-129F, where they ask if I am convicted in one of the following.... I found great website www.avvo.com where you can ask lawer a question and I got 3 responses from lawers and all of them said that this is not the type of conviction that might denied my I-129F. They only look for some serious sexual abuse convictions for the application. It would have been different story if my fiancee had any kind of convictions. It is much more difficult this way. I understand that my trouble doesn't make me a good moral history but anyway I hope everything is gonna be fine.

    I am soo excited I got my approval yesterday, July 25, 2013 after waiting 6 whole months. So Now I need to fill out form I-134 but I have a question. Last year I was going to school and working part-time so my dad included me as a member of the house hold in his tax papers because I wasn't making enough money to file on my own. But starting Feb 1, 2013 I had a full time job that pays higher than the poverty line. So for the supporting documents for form I-134, are my pay stubs enough? or should my dad also fill out the I-134 and Co-sponsor me and my Fiance?

    I think the right way will be to fill out one I-134 from you as a primary sponsor and one from your dad as a co-sponsor for your fiancee. Fill all requered information on that and attach suppurting documents such as income tax, pay stubs, bank acc etc. your dad has to provide his information on his affidavit of support and has to provide yours on your affidavit for support for your fiancee. That's how I think it is. cause I recently filed my petition and I will deal with it later. I might be wrong in my thoughts but would like to know more on this, because I have almost simmilar situation like yours. But I also have a quistion about it. If the co-sponsor is married DOES HIS WIFE HAS TO FILL ONE I-134 FORM ALSO?

  7. Everyone accused of a crime is legally presumed to be innocent until they are convicted, either by being proved guilty at a trial or by pleading guilty before trial. This means that it is the prosecutor who has to convince the jury that the defendant is guilty and must provide proof of guilt beyond a reasonable doubt. The defendant has the right to remain silent and that silence cannot be used against him or her.

  8. Hello everyone! According to my case situation, I found out some unkown steps and quistions about Criminal Records and K-1 visa petition. Maybe somebody had already experienced such things and can give suggestions on it.

    Situation is that I have criminal record for marijuana posetion in 2008. At that time I still had Green Card. April 2013 I got my citizenship and couple weeks later I got into a trouble in different state. I was arrested and my case is still not done. In the worst scene I am looking for a misdemeanor for the Theft from a motovehicle and get on probation in PA or in good scene I will dismiss it. Depends on how good lawer be on the last court day. I filed my petition for Fiancee and on a form I-129F they are asking if I was convicted of one of those convictions which they listed on the form. And none of them looks like it is my case. BUT my courts still pending and I am still not convicted in anything. The only thing is that that arrest might be shown somewhere in the national criminal backgroud check. I am not sure How it works. If somebody have an idea about it, post replies on this topics. Thank you everyone.

  9. Hello everyone! I sent my fiancee petition in the end of june and on July 1st the USCIS office recieved it. I sent it through the Texas Lockbox and I they routed it over the Vermont Service center. On july 5th I recieved an email saying that they recieved my application gave the number i can check the status with.Also it is saying that in next 7-10 days I suppose to recieve an official reciept(I-797 form). Today is already 24th and I still didn't get any notice through mail but when I go online to check for status it says "On July 10, 2013, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E". No new updates since then.
