Yay!!!! I am so excited for you! We have had similar timeline through this whole process, and I am so happy to see you get the approval ​ . My husband has his interview 5/8 in MTL.

AS far as the SS card - at the end of the DS-260 it asked if you wanted to share the information on the DS-260 with other agencies and automatically apply for the SSN. If you checked yes, then once he enters the US they will generate his SS card and I think it takes up to a couple of weeks to get mailed to your US address. I could be wrong...because I haven't gotten to that point yet, but that is what I have read. If you did not check that you wanted to SS generated, he can go into an SS office after he moves here and then apply.

We were approved!!!! WhooHooo! Thanks so much to everyone who helped along the way. And to all of you still waiting, I promise you will make it through, stay strong and try not to freak out too much.

All of the info regarding the MTL consulate was 100% on point for us, arrived at 7:00, doors open at 7:30 etc... (Do not bring bags or extra stuff, the guard was not gonna budge even a bit on that and some folks in line were freaking out.) Took us 2 hours total, the interview was pretty much a breeze, the guy was quite impressed with the amount of stuff I brought for proof of domicile, he mostly focused on my lease, job offer and contract for sale of our house in Canada. Actually asked me if my lawyer told me to bring all of this or if I took it upon myself. Told him the web was a wonderful place! The only other questions he asked was where we met, when we got married and what my husband planned to do for work in the US.

One last quick question for you guys, we realized after the fact that there was no mention of my husband applying for his SS card? Does that happen automatically or does he have to do it once he is in the US?

I currently rent a condo in the US as of Jan of this year, all of the bills are paid by my landlord and are included in my rent but yes I do get mail there. Since Jan I have been going back and forth while waiting for my husband and children to come when able.

I am including both, since I moved to Canada I have maintained domicile by keeping multiple accounts, voter reg, student loans, etc... I have also taken steps to re-establish domicile fully by signing a lease, excepting a job, selling our house in Canada. I feel like it is better to cover all of the bases but that is just my opinion.

You can go to http://www.lawdepot.com/contracts/residential-lease/ and create and print a lease, it looks much more legit than an agreement. It will only cost you like $5.00, if I remember correctly you basically sign up for the service and on the same day cancelled it. Good luck! We are dealing with the same thing and have our interview on April 8th.

I am in CA and we have been here for over 10 yr together, no worries about proof of domicile as I have been working on this for over a year (read lots o scary posts of folks being turned away) just surprised it was not even mentioned and never has been up to this point.

As for the medical, I am just worried we wont get an appt before he has to leave on the 29th, do you know if it is usually booked up? He wont be back till the 4th and that would be cutting it way close...

For Montreal specifically no. But next round of scheduling should start up about next thursday the 27th or friday the 28th.

I have to resubmit my I864 form due to error on it. I submitted on March 3rd. All the other document is cleared like civil docs n others. Does anyone know how long does it take to review it and case complete (other than 30 days). If anyone had the same issue then how long it took NVC to review and finish the case.

It took us 20 days from when they put the checklist in the system.

dwheels76: we got our case complete email yesterday but are still waiting on interview date.

You can also get a State ID if you do not drive but the job, lease, kids enrolled, moving quotes, voter reg, business and home in Canada for sale, and US student loan should be more than enough for domicile. You really covered it with the job and lease. The rest is extra. If need be open a bank account down there too (You can do CDN and US RBC or TD so you can transfer the money from your business and home sale to the USA easier as well.)

We already have an RBC US acct and US credit card not to mention a US Old Navy card too.

Awesome, put in a few pay stubs or the employment offer or proof of employment. You're golden and likely don't need much else

have a lease?

Even better... add that to the employment and you don't really need anything else.

Thanks NLR you have always been a help to me, this ####### is stressing me out!!! I just want to be home and I cannot for a second imagine having to add more time to what has already been way too much.

Okay so I have been going back and forth between MTL and Texas for a few months prepping for our move, I have a job in the US and signed a lease there. I do not have a driver's license or car insurance since I do not drive at this time. Do you guys think the lease, job letter and a boarding pass from Texas showing I just came back for the interview and the prep to move my family in addition to:

-US cc and bank accounts

-TX voter reg.

-US retirement fund

-US student Loan

-Contract with agent for our house in CA that is currently for sale

-Proof of sale of my business in CA

-Moving quote

-Emails for enrolling the kids in school

Well looks like you have more proof than we did, so hopefully that will gain your approval. How "exactly" we are supposed to prove it to them is the part that is challenging, because they do not give us exact steps, or even vague ones, really. I wish I knew, but at this point the only thing we can do to hopefully guarantee him being approved is for us to move down there. Which we are now making plans to do so. And as far as the timeframe, my guess is however quickly we can get them more proof, and from there how quickly they can process it....my guess is a few months....but really, really hoping that it will go quickly I really hope all goes well for you and that you aren't put in the same awful predicament!

When is your interview? Do you have family in the states? I would move down there to be with them and get as much proof as you can, otherwise it's very likely you will get as far as we did and be denied. After going though this, I would not wish it upon anyone. I'm so sorry you are in a similar situation, the unknown is so hard to cope with sometimes....all the best to you.

Ours was just complete last week we are waiting for the date. Thanks for the advice, I pretty much go back and forth quite often so I guess I just need to focus on getting even more. I can show a job offer letter showing I have already started working in US and an airline ticket close to the interview date showing I flew back from the US to CA for the interview....I hope this, on top of what I already have will work because if not I have no other ideas. I have the proof because we have honestly taking the steps to move back, just like you guys. It blows my mind that they essentially want us to be seperated from our spouse and children long term as proof. Insanity!

How exactly are you supposed to prove to them? More evidence? And what is the time frame before they will give you the visa???

What I find absurd is the rejection itself; the mere fact that a family is pursuing the legal route to move to the US should be proof enough of their intention.

Why else would a young family choose to go through the immigration process if they don't have the intention of moving there?

EXACTLY! This is just plain crazy and heartbreaking for those involved.

I thought it was pretty much understood that with Canada the spouse had to basically move back first to prove domicile.

Especially for Canada, I feel that your evidence was a little light.

For us, and keeping in mind that Canada is harder, we did the following:

- Current US driver's license

- Current active library card and AAA membership

- Communication with school for daughter's enrollment

- An accepted will by the probate court and real estate evaluation showing that I was the sole inheritor of a house in America

- Proof of being on my mother's car insurance in America

The attempt is to show that you actively live in a place - car insurance or things that you'd only have if living there. Sending mail to an address or transferring funds is not really showing that. Think about having utilities in your name, actually moving in with your father for a few months, registering your car in America, etc.

I don't think you need to rent an apartment if you are planning on living with your father. Just grin and bare the couple of months to get the domicile in order. I can almost assure you that if you move in with your father (and have proof of living there like receipts, etc.) and you do some of the normal activities of life like car insurance, you'll have no problem in meeting the requirements.
