  1. If your case was completed with the NVC, wait until they send you an interview confirmation to see what you need to bring. It's hard to advise you now. I had my case completed and I still needed to bring more financial evidence, which I did. And to be safe, just bring as much evidence as you can for the financials. If they need it, they'll take it. If not, they'll give it back. I brought the I-864, 3 years tax returns, w2 and pay stubs. You can optionally include letters of employment.

    The only thing that changes with the wife filing jointly is that you would typically need to have the I-864 for your joint sponsor and then add an I-864A for their joint filer, in this case being his wife. If she's unemployed, I'm not sure.

  2. I would recommend the same thing. Some classes may transfer and others may not, this is typically how it works. You can always give yourself a jumpstart as well if you're thinking of advanced education by taking the TOEFEL and the GRE. Universities will see your degree differently with good test scores for these exams in the mix and this may prevent you from redoing any undergraduate coursework.

  3. If you could get the DHS Ombudsman or a member of the House or Senate to submit this expedite for you, it would work wonders. But you do need to have each of these things documented, so much as to going to a doctor to diagnose the migraines. I had my case expedited through USCIS under the financial hardship when my foreign lease ended and funds were very tight to start another. Do what you can, it can't hurt you to try! But I'd take some advice from visaqueries because you will still need something more instant. After USCIS comes another slow beast called the NVC...

  4. You've all attacked this woman. And it has led to attacking certain cultures and a little more. Bad men exist everywhere, religion or ethnicity doesn't dictate that. Christians, Jews, Muslims, etc will all produce some gems and some fools gold, so stay away from attacking religions.

    To the OP, be patient. Bear all of this with patience. See where this relationship takes you by the time your birthday arrives and a little beyond that. I'm sure you'll come to learn more about each other.

    In the future, be very weary sharing too much information or some members will eat you for lunch. It's really a great community here, so don't let these responses scare you away. Get your ducks in a row, take your time talking to the brother in Morocco and come here when you feel ready to take those next steps.   5. I believe that people call it a loophole, not because it's legal or illegal, but because it seems like our government should have been as strict with this area as they've been with the others.

    Anyhow, as of today, it isn't breaking the law. You are very much free to marry and adjust. There's one thing I'll mention because I read that you're on a tight budget. The costs of filing for AOS aren't so cheap. If you do decide to marry and file, make sure you have secured those funds.

  6. I know how you feel and agree with your description. It is truly "inhumane". Even when you finally get past USCIS, you have to wait months to get through the NVC. It's pure torture and I couldn't imagine any of those employees having to go through what they take people through. There are a lot of people with jobs and our government can easily attack the unemployment and improve our immigration process by opening up more jobs at USCIS and the NVC. Hang in there, I hear when it's all said and done, it'll be worth it!

  7. I see a lot of comments about expedites here which hold some truth, but not entirely.

    I don't think the reasoning for the expedite is sufficient for USCIS, but I can say that the weight of an expedite depends on who submits it. If you wish to try and go that route, get both the Ombudsman and a senator to file an expedite for you. However, as is already mentioned, dealing with the Pakistan embassy is the bigger problem. You'll have to hang in there and be as supportive as you can until the petition is approved. Good luck bro!

  8. So you're saying that the K-3 is pretty much pointless if it gets assigned an MSC number? Is that correct?

    From my experience, if it gets a MSC number, then it has been put into the same folder as your I-130. It seems like the TSC is even sending those they receive to the NBC. I don't know what kind of policy they have in regards to the K3, but they aren't giving it any weight.

    En-oh-eh-to now correctly answered the second question. The representatives should be furious that a law that they passed is being completely ignored. Depending on how long your representative has been in office and how proud they are, a good letter can be enough to get a ball rolling. The national average for processing times right now is a good reason to return to the K3 as this is why they started it in the first place.

  9. Well, to shed a little light on the K3. I did this back on July 1st and I sent it to the TSC. However, I never heard anything about it until after the approval of my I-130. I didn't get a NOA1, text message or an email. The letter stated that because of the approval of my I-130, the I-129F was denied and no longer necessary. The file number for the I-129F was a MSC number. It is not based on where you live, but more of where your original petition is located. They will eventually end up at the same center.

    It seems clear to me now how they use the K3 petitions. They put it with your I-130 petition and then it sits just like the rest and when your I-130 is finally approved, you get a nice little notice about the denial of your K3. So I can say this, if you get your receipt number for your K3 and it begins with MSC, then it's going to sit in the same place as your I-130. If you do get a case number with the TSC (which is unlikely), it will more likely be sent to the MSC like mine was. However when the shutdown ends, you can use the K3 to your benefit with your congressional representatives because they passed the bill to limit waiting times and now USCIS doesn't give their bill any weight.

    Of course, sending in the K3 documents won't hurt you at all, but I doubt it helps with the way USCIS treats them now.

  10. A trick to the phone situation is to call the phone company and tell them it's stolen. They won't charge you any fees and you will still pay the monthly bill, but it will prevent him from using the phone any further.

    I'm sorry you've had to go through this. You can definitely do better. Never settle for less. Divorce and move on. He will get whatever is coming to him, so let karma have him and his family.

  11. I got this same message about 45 days before my expedite request was approved. This means just as everyone above has stated, they will review it.

    Due to the backlog of the normal processing times, most people have searched high and low for a reason to expedite, so it will take some time as the expedite office is backloaded as well. Give it about a month minimum and give or take two more weeks and you'll get their decision.

    And if you haven't tried with your senators, representatives and the Ombudsman; I suggest you utilize this option. Many of the offices won't go too far, but there are some officials with a little more helpful staff. The office of Senator Wyden was the last to respond to me, but they helped the most, but by the time they got to filing an expedite (which they did), the Ombudsman had already filed their own expedite. When I get a chance, I'll share some of the various emails as I had contact and action from all parties.

It is not 9 months but 3.5 months and it's already killing me over here, called for an expedite request since my wife is having hard time living alone during her pregnancy and it's bad for the unborn baby, and got reply back it is not a strong reason for an expedite and that I have to wait. I feel so depressed and have to wait.

    Isn't yours at your local office?

    The only way you can make that expedite request work is if you can gather evidence describing a high risk pregnancy. Everyone with a pregnant spouse could use your first reasoning and this is probably why it wasn't approved. If this long wait does prove to be too much for your wife, I suggest she obtain a note or letter from her physician and you try again.

    It never made it to my local office. The last known location of my file was with the expedite team for review.

    I'm not sure what the Ombudsman filed under, but I know that my senator filed it under financial difficulty as my lease ended in Algeria and I just couldn't manage to pay another year's rent. In Algeria, they don't have monthly rent, only annual. Trying to pay petition costs, visa costs, flight costs and then a year's rent all at once would be impossible. It was after explaining all this that the senator decided to file an expedite.

    I guess all of the extra efforts came through! The Ombudsman and Senator Wyden both put in expedites for me.

    After this long and stressful part of the journey, on to the next!

  16. This forum isn't about haters, it's about sound advice for those struggling with visa and immigration issues. It's never good to sit here and attach people who are trying to preserve our already flawed immigration system. If so many people didn't come here and stay illegally, I'm sure it wouldn't be such a battle for those of us that do this correctly. To knowingly help or allow someone to commit a crime, it's not in the best interests of the individual or the country.

    To call it a felony is not trolling. To advise the OP of the negative possibilities is not being a hater.

    So to the OP, many would suggest that you report this all to the proper office. If that is not in your wishes, we understand. Anyhow, it wasn't useful to chime in on this because it wasn't what you asked. Though you have an interpreted legal liability, you have no financial liability for the illegal immigrant. You're in the clear. Beware of VAWA claims and if you choose to petition another fiance or spouse, be ready for some interesting questions.
