  1. Hi Mayb, Can i ask (as i am about to do the same), how long after you sent the letter to cancel the i130 did London accept and process the i130?

    Does London just need to send the letter or do they need to "see something on the system"? I was just wondering as it could take USCIS a while to cancel and for London to see it!

    London advised me they would not approve our petition with them until the one in the US was cancelled but I went ahead an mailed London a copy of our notarized letter requesting to have our US petition cancelled and London approved ours a few days later! So in short I think they may tell you that they have to see it cancelled but in reality I think they are just looking for your intent to cancel it.

    As far as I'm aware our petition is still live in the US despite my letter requesting it be cancelled having arrived over a month ago.

  2. Hello, I'm my husband and I currently live in the UK, I am the petitioner and he is the beneficiary. Our family friend is our joint sponsor since I have been living in the UK for the past 2 years.

    Our sponsor is married and they have no children so his household size should be 3, correct? On Part 6. Sponsor's Income and Employment he has listed his individual, annual income as $50,000 which meets the poverty guideline requirements for a 3 person house hold size.

    This means there is no need to list his wife's income, correct?

    Also, on Part 6, 13.a-13.c where he needs to list his total income, it should just be what HE earned in those years and not he and his wife together?

  3. Yes I reside in the UK and I meet the requirements for DCF through the London embassy. Everything is inline for my I-130 being approved in London except that my petition needs to be cancelled in the US. I originally filed in the US because I did not realise DCF was an option at that time.

    The USCIS has many offices, so where should I send the request to withdraw my petition to?

  4. I filed an I-130 in June and it was sent to the Overland Park Kansas office.

    I decided to file another I-130 at the USCIS London Office as that process is moving much faster than the U.S. right now. Despite being advised by both offices that I didn't need to cancel my US petition I received a Notice of Additional Processing Requirements stating that in order for my London I-130 to be approved I need to cancel my U.S. I-130.

    I assume I will send the request to withdraw my U.S. petition to Overland Park? Also, does it need to be notarized or just signed?

    We are on the exact same timeline. SO glad I found your post. I too was wondering when we would get our NOA1. Looked in my spam folder today and there it was! smile.png

    This is great!!! We will definitely have to keep track of each other's progress. I'm not gonna hold my breath but I'm really hoping to be done with the process by the end of January! From the way I see it it's taking them about 3 to approve the I-130... so mid November and then about 6 weeks to schedule an interview after the next few forms are filled out so that would put us at the end of December but that's Christmas/New Year's so hoping for an interview date by mid January/end January. I'm probably being unrealistic but a girl can hope!

    and yes, POE is port of entry :)

    You will need a sponsor as you have no earned any income in the US in the past few years. A sponsor basically ensures the following, "This form is required for most family-based immigrants and some employment-based immigrants to show that they have adequate means of financial support and are not likely to rely on the U.S. government for financial support" See this link http://www.uscis.gov/i-864 for the full information.

    The sponsor will basically agree to pay back any money your partner gets from going on welfare for 10 years. They have to make a certain percentage above the poverty line, like for Texas I think it's over $18,000 or somewhere around there. My best friend's husband is sponsoring my husband. He will have to provide us with a tax transcript from the IRS for the past 3 years, a letter from his employer stating the type of employment, his wage, start date, etc.

    Even though you don't meet the criteria for sponsoring your husband (unless you have a certain amount of assets, you would have to do more research on that) you will still have to fill out an I-864 and provide your tax transcripts for the past 3 years.

    That's roughly the idea I'm not an expert though just feeling through this thing as I go! haha I will definitely be following your time line!

Do you know of anyone on the forum here in the UK that has recently done the I 130 paperwork to move to the USA ? I am curious as to see how long it took them. I will check out the links and see what I can find. ...

    I just filed an I-130 at the London Embassy, it arrived yesterday now just waiting on my NOA1. From seeing other people's experiences, especially on the Britishexpats.com forum (http://britishexpats.com/forum/forumdisplay.php?f=35) it appears people are getting through the entire process from 3 to 4 monhts.

    While you're waiting for your NOA2 your partner can obtain their criminal background check at http://www.acro.police.uk/ for the UK and you will also need one from any other country your spouse lived in for more than 12 months I believe.

    You should also start preparing your I-864 (http://london.usembassy.gov/i864.html) you will probably need someone in the US to sponsor your spouse because you've been in the UK so long. However, you will also need to fill out an I-864 so make sure that you're up to date with your US tax returns even if you haven't earned any income there in a few years.

    Hopefully I've explained this correctly but definitely check out British Expats forum or the DCF board on here.

  8. thanks for the tips UKHusband. I agree none of this could be done without this place!

    I've already learned a lesson in patience, stupidly didn't realise we qualified for DCF so initally applied to the Chicago Lockbox facility and we are on month 4 of waiting for our NOA2 hence why we have just said forget it and have paid another $420 to try and go the DCF way!

    From following your journey DCF does seem realtively painless as long as we are up to date with all of our paper work so my fingers are crossed for a semi-seamless journey as you have had!

  9. Hello, hoping I can get some help!

    From looking at the required vaccinations it appears the only one that applies to his age range (he's 27) is

    • Td - Tetanus and diphtheria toxoids
    • Tdap - Tetanus and diphtheria toxoids and acellular pertussis vaccine

    He's gone to his GP and gotten his vaccination records although it's confusing to read.

    Are there any other vaccinations we should be looking into him getting?

  11. this is an absolute disgrace. Why are they JUST NOW transferring these petitions? I'm so angry there's no chance of me being optimistic at this point and I'm just a June filer, I have no idea how people who filed at the beginning of the year are coping. What's even worse is there's no one to really direct your anger towards it's like you pay them $420 and they get to do whatever they want!

    I'm totally fed up, I just sent another I-130 to the London Embassy and I'm going to go the DCF route. It's a shame the government gets so much money for these applications and then just screws people around.
