My case is regarding an I 130 but I will let you know my experience with info pass. My I 130 was approved on Dec 27,2012 ( after the interview) and by August 2013, I haven't hear from anyone. Long story short, I called USCIS several times but they were not able to give any new information. I made an info pass and they noticed that there was a problem with my husbands name (made by them) and that's why the case was not transferred. I had a second info pass a month later and I was told that the case was going to be transferred to the NVC. Fast forward 2 months and I go back (3rd info pass) because NVC still doesn't have the case. Lady at USCIS noticed that the case was never forward (no one knows why) she said she was going to sent it and around a week later I received the letter from USCIS saying that the transferred the case to NVC. After that I received the letter from NVC that they had the case. And they received everything with the right name. In my case the info pass was good because the case was stuck for almost a year (approved on Dec 2012, transferred to NVC on Dec 2013). it depends what's going on with your case. Good Luck

Hi, I have a question about the interview. I know that the documents should be translated to English but I would like to know If the interview was in English or Spanish. My husband is from El Salvador and he will have to go to the Embassy at some point to do an interview. His English proficiency is limited and I was wondering what language they will use to interview him. Thanks

Thank You so much. Today I paid for my Affidavit of Support and my Visa Application. I have to wait for the payment confirmation (it says in progress but should change to paid) and I will start working on the I 601 A. I think I have to wait for the approved I 601 A to do the rest, im not sure though. I will continue to post as things progress.

This answer might be very late but just in case you still need it I will respond your question. For starters we are in a very similar situation. My husband was on removal proceedings when we got married, I am 4 years older than him and I am more educated than him. I thought I was going to be flagged but we did not. For my interview, I had a photo album, a letter from our landlord (since when he was living with me), I did not have bank accounts, I gave them a copy of my car insurance that says he is excluded because he doesn't have a drivers license but to me it proved that he is part of my life... I show the lady (immigration officer) pictures of him with my mom and pictures of me with his family, several pictures of us together. She asked him a few questions about information that was on the I 130 application and he was nervous an messed up the answers... I responded the questions for him and the officer said that she was going to ask me because he did not know anything. About our relationship she asked if he meet my father, where did we meet (at church) and the address... the lady only kept 2 pictures, one of my mom and his dad talking, it wasn't a stage (posing) picture, a picture of our wedding date... we were not approved right there but a month later we received our approved I 130... we had to do an administrative closure and today I just paid the Affidavit of Support and the Visa Application fees... we are now working on getting documents for the I 601A... good luck with your process...

Thanks for your response. To answer your question, my husband is from El Salvador and he does need a Unlawful Presence Waiver I-601-A because he enter the country undocumented. I will check the links you send me.

We just got the news that our case is finally at the NVC. With the letter I received two invoices. One for $88.00 (Affidavit of Support) the second one is for $230.00 (Visa application processing fee). My question is if I just have to pay this amount and wait for forms or anything. Also, NVC sent me the I 601-A form. Do I have to send it at the same time with the money? As you can see I am kind of confused about what I am supposed to do now. I will really appreciate if any of you can give me some light.

In case you are keeping track:
I went to the info pass and talked to the USCIS officer that have our file. I still don't know how to "fix" the name problem but he told me that from now on I should write the full correct name on everything. The good news is that the officer told me that he already got the approval from his supervisor to forward our approved I 130 to the NVC. He told me that he was sending our documents with notes so they know that there is an issue with the name. The officer told me that in the worst case scenario if my husband gets his green card with the wrong name there is a process to correct that.
So, the good news is they are moving the I 130 to the NVC (he told me he was going to send it that same day Aug 23).
The bad news is that we still have the name issue.

In case you where wondering..
- I called USCIS Customer Service Center and talked to a Tier 2, she was lost and had no idea what I was taking about... she was not helpful at all...
- Because of this I made an infopass for Aug 23... I will let you know how that goes
- I called Customer Service Center and talked to a Tier 2 for the second time and this time the agent was very helpful.. he made a request in the system to fix my husband's name. The good news is that his name should be right on everything related to the I 130. The bad news is that for other stuff like the administrative closure, we still have the name problem.
- Hopefully the infopass will solve (or at least give me the next step to follow) this situation.

I don't know the answer for your question but if I was you, I will include/ have information about the culture. For example the fact that your culture forbids dating. There most be articles or maybe a letter from a religious person (equivalent of a priest) that explains how things are done in your country. You could also get notarized letters from someone who can say that know both of you and knows that your marriage is real.
In my case, when I got married I did not take my husbands last name and kept my maiden name. I was a bit concerned that that was going to be seen as a red flag but in my culture women don't take their husbands last name. My mom did not took my dad's last name and none of my sisters have their husbands last name. My mom and my brother made notarized letters saying that they know me and my husband and that we are a real marriage. At the end we did not need the letters and no one asked anything about the last name but I was prepared just in case.
Hopefully you have enough evidence of long distance relationship and they wont question the marriage in the first meeting. Anyways be prepared... Good Luck

Hi Jorge, my husband is from El Salvador and we had to translate a lot of things. Your question about if you can translate the things? well the answers is NO. I have been in that situation and my lawyer told us that I can not translate the documents. The good thing is that you don't have to pay a professional either. If you have a family member or friend that is bilingual they can do it. You only need a "certificate of translation" it is basically a paper that says: my name is ABC and I am fluent in English and Spanish and I translated JKF's birth certificate. You can find the certificate of translation in the DOJ website.

About the pictures.. in my original packet I had only 4 pictures.. one from my wedding day.. one of us as a family with my son and two in two different occasions in which we were with his family... but when I went to the interview I had a lot of pictures.. I included pictures in which my family was with my husband and pictures in which I was with my husbands family... The interviewer did not look at all the pictures but ask me if she could keep one of the pictures.. it was a picture of my mom and my father in law... I almost did not include that picture because it was a bit blurry... my father in law and my mom were taking and I took the picture without their knowledge.. it was a very "natural" picture... they were not posing for it... I am not saying that pictures in which people are posing are bad.. but in this specific picture you can tell that it was not staged... so I think that it is a great idea if possible to include pictures of both families interacting together.. Thanks Caligirl 75 and NLR... I know that my case is very complicated and I was looking at this site for extra knowledge and experience... I do have an immigration lawyer but he seems to know as much as I know about this A# situation... I will consult other lawyers and see what I can find out... I will make another info pass to see if someone at USCIS can explain me what will be the next step... Once again thank you for your advice

This is how my husband got the A# and the wrong name. In 2008 my husband got a DUI, usually the police takes you to the police station and lets you go after 6 hours. They do that to let you "sober up". But because of secure communities, the police fingerprinted my husband and send his fingerprints to INS (now USCIS). INS took my husband into custody because my husband came to the USA undocumented. My husband was put on removal proceedings and that's how he got an A#.
When the English speaker INS officer was asked my husband his name, my husband gave his real name but the officer could not understand him. My husband (Spanish speaker with very limited English at the time) repeated his name several times because the officer kept getting it wrong. At some point the officer got frustrated and said whatever and wrote down the wrong last name.
Maybe the officer did not realized that something that might sound so small was going to screw up .
Since 2008 we have been dealing with his immigration issues. USCIS kept changing the court day for the removal proceedings. As of 2013 we never had a court day.
In 2012 I petitioned my husband with a I-130 consular processing. The I 130 was approved in January 2013 but they did not forward it to the NVC because of the removal proceedings. We did an administrative closure of the removal proceeding in order to move forward with the I 130. After the administrative closure, USCIS was supposed to forward the approved I 130 to the NVC but they did not.
That's why I did the infopass and they explained me that the name linked to the A# is wrong. That means that everything we have done (administrative closure, approved I 130) is under another persons name.
As you can see, my case is very long and maybe complicated. We have been dealing with this since 2008. I do have a lawyer but I try to stay on top of things and learn things by myself. As for the A#, even my lawyer doesn't know how to do it and told me that he was going to research about it. I am upset about my lawyer but I am stuck with him. I can not just switch lawyers because a new one will charge me from scratch. We have spent over 10, 000 dollars already.
Anyway, that's my story. I hope this clarifies your question. If you or anyone else has some idea about what I can do, I will really appreciate it.

No and that is the problem, that all documentation shows the A# with the wrong name. Even if I send his documents (like my petition for example with his right name), when I get a response it comes back with the wrong name. I don't know how to change the name linked to the A#.

My case is kind of long and complicated. I will do my best to explain it in concise and non confusing way.
I am a USA citizen and my husband is from El Salvador currently both of us live in USA. In 2008 my husband had a DUI and INS end up getting a hold of him. When the INS officer took my husband's information, the officer wrote down my husband's name wrong. Because of that the A# that was given to my husband is linked to a name that is not my husband's name. Example A# belongs to Jose Perez but the real name is Jose Pedroza.
Fast forward a little bit. I petitioned my husband thru an I-130 Consular processing. We did all the paperwork with his real name (birth certificate, marriage certificate, my son's birth certificate, his passport). The I-130 was approved on January 2013, but because his A# has his name wrong all the letters and approval come with the wrong name.
The approved I-130 was not transferred to the NVC and we did not understand why, so I made an infopass and the USCIS officer explained me that in USCIS eyes Jose Perez and Jose Pedroza are two different people. We need to fix his name, but the problem its about the A# not paperwork related.
Does anyone knows how to change the number linked to an A#?
Some extra information: we do have an immigration lawyer but his answer was what he needs to research because he doesn't know what we are supposed to do... Unbelievable,.

So, the thing is that I applied for an I-130 spousal petition consular proceeding. My husband is in USA now but he will have to go to the US Consulate in El Salvador to do the interview. The I 130 is approved but instead of going from USCIS to the National Visa Center as it should be, the case end up "stuck" in some office. I had an info pass last Monday July 29 and the USCIS officer told me that they needed to revise the case to see why they did not sent it to the National Visa Center (the I- 130 is approved).
The USCIS Officer noticed that my husband's last name is misspelled (more like totally change). The problem is that his A# is linked to the wrong name. Is not like we gave them the wrong name but instead everything we do comes back with the wrong name because the A# belongs to that name. USCIS officer told me that in USCIS eyes these are two different people.
Now the question: how can I fix his name? I went to the USCIS website but the forms I saw were for when the green card comes with a mistake or the lawyer makes a mistake. I don't know how to fix the name thing and I am concerned that USCIS might thing that we/he tried to misrepresent who he is and he might get permanently banned form USA.
