  1. Hello everyone,

I am writing as the petitioner for my husband's CR1 visa. When I filed the petition, we were living in another country outside the U.S. Will this affect his visa process and future interview since I am still outside the U.S.?

Currently, this was the last notice we received from the NVC:

The National Visa Center has received all documentation necessary to complete pre-processing
of your case. As soon as an interview date has been scheduled, the applicant, petitioner
and attorney (if applicable) will be notified.

Also, when I have read on the Immigrant Visa website (Dept. of State), it appears rather vague.

Is Residence in the U.S. Required for the U.S. Sponsor?

Yes. As a U.S. sponsor/petitioner, you must maintain your principal residence (also called domicile) in the U.S., which is where you plan to live for the foreseeable future. Living in the U.S. is required for a U.S. sponsor to file the Affidavit of Support, with few exceptions. To learn more, review the Affidavit of Support (I-864 or I-864EZ) Instructions.

*Domicile: Place where a person has his or her principal residence. The person must intend to keep that residence for the foreseeable future. The sponsor of an immigrant must have domicile in the U.S. before the visa can be issued. This generally means that the sponsor must be living in the U.S. In certain circumstances, however one can be considered to have a domicile while living temporarily living overseas.

Does this mean to say that I need to go home and be physically present in the U.S.? When I filed the I-864 Affidavit of Support, I attached my tax returns that showed my residence/domicile in the U.S., even though my income was earned outside the U.S. Do I need to go home or can I stay with my husband?

Thank you for your help and advice.

  2. Hi again guys,

It seems that 1st week of July is over and I don't have the appointment letter yet. Does it really take long to receive that letter? We've tried calling NVC for several times and the people there are very discouraging and don't know how to show empathy! We've been on hold for 22 minutes (2nd call) and 25 minutes (3rd call) and when they finally answered it took them a minute only saying "I DON'T KNOW"! We felt it is a waste of time and money calling for an update ---- not so HELPFUL at ALL!

This is now the 23rd day from the time that we received an email saying that our case is complete and 1 1/2 month more would be a year from the time we started the application. Does it really take long to do this application? to be honest we did not encounter serious problems when it comes to our documents but why is it seems forever for the appointment letter to come!

  3. just had my CFO today too. everything turned out well. i guess just be ready with all your documents especially cases that involve previous marriages and be mindful enough in filling out your form. the counselor is very meticulous when it comes to the completeness of the information you'll be providing. i am just thankful that today wasn't really a PAIN even though i was there really early to secure for a spot.

    --------------------------------------------------------------------------------------------------

i saw a couple of posts on this topic about parental consent/advice on this thread, i just want to share my case that i needed it when i was applying for marriage license since i was getting married without the presence of my parents even though i was at the right age when i got married.

  4. I received the CC email yesterday, and I'm expecting to get my date of interview (for August interview) on the first day of July (by calling NVC). Usually wait a week or less before you can get the appointmet letter.

I got the CC email last Thursday. I was reading some other posts and they said that sometimes they don't send the appointment letter anymore instead you can just call the USEM and make an appointment.

So if ever I would receive a letter within this week, does it mean to say that the interview schedule will fall in August?

  5. Hi again,

I just want to restate my question last time regarding the length of time to wait for the appointment letter? It seems like our case got completed already but we don't have the appointment letter that contains the interview schedule. Does anyone have an idea about "how long does it take to get the appointment letter once the case is completed?"

    thanks guys for the help.

    cheers...

  6. thank you for the immediate response. i have another question though, what documents did you show during the 1 on 1 session with the counselor?

My hubby is a naturalized USC, I was asked:

    -When did you meet

-How long do you know each other

-When did your husband went to USA

    -Do you have pictures together

My 1 on 1 counselling at CFO Cebu lasted for 2-3 minutes only as compared to those who were fiancees and spouses of foreign nationals. Some lasted for 10,15 or worst 30-45 minutes..

For Fil-Am couples: during my session some of my group mates shared the ffg questions

    -When did you meet

-Why did you both decide to get married

    -How often do you communicate

-Asked about divorce and annulment decree

  7. hi, i saw from one post that you are a part of a group in fb. i wonder what's the name of the group in fb so i can join and hopefully i can get information i need in case i would be needing some later on.

btw, what you shared is very useful. gave me some ideas what i need to prepare or do by the time that i have to attend the CFO seminar.

  8. Hi everyone,

I just want to verify some things if I understood it correctly based on the message below:

The National Visa Center has received all documentation necessary to complete pre-processing
of your case. As soon as an interview date has been scheduled, the applicant, petitioner
and attorney (if applicable) will be notified.

Does this mean that the case is complete?

if that so, how long does it take for them to send an email that contains the interview date?

Let's say I got the date for the interview (which is usually scheduled a month later from the receipt date of the appointment letter), will it be possible to reschedule the interview date like 2 weeks earlier from the scheduled one?
