Hello All,
my and my same sex partner married in March 2014. She was her work EAD. She does not have a green card yet, we are waiting on that. We never applied for the SSN like we should have in the beginning (we didnt know)
so, she does not have a social security number. she does not have an ITIN.
I need to file my taxes. My W2 states married. Preparer said we need a SSN or ITIN. Im pretty sure she is not eligible for an SSN at this time as we are waiting on the green card and missed that opportunity. My spouse does not work, does not have an income. I only work and have a W2.
1. Should we mail in the W7 and apply for an ITIN for her? Won't this take too much time?
2. Or, can I just put married filling separately and insert NRA in the SSN box? The tax prep person said I could end up owing a lot more money if I do married filing separately as compared to married filing jointly. Im tight on money...
Please help and advise.

Hi, my wife and i were married after the i129 was approved. We are now in the Adjustment of
Status process. She was approved for work authorization as well. We got married within our 90 period in Washington DC. As my home state of North Carolina does not allow same sex marriage. GOOD NEWS. North Carolina now allows same sex marriage as of yesterday. Question: Do we need to go get married again at the court house here in NC? Or do we not need to take any action for it to be recognized in the state as it is recognized federally already??
Please Help. We will get married here asap if we need to and I need to arrange for that.

Ok ok. so I can resubmit the forms after I receive NOA1 for the AOS. and just put my last name as her last name ( even though it is not official)
or, as in another response to my post, if we have an interview, i can request it then.
they also mentioned wait till ROC and I can change it for free. What is ROC?
or after green card is given, i can pay the enormous $450 fee to change it...

is this still correct even though we have not changed her name to my name?? our marriage certificate has both of our maiden names. She does not have a SS card or number. we have not had a name change. So i can submit forms that have my last name on it, though her last name is not my last name at the moment...
please advise

Dr. Pervy - she has not legally changed her name yet. We are a same sex couple. We did not file for SSN witihin 90 days. She does not have a SSN number. We only got married within 90 days and filed AOS this week (6 months after her arrival)
as far as things stand right now, she still has her maiden name. we have not changed it.
would re-sending in the AOS forms still be a good idea?
or once she has her green card perhaps we can change it after that
and yes, we filed all the other forms as well for employment, etc. im not sure of the exact names.

Oh no. I do not like what I hear about the name change. We couldn't change her name unless we got a SSN and we havent at this point. We married within 90 days. And we just filed AOS and she has been here 6 months now.
the AOS is in her given name, as there has been no name changes. During our interview or sending in additional paperwork - is there anyway she can take my name??

Hi everyone,
We sent off our AOS papers. USPS let us know it was delivered yesterday. I still have not received E-Notification yet nor has the fee been taken out of my bank account. What do we expect from here? What are the steps to take?
Note: We got married within 90 days of arrival. But we just filed AOS, and it has been 6 months since my foreign fiancee arrived, so her I-94 is expired. We had to save up the $1000 to file, this is why it took so long...
We did not apply for SSN before her I-94 expired (we did not know to do this, or were too caught up in each other since we were finally with each other). So, do we have to wait for AOS to be complete before she is able to have a Social Security number?? Or, what are our options?
Also, we are a same sex couple. She would like to take my last name. What steps and in what order should we take??
PLEASE help us. ALL help is appreciated.

Hi,
We've just received our triple seal(we married in DC few weeks ago) but to our surprise it only contained 2 papers : one is called Authentication and the other paper is a certificate of marriage. Why do they call triple if it only contains 2 papers and which one are we supposed to send for AOS? do you think that there is a missing piece?

North Carolina does not allow same sex marriage. This is why we have to get married in
Washington D.C - the closest place that allows us to marry -
bob - that would be great. Except - we do not have the $ to pay for all of that. We have looked into those services, which cost around $400. In getting married at the courthouse -all we have to do is pay for gas to get there( which is over 5 hours away) and for the marriage license we already paid for and obtained. Feel free to provide the list.

Hi
Our marriage was scheduled for today but the courthouse is closed due to bad weather. The marriage licence application was done on February 5th, will they pay attention to this date when we apply for AOS? My 90 days is up on March 28th so we are running out of time. We can't call them now. If we can't reschedule our marriage before March 28th what are our options since Im going to be out of status?

We cant afford the 1000$ fee for AOS any sooner but we are planning to marry withtin the 90 days time frame. Will it be ok to apply after 3 or 4 months of marriage?

I entered usa on a K1 visa, My question is after me and my fiance get married should we give the marriage certificate to anyone (to uscis for instance) before applying for AOS?

My Fiance (and I) who is here in America with on a K1 Visa are planning to get married in a couple weeks. She just got here 1 week ago. We are getting married in Washington D.C. We were wondering if, for the Adjustment of Status process (AOS), if we should have professional pictures taken. Are pictures required as proof for filing for AOS? Will we need to include pics of our wedding day in the AOS?
Or, can we just have casual pictures made?

The K1 visa expires as soon as it is stamped when you enter the US at your POE. You have 6 months from the visa issuance date on your visa to enter the US.
The first thing is to get married, which has to happen within 90 days of your entering the US.
Once you are married and have your marriage certificate, you can apply for AOS. It will take anything from 3 months to a year to receive your green card. It depends on whether your are in the pile to be interviewed or not. Those that are interviewed generally get their GC quicker. It also depends on where your AIS paperwork goes to. I applied for AOS in July and am still waiting for any communication from USCIS for my AOS (my EAD/AP came through in September).

Hi,
My K1 Fiance will be coming to the U.S from Morocco this Saturday. We are wondering about the POE process. Will someone meet her when she lands in New York? Or, will she have to go to an office somewhere? What does the POE process involve and will she be directed to where she needs to go or will someone already be there to meet her?? Please help and advise.
She is connecting through New York for a final destination or North Carolina.
flight path: Casablanca, Morocco > New York, New York > Charlotte, NC > Wilmington, NC

I'm entering usa under K1 visa. Is there any documents I need to have with me apart from the sealed envelop and is there any form I'll have to fill ? can I fill it online?
Sharing your experience with me will help a lot. I really need to know what to expect.

Thanks for the info. So what I have found and want is: Royal Air Maroc form Casablanca to New York. I will book this flight from Royal Air Maroc's website. ofr 8568 MAD which equals $1,050
Then I want to use orbitz.com to book a flight from New York to North Carolina. So, it will be two separate flight. But Casablanca > New York (Royal Air Maroc) this cost $254. Bringing my total cost to $1,304.
Then New York > Charlotte, North carolina > Wilmington, North Carolina using U.S Airways booked through Orbitz.com
is this ok?

It depends on what airlines have the best price and Delta doesn't seem to be one of them. The flight I want has Royal Air Maroc and JetBlue Airways. So book through Orbitz, ticket in her name, reservation in mine since i am paying for it and we will be fine and good to go?
