  1. How long have they been living in Colombia? It would need to be a minimum of 6 months legal residency before they can apply via DCF.

    I believe they just recently moved to Columbia to live with her parents. I think had they stayed in Argentina that the DCF through there would have been much faster. Now they need to establish residency in Columbia --- But if they had lived in Columbia for several years prior to that would that account for anything - They were both former residents of Columbia.

  2. Thanks so much for your speedy reply --- but in the short time I gathered information to share this with them... I found out that they live in Columbia now.. with his wifes parents. So, now what is the process. Can they DCF through Columbia being they have been married over two years. I had read somewhere that Columbia only allows DCF under very special circumstances. Is this correct?

  3. I am posting this question for someone else who is planning a move from Argentia to the US with his Columbian Wife.

    Here is a brief overview of thier situation. He is planning on moving back to the states in July. He and his wife were married in Columbia over two years ago. Although he attended College in Bogata so he was there on likely a student visa - I am not sure what he has for visas but assume since he works for a Financial News publication and is a foreign correspondant in Argentina that he has the proper visa and documentation to be there as well as she as his wife from Columbia.

    So, here is my initial question.. What is the process they should follow? And my concern would be that he is a current resident of Argentina as well as for her... is there any Argentinan process they need to follow or would it be best for them to just apply for DCF through Columbia....

    He had been in Columbia for a few years on a Student Visa when he met and married her.

    Just a little help to steer them in the proper direction for her US Visa to be issued

    I did all the hard work on the visa process and trust me all of you out there reading this --- I would never put myself through as stressfull process at that was again ---

  5. Well, go figure. I sent a status inquiry email to the CSC on 6/26 at 1:45pm and last night, we received an email from CRIS:

    Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Notice mailed welcoming the new permanent resident.

    On June 26, 2007, we mailed you a notice.... blah blah blah

    Coincidence? Hmmm.

    At least we're finally approved.

    I sent an e-mail & never got a :angry: response

    can someone supply the address again?

    I am so happy for those that are receiving their approvals but......if my man doesn't get his EAD soon I am gonna snap!

    Irishgirl, If you applied for the EAD and 90 days have passed you can make an appointment for your hubby at the local USCIS office and request a temporary EAD until the regular EAD arrives. We did that and within a week my husband had the Temp 90 day EAD in hand ---- When ever there was an issue that the phone line would not or could not answer my husband was on the line making an appointment to talk to someone in person --- although it took about a month to straighten the entire mess out --- Last Saturday my Husband received his Green Card --- I would say all due to our persistence and diligence to keep them on their toes.....

  7. Whoo Hoo! Finally, my husbands Green Card Arrived Today --- I took from the point of filing approximately 20 months from the point we applied in November of 2005 - Funny thing the permanent EAD arrived 3 days ago --- hardly got to use it before it wasnt needed anymore --- So, we can hold on for another year and 9 months till we have to apply for the 10 year card --- This has been a Hell of a Nightmare --- nice to know it is finally over for a while --

I hope that is not what my husband has to go through --- we have been waiting for quite some time --- the letters got mixed up and we got the appointment for the AOS about a month ago and then just today we got the appointment letter for the Biometrics --- The AOS interview is scheduled for April 18th and the Biometrics is scheduled for May 4th --- we are going to go into the Wednesday walk in at the Seattle office tomorrow === actually I am dropping my husband off there on my way into work --- the office is about a mile from my work location and he will just ride his bike home from my work location. well if he has to wait several hours it will do well to help fill his day --- he has become such a househusband lately ---

  9. We have had quite the mess in getting everything right with the AOS process. We got an RFE three weeks after our submission due to us using an outdated form --- we submitted the correct form the next day. Next, the real mess begins --- we received a red flyer in our mailbox stating that we were living at a vacant address --- My sons G-friend rented a room from us for 4 months and then moved out to her new address and when filling out her change of address form from the post office she checked a little box that said the address was vacant --- mind you she is VERY Blond === ha ha, but that set us back when the USCIS would not deliver our "likely" Biometrics appointment letter. We called and were told that it could take up to 30 days to get the letter that was sent back to them from the post office. They also told us that they had no idea what the letter was for.... But, due to us getting the AOS interview letter today, we can only suspect it was the Biometrics letter. Has anyone ever had this thing happen? I was told when we got the biometrics letter that even if we were past our appointment time that we could do a walk-in Biometrics appointment in Seattle on Wednesdays..

    No word about the EAD which we could really use.... I did get our taxes done and with claiming my husband and his income with the income exclusion we got 2000 dollars more than we would have without it --- sad thing there is that it takes 6 to 9 weeks to process the ITIN number and then another 6 to 9 weeks to process the taxes... so it should come in time for hubby to go back to work....

    My wife went to the interview in Montreal on October 12. Since her overstay of more than 1 year, we submitted the waiver papers. They did accept it and have already sent to Vermont. I have few questions.

    1. Do the consular officer provide a recommendation on the waiver before they send it to Vermont?

    2. Will I get a NOA-1 for the waiver?

    3. How long is the approximate time that it will take to process?

    I would apprecaite any insight that you can provide.

    you will not get any kind of recommendation from the consular officer

    you will get an NOA-1 for the waiver submission - this is the date that you use for the processing timeline

    we waited nearly 7 months but then we contacted our Senator as well as sent personal letters to the Vermont Service Center Director

    I have been told the average waiting period for Montreal out of Vermont is from 6 month to a year

  11. I am an British guy who has filed for a k1 visa to marry my American girlfriend. She has been living with me here in England for almost 6 months on a visitors visa and must return next week. We are well into the k1 visa process but as I have a criminal record we are sure I will need an I601 waiver. I have 2 crimes on record. 1 was for smashing a window (criminal damage) around 5 years ago. I recieved a small fine. 2 was for Arson for setting fire to a car (my friend did the deed but I was with him). I received a 12 month prison term and served around 3 months. This was just under 5 years ago. I have 1 youth court conviction as well, however I was 16 at the time (1994).

    It wouldn't be hard to prove extreme hardship for my girlfriend. She helps her Mother look after handicaped (spelling?) children as well as her older who was left with the mental age of 10 after a severe car crash. This is just 1 example of why she cant leave America.

    My question is, what are my chances of entering America to marry my girlfriend with an I601?

    Sir Woods, My husband is here after we filed a Waiver for him because of 2 crimes one of CMIT. You will have to file a waiver for sure but due to the fact that you served time and that you have more than one crime --- my husbands last crime was 23 years ago and we had about 6 letters of good character. As far as the prison term, the time served means nothing -- it is the maximum sentence time that is looked at - another thing they might question why your fiance was tin the UK with you for 6 months if she is required to be at home helping her mother - I think you need to get a much beefier story as to why she cannot immigrate to the UK with you -- Go to www.immigrate2us.net to read several examples of approved Waiver letters ---

  12. You can go to one anywhere really, but good luck in finding one cheaper. In FL my husband is paying 95.00 for the base exam then all the shots and it's still going to be over 200 (and this is one of the lower numbers I have heard). They're all probably going to charge similar prices, especially in the same area. Also, I don't think they take insurance - my husband has medical (long story) but there's been no mention of insurance covering it so I wouldn't be surprised if you still have to pay the full price.

    My Husband had his medical which was only the shots supplement portion and was charged 25 dollars plus 25 dollars for the flu shot at a local clinic --- the Dr. was really good and we did shop around though --- there were quite a few in Washington ---

When you submit The check for 325 dollars for the I-485 -- does it include the 70 dollars or do you submit a seperate check for the 70 dollars for the biometrics fee --- it does not state in the official instructions that you do this but on the USCIS website it says that payment for the 70 dollars is to be submitted in the AOS process (not sure where in the process this is)--- I do not want to send the application off yet if I have to send them the 70 dollars with it ---

Ok I have been ringing round my approved M.Ds this morning and they have confused me as to which vaccinations I require,Im over 50 and have a current diphtheria,tetanus,polio,just done in Feb of this year in U.K. and good for 10 yr,MMR had that when a child same with chicken pox,got Hep A also,so Im needing a flu shot for definate,but one nurse I spoke to said I would require another tetanus shot as I needed two?but none of the other nurses I spoke too mentioned this,can anyone enlighten me please,thanks,oh and as a by note the charges for this service varied from 35 to 142$.

So how come it shows up on his police record then ok he was charged etc but are we talking the record from Scotland yard or just the court record cos if it is on his NIS document then it will be looked at when you interview so I would say honesty is always the best policy in these sort of things,as if you try to sneak one past them and they get you they will start digging really deep.

Ok I went to my local S.S. office today and after waiting an hour and half gets to see someone,they ask me why I want a number I say it is because I need to open U.S. bank account as my british card only is accepted at certain places,ok she says I just need to go ask about this,comes back 5 minutes later and tells me that they cannot issue me one due to the fact I dont have the right authorization on my K3 visa and if I want to open an account I have to apply to I.R.S. and ask them for a ITIN?,the alternitive is wait till I get my EAD and then apply again,has this happened to anyone else?

Every State has a different Minumum wage --- in Washington state it it 7.89 an hour -- my 17 year old son just got a raise to 8. 20 an hour after working for 4 months as a dishwasher --- + he gets a 10.00 meal every shift and tips on top of all that at about 5% of the take of all the waiters --- not bad for a kid --

    4 dollars an hour is just shameful and if the person I was supposed to interview with showed up late --- I would take that as the first clue to the level of concern they would have with you and your job had you taken it --- good for you --- selling stuff on e-bay can get you more money than that ---
