    Thanks for your reply. Tourist visa is not an option since I live in a third world country. If she came to my country and we got married, what are our options then?

    What makes you say that the thrid world countries can't have a tourist visa ? If you have a good job in your country, they won't deny your tourist visa. I'm from Morocco, and I had a 10 years tourist visa. As a lot of friends there. And if you are still student, your parents can support you for a tourist visa, my parents were my sponsors for the visa. It was very smooth. It doesn't matter where you are from, since you proove you have enough money for your stay and strong ties to your country...(school and parents support or a good job)

  2. My fiancé put his sealed envelop in his luggage and it got shipped to NY. What's gonna happen once he reaches NY? He won't have it on him it's going to be in his luggage. Someone help me ! Has this happened to anyone before?

    I think it's not going to be a big issue, he should talk to an agent or officer in the waiting area, they will call the flight company's supervisor, the supervisor will be able to go and pick up his bag to bring it to him. I had a small issue when I arrived to NY and they called a flight attendant supervisor (I was with Qatar airways) to help me out. Don't worry. Even if it's a big mistake actually, because they explain clearly at the embassy that we have to keep the papers with us, and it's not safe to put this kind of stuff in the luggage anyway. Hopefully he won't loose his luggage. Otherwise he will be fine ;)

    Yes it's a privilege not a right to a green card. It's not a mentality. It is EXACTLY the way it is.

    If you are over the processing times it's time to get the USC's congressman or senator involved and to write to the ombudsman.

    I wrote to the the Ombudsman, they said USCIS are working actively on my case, and that I will receive something within 10 days. It's been 20 days now, and still nothing.

  4. What USCIS does is very abusive!! They make errors and take much longer than the normal processing times and we are the ones paying the price. To take another medical exam because they are behind is just ridiculous.

    The mentality is that it's a privilege for foreigners to become legal residents that's why do as they please. Every time I call I'm told oh in 30 days. But when 30 pass and I call I'm told 30 more days.

    It's incredible that coming here legally with our k1 We are sitting here a year later without being issued a green card. Yet I know others that have come with B1/B2 visas overstay their visa, marry here and submit papers and already have their green card in 3/4 months. I just don't get it.

    Same boat, same s*** here. 15 months, received a medical exam RFE, I made it again, sent it more than a month now and still waiting. I applied on March 2014. That's ridiculous.

    If my co-sponsor sign affidavit and produce tax return for me every thing is okay? and as I didn't pay tax, there is no problem?

    I think my co sponsor should sign affidavit after NOA2, is it correct?

    They will ask you to write a letter statint why you never paid taxes, as they asked my wife. But you dont have to put that for the k-1 petition. They will ask for it when you get approved and when your fiance starts the consulate steps in his country. Your co sponsor has to send the affidavit of support signed and taxes to your fiance. You have to sign an affidavit of support too as the primary sponsor even if you don't have any incomes. it's not going to be a problem, my wife was like you, her dad was my sponsor and that's what we did. There is no problem if you didn't pay taxes. But send the K-1 petition to the USCIS first, wait for the approval and then the story about the affidavit and taxes will begin with the consulate. Don't worry about that, you will be good as long as you have a co sponsor.

    I want to apply for k-1 visa for my fiancee. but I have a problem.

    its a long time that I am leaving outside the US in the same country of my fiance. and now I'm coming back to US and I want to apply for my fiance for k-1 via, to get married in US. for proving that we see each other last two year, I do not have airline ticket or other these kinds of prove documents. now I don't know how to prove that we see each other and it's a long time we are in the same place. would you please help me what should I do and how should I prove?

    I was in the same case. Pictures together, an explanation letter, and the passport stamps...but mainly the pictures. Because they ask for your fiance's passport copy anyway so they can see the stamps and the explanation letter about how you met as well. For our case, I think we added her departure flight ticket when she left my country. If you are still there, you can print your arrival flight ticket...and like 10 pictures together, write on the back the date of each and details about the pic...we got approved in 3 months

  7. Thanks for the words of encouragement chsim, I feel really bad because I trusted what the USCIS office was telling me, little did I know that it was their interpretation and not fact. I'm hoping for leniency as I have supplied all information required well before due date and I have complied 100% until this lastest issue. I have access to an immigration lawyer consultation through my spouses work so as soon as I get the letter I will be getting legal advice as to how best to proceed, either request to reopen or start the process again

    Yes, do it. There is no reason to deny you again, you are not frauding.. it's an RFE and you missed it, it happens, and you did everything well as you were directed to. The uscis records all the conversations with the customer service. You might have to pay the fee again, for sure. Now, as we said, it's better to get an INFOPASS and talk to an officer in person when you get all your details via mail. The free toll sucks, it's a very bad idea to call them again for this matter. They are like robots and can't help for anything trust me, I used to deal with them about my case. Don't stress out a lot, you will be fine, it's just going to take a little bit longer...Good luck !

  8. Well I agree with the post above that your medical seems to have been expired in addition to being incomplete. USCIS sometimes accepts them when processing takes excessive amounts of time but recently its been the trend for them to RFE or ask at the interview (and you were a waiver so its not a surprise you got it via RFE) for a new medical before approval.

    This is a discretionary issue because they can use the expired medical if they choose since it was valid at time of filing but they dont have to. In your case it seems they decided not to, so Im sorry.

    FYI- clarification on an RFE is a tricky thing because you are basically calling and asking for help and taking who ever you speak to's word for interpretation when that person is not the person that issued the RFE in the first place. Misinformation could be given (as it seems in your case). Your best bet is always to answer the RFE exactly as its written and not as someone explains it to you.

    This is all water under the bridge now as you have been denied.

    When you get your official denial letter it will come with instructions on appealing and I dont know. I can see it going either way. Technically you did make the mistake by not submitting the proper complete response to the RFE. But again they have discretion on the matter so they can let it slide if you submit the appeal and pay the fee and turn in the proper medical paper. They may not and deny your appeal and you would need to refile. So its your choice whether you want to roll the dice and appeal or simply refile.

    You only get one shot at an RFE so Im assuming since you failed to respond properly you were "officially denied" and whats coming next is the denial with instructions to appeal. (you can post back when you do get the actual paperwork)

    Wow, I wasn't aware of this new law, I would have thought that the lady at Ucis would have been aware of it and told me the correct information...Can anyone tell me if the letter I am being sent is a denial or a notice of intention to deny? The email just said that my AOS has been denied.Tricky question I know but I'm wondering if they send the notice first. As I had received wrong information and did I fact need a new medical and I had just had my vaccines updated, would they give me a mother opportunity to get the medical done? The date that I had to provide the details on the RFE was August 22nd, they had the vaccines back around July 25th, does this date allow for missed items to be gathered and sent?

    As mentionned in the post above, wait for the USCIS letter and get an INFOPASS appointment at your local office to speak with an immigration officer. Follow the instructions and it's gonna be fine I'm sure !! Just make sure you save some money...lol. Good luck.

  9. I presume it was vaccines. When I called the USCIS and asked about the RFE I had received about the medical, they said it was for vaccines, not a medical

    There was nothing specific on the RFE that is why I called to clarify

    The customer service are so stupid, they don't know better than us. I had to deal with them too many times, nothing helpfull at all. I'm sure you needed a full new medical exam, like a lot of us. My RFE wasn't specific either, it's a standar letter, and they checked the box of the medical exam...

  10. The knightsbridge doctor did state that my vaccine was incomplete, that is why they needed me to go to the civil surgeon to get my MMR. According the the USCIS website I shouldnt need a new medical if I applied for AOS within 12 months of having my initial medical, mine was within 5 months. I didnt need a civil surgeon at the start, i just went along to the london medical as instructed.

    The new law states that even if you applied within 12 months and the USCIS didn't give a decision whitin the validity of the Medical exam, you need a new one. I just had an RFE after 14 months, saying that I need a medical, I applied for the AOS 4 or 5 months after my first medical in my home country. I had it done and sent it, I'm still waiting for something for more than a month now. If you sent only the new vaccination, that might be the reason for the denial. They need a new full medical exam since your first one was done longer than 12 months ago...

  11. I checked my status online never changed still the same since i applied for the AOS !! But I have never tried to contact my local office or USCIS !! They received my RFE Medical sealed Envelope June the 6th , 2015 . It's been 5 weeks now hopefully i will hear good news soon . If not within one week from now i will call and see what is going on !!

  12. Hello,my wife received the AOS potential interview waiver letter back in June 2014. Our six month wait time was Dec. 27 2014. We called on Jan 3,2015 to check status. We were told that the were working on the February 22 2014 AOS filers. We filed Aos March 20, 2014/ NOA date March 27,2014. We were also told they get updated once a month...so I took it as in a nice way, not to call back in a month.

  13. Hey guys.

    I and my wife had an interview with USCIS (Seattle Office) conducted by Officer Sonia Hobart. The interview went great. She was extremely professional and respectful to both of us throughout the interview. We went through my I-485 and my wife's petition I-130, to make sure everything is correct.

    We've been dating since 2008. We married on her birthday 2014.

    Back to the interview. In our possession we had our marriage certificate, phone records (texts and call log) since it was mostly long distance relationship prior to getting married, email exchanges dating back from 09, car title with both our names, joint lease, work emergency contact, travel itinerarys (both of our visits to each other and trips we made together, including hotel stays with both of our names on it), tons of photos together, and with both of our families.

    After going through the application, her first question was, "As a married couple, how do you convince a stranger that you're married?" Which I found funny and confusing at the same time, as in the sense that, in real life all we have to do is tell them we are married, but I know. That doesn't work with USCIS. We started digging through our documents. She took the ones that she needed.

    She then asked to see pictures from our wedding. We provided her a few and she asked who were in attendance. It was a very simple court wedding as we can't afford a big ceremony. I'm only 22, no job (just got my social security # couple of months ago). She's 23, graduated college this summer. Her whole family lives overseas. She use to live with a family friend while she was attending high school but they treated her so bad they're not in speaking terms anymore. The only family she has over here is her cousin and her boyfriend and they were both in attendance.

    I met both of her parents for the first time when they came from Africa for her graduation last summer. I had the privilege to spend some quality time with them during their short stay. Although, her mom ended up staying here in the US.

    The officer's concern was, why did the parents came for her graduation and not for "wedding". I had to correct the officer that this was indeed marriage ceremony, not a wedding. There was no way we could have afforded to pay for their trip to come for both. Considering the fact, they didn't even have their visas at the time. I was unemployed and living with my mom. She was still going to school, living in student housing with 3 other roommates, meaning if they would've came, we would have to pay for their hotel. We were not going to change our marriage date for their convenience. Our birthdays are only few days apart (6days to be exact) and it was extremely important that, we are able to celebrate both our anniversary and birthdays together. We thought it would be a great idea to invite them for her graduation instead. That way we can just celebrate as one big family.

    She then asked about my family. My mother is in the US going through her own immigration battle. She lost her mother (my only grandparent left) exactly 11 days before we got married. That, together with her denial letter from uscis with grounds of inadmissibility (meaning she can't even travel back to attend her own mother's funeral) was depressing beyond words. It was an extremely difficult time for my family. There was no way she could attend our marriage ceremony considering it was being held 2,000 miles away from where she lives.

    She then decided to separate us. She interviewed me first (the beneficiary) and then my wife (the petitioner). She asked about our proposal, my wife's travel history e.t.c. She escorted me out and asked my first the same questions. Both lasted about 5mins. Our answers matched 100%. From what I read from different forums, it looks like most couples are brought back in the office together afterwards but that wasn't the case for us. She just told my wife she was unable to make a decision at the time and to wait for the decision in the mail and handed her a white piece of paper. It's reads "Your case is being held for review. At this time, USCIS does not require any further information or document from you. Should further information or document be required, you will receive a notice in the mail. We may also schedule you for another interview, you will receive a notice in the mail. Otherwise, a final decision will be mailed to you once your case is complete."

    I need help. What should I expect from this. It's been 2weeks and I haven't heard anything.

    How long it took to them to call you for the interview since you filed out and sent the form ?

  14. Salam labas 3lik ? I got my EAD in June last year and it is going to expire soon in 2 months , I just started the application to renew it :( more money to spend man !! I was planning to request an AP as well but then i changed my mind because i am afraid i will not be able to reenter as i always have such bad luck !! so i don't want any other complications , though i really need to get a huge work in my teeth that are causing me lots of issues lately and it costs a fortune here , if you know what i mean ?!

    I had the interview without the affidavit of support (I was waiting for it by mail) and I was approved. Now I have just to bring them the support documents.

    Ma fiancé and the co sponsor (her father) filled out the form i-134 and all the documents from the bank to proof her father's income + A letter from the employer. Without tax returns. Is that enough ? Help me to know pleaseee Thank's
