    Same boat here, I feel like MODs should start a new sticky thread or sub-category for post-doma same-sex couples.

    I'm curious about the experiences with interviews, as those should stsrt in about a month and see how different offices across the country react and treat same-sex couples. Also, the questions they ask, how invasive they are, and so on.

    Also, some families and cultures are not supportive, so ie. USC's families can be but the other spouse's can just denounce them. How you go about proving the bona fides of your relationships? What if being too out could affect the livelihoods of your families overseas?

    There was a discussion about this in the site feedback form and I argued that this issue is about equality and making a separate forum is not equal. The laws are the same so IMO it should all be in the same place and not treated differently. That's what the whole issue was about, wasn't it? There is a thread about it in the site feedback forum.

    Bona fide is more about how you treat eachother, not about the people around you. Some traditional couples also have family issues.

    OP: You could get the F1 now and worry about the immigration after that. Or you could file AOS right now. You'll have to check with the school and see what docs they want for enrollment. You won't have a GC by September, or even an EAD, so I think getting the F1 now is better for you.

  3. My wife and I have been together for three years, and married since last September (2012). We got married in New York. I am from France, where same sex marriage has only become legal this June. We live in San Diego. We have everything ready for my adjustment of status (from f-1 student to permanent resident) and I-130, but were advised by the DOMA project team, to see a lawyer first. We are seeing him tomorrow (in LA), since they are offering pro bono consultations for binational same sex couples. Hopefully we did everything right and can send our application this week, finally! Such a relief!

  4. just one of my best friends gay hisself a visa to London last week, and it was just accepted the union of fact, but partnership could file a fiance visa, was quite complicated because they had strong economic requirements and many more documents but rather like the K1, they were sure he would see marriage soon, in fact already knew they would begin to marry in mid-2014, I am very happy for them.

    We applied and have NOA1 but the whole issue of living in a state w/o SSM is worrying us. Living in Texas and planning on marrying in Iowa. It seems the immigration lawyers are saying it wont be an issue but would like it not to be such a grey area. Any one with more info on this?

    Hello Mr texas, you know my case is the same there is no SSM lousianna but my boyfriend has consulted with an attorney friend and seems it will not be a problem if you show that you're getting married in another state ... if you can schedule an appointment, tickets to another state, hosting ... would be good if you're ready ..

  7. Lawyers have no idea how it works since the matter isn't settled into law yet. All we know is they are accepting the petitions. These are being treated the same as opposite-sex couples, and this states' rights aspect is an issue for opposite-sex couples. I don't know why same-sex couples would be treated different than others.

    The cousin case seems extremely applicable, to me. Federally, some states allow it and these couples can get federal immigration benefits. But, they cannot get these benefits if they live in a state that does not allow cousin marriages.

    I just see many people in this process get unrealistic expectations, then they are devastated when things don't work out according to plan. You are all going to be guinea pigs, as it were, and we don't know yet how it will be. I hope it will be easy and not a problem, but I would prepare for a few bumps down the line. You even thought an NOA1 meant no RFEs... Imagine the devastation you'd have when you got one six months from now...

    can be solved accompanying documents showing plans to marry in a state that permitting such an appointment to get everything in order, maybe air ticketing to the state where you are getting married and maybe a reservation of hotel etc. ... federal laws take precedence over any state decision....

    boys saw a part of the I-129F that says "as my fiance proposed to me" and lol .... I would not have proposed to her or done the ritual of the Rings, but obviously we know that if we get married and be together we've been so stressed earrings struggle and that's why we do this k1 visa ...heart.gif
