  1. I spoke to a lawyer today who said I did suffer mental cruelty but my package was very weak and USCIS ignores packages with no lawyers. I tried to ask if we could file before I am in removal proceedings though he ignored that and said we should go slow because all what matters is winning the case. He told me to get him the denial letter first and mean while see psychiatrist/therapist because he could read the stress on my face. He talks like the removal proceedings is nothing. I want a lawyer who is willing to file before I get in removal proceedings. He said he has a good success rate in VAWA cases. He has done hundreds of them.

    Vermont sent the denial letter to my old address in Washington even after I had sent them a change of address form meaning they did not look through the package.

    be careful with the lawyer who says that you suffered abuses etc. it is not the place of the lawyer to diagnose you, you need to find professional psychologist for it.

    I think you did not properly changed the address on uscis case that is why they have sent it to the wrong address.

    You need to pay a lot of attantion to all the details and take your case seriously following all the letters of instructions.

  2. Hi everyone,

    I am trying to respond to my RFE for abuse. I didn't submit any psychological evaluation at the beginning so they are asking for one now.

    I contacted a few Marriage&Family therapists (with a lot of experience) lately, but none seem to know or able to perform the psychological evaluation for me. So question is, WHO can perform this evaluation or whatever its called.

    The issue number 2. None of the therapists is familiar with VAWA. Anybody here has a sample of letter that you send to a doctor when you make initial contact? All of them are like: "Oh, no, I can't help you" when they hear word: Immigration.

    Google in your state "phsycologist evaluation immigration"

    that is how I was looking for one.

    Sometimes it worth the trouble to go to the other state to do the eveluation.

    It has to be PhD clinical pshycologiest though familiar with abuse.

  3. My rfe was only for my arrest desposition. That's it. I sent it to them right away. I'm crying every day. And I'm from Ukraine Crimea the part that got took over by Russia. So I have Ukrainian passport and we r no longer Ukraine I believe we r Russia now. And I don't know if it gonna effect my case.

    I do not think it will at all.

    They not going consider you Russian until you going to change passport.

    Though, sucks (( I doubt you can change passport in Russian consulate only back in Crimea.

  4. Today she came back from the hospital and told me the heartbreaking news. She's got AIDS.

    Now her all hope is wiped off. My heart just goes out for her.She used to anxiously wait for her case to be approved so that she can take care of her mom and grandma...

    Does she has AIDS or HIV?

    If she just got it probably it is HIV (AIDS is the final stage of HIV)

    Cheer her up, having HIV is not the death sentence any more. People live long and productive lifes with HIV. With proper medications and prevention of opportunistic infections she is looking on 20–50 years.

    If she has been diagnosed with AIDS and the treatment will begin right away, life expectancy is about 10–40 years. Educate her and yourself on it!!

    Please, do not put her in the ground beforehand! She needs a positive outlook on life and her prognosis and thoughts of "hope wiped off" is not good because it is not true!!!!

  5. Jessy L.I can't change my phone number.I am using this number for 10 years already. Starting at 7pm tonight I am going to turn off my phone , and during the day,and weekends I won't take any phone calls anymore, that's the only way I found to continue here.

    You can also make the group of phone numbers that are allowed to call you after hours (at any time) and who are not.

    I suggest you also use the google voice (they give you separate phone number, or just calling through online, it is free and no one will have your personal phone number.) So you will be able to contol it.

    what to do if the EAD expires in may, and person works and can not quite.

    The paper work was for new EAD was filed 90 days before.

    Since the first reciept of acceptance we did not hear anything.

    What to do now? The uscis does not accept the complaint or infopass about it if it has not been 90 days since the paper was filed.

    Does she need to quite her job?

  7. jessy L, NBC uses to submit RFE to have fingerprints done when the case is still with them,in case they believe the alien needs to have fingerprint done again.

    her EAD is expiring on 9th of May, we submitted the papers to renew it (90 days before hand), but did not hear anything from uscis about it.

    She did not even had finger print.

    My sister is working now, she has a good job, so what to do? Does she have to quite?

  8. faith38 one member from VJ(alma)she had interview in Boston last year.Her case stayed 3months in the NBC, and after 3 months they transferred to the local office and in 25 days she had her interview, but Boston has more than one USCIS local office.

    Sandra, and if the case stuck in NBC do they appoint biometrics while it is still in NBC or only after they transfer to the local?

  9. USCIS rcommends that you file for a replacement EAD 120,days before your current document will expire, if you believe there is a good chance you will not have your green card by then. This means that you should have applied for a replacement EAD in January - February.

  10. I had biometric and medical and everything...just waiting for a letter for my interview...what about u?what is ur status?

    When did you have your biometicrs? You said that

    Any body still waiting for green card interview?I have been waiting since October 2013 when my case was transferred to NBC and after that nothing happened

  11. folks it seems Uscis started approving some AOS for vawa filers without interview ,then Cielo you were right regarding your friend . I helped one member here, and today she received a letter saying her work permit was denied cause her green card was approved .She did not receive the approval letter yet,but Uscis mentioned the reason of the denial was because her Gc was approved ...then it seems some cases are being approved without interview,she is the first person that I helped and had this decision .

    We are kinda worried.

    My sisiter's ead expire in may.

    She filed the paperwork, but nothing so far. Not even the finger print invitation.

    I recieved both written letters (for 485 and 130) saying that they moved case to Vermont for speeding up the process.

    The letters were address to him (130) and to her (485) and showed up in my place since we changed the address.

    Do we need the infopass to cancel the 130?

    Though, she had 2 infopasses and both unseccessful. They could not tall her anything about her case (and could not even see where it is) and the answer was always just wait.

  13. Jessy L it seems your sister husband did not withdrew the I-130, or maybe instead written I-360 they messed up and sent it the wrong letter saying I-130. I advise your sister to go to the infopass ASAP, just to make sure about it, because if it is a mistake she must to let them know in order for them to fix it, otherwise they will continue and might send it to the husband "by mistake" the mails.

    we have already received approval of I-360, so it could not be the mistake, I hope.

    We changed the address on the paperwork, so everything goes to my address, not to her ex husband.

    Do you think we need to have infopass (she already had 2 because we thought uscis lost the documents in some kind of limbo(()

    So do you think we need infopass ASAP in order to ask them to cancel the I-130 petition?

    He is too lazy to withdrew I guess, do we need to do anything to the I-130? Or just let it go?

    The I-485 was updated saying we transferred your I-485 to your local USCIS Office for further processing.

    Though, we saw the update on the I-130 form, the update was

    The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Does that mean that they going to send the information about the I-130 to the abuser?

    I know that they can not give info about filed I-360, though we kind of worried that they will send him something that make him upset.

    Can we change address on this form now?

    It is so weird that they was such update, because I thought that the 130 was denied already.
