  1. HI, My wife and I are travelling to Phils in Feb 2016 for vacation. We have not reported to the Philippine consulate a report of marriage or changed the name on her passport to reflect her married name. She has a 2yr green card(married name), state ID(married name), and SSN(married name). If i book her flight to reflect her passport(maiden name) will we have any trouble at either border (Phils or US)? Thanks for your wisdom/experience with this.

  2. The visa actually expired the moment she cleared POE. As long as you were married within the 90 days there are no issues.

    If you go by the instructions for the I-485 you only need to include a copy of the DS-3025 vaccination record. Many adjudicators seem to not know this and look for the I-693, I suggest you attach a copy of page 4 and highlight item 7 (c ) of the instructions page with the copy of the SD-3025, this has worked for others... worse case you will get a RFE for the I-693 (but I doubt it)

  3. The visa expiration date is irrelevant as long as you married within the 90 days. There's no set time frame to file AOS. Even tho it's suggested to start the process asap there are people that don't file for it until 1-2 years after the wedding. Don't worry, as long as you got married within the 90 days she doesn't have to leave. As far as I know, You also don't have to do a whole new medical as long as her k1 medical in her home country wasn't longer than 1 year ago. If that's the case all you gotta submit is a completed vaccination supplement form. Didn't need it so I don't know the exact name for it.

    Thank you for the info...thats a relief! So ...if we get an RFE because I don't send in the I-693 with the I-485 packet it really doesn't matter , only in that it would make the process take longer. Right?

  4. I think we may have waited too long to arrange to have my wifes I-693 filled out by a civil surgeon. Her visa expires on 2-19-2014 all of our forms are together but it is my understanding that we cant submit the I-485 AOS packet without a completed I-693. Is the first NOA after submission of the I-485 like an extension of her visa? Is there time enough if I get her into a civil surgeon so that she doesn't have to leave? Any input would be appreciated. Thanks much.

    So no bright possibilities that he would be approved?

    They are thinking if she get approved, she come to US first, then work asap, get their income stabilize together then petiton for 2 kids later.

    Honestly...and I'm not trying to be rude but why?? With a sub 20k income how can this person expect to provide for a new wife and 2 children?? It's like Tina Turner said..."whats love got to do with it". This person should improve his lot and then revisit the idea of a foreign bride. Just my 2 cents.

  6. Today we received our NOA2 in the mail. There are some things I don't understand, it's in the comment part in the first sentence it reads: "The above petition has been approved, and forwarded to the listed consulate." But there is no consulate listed on the I-797 letter.

    questions:

    1) I thought NVC was the next stop in the K1 process after the NOA2?

    2) Is there usually a consulate listed on the NOA2?

    3) Has anyone else had their Petition forwarded from USCIS directly to the consulate?

    4) Should I be concerned about any of this or just be patient and wait?

  7. The U.S. has a very good relationship with phils law enforcement....consider very carefully what you are thinking about, because it is a very SERIOUS crime! You will go to prison if caught and not for a short stay. Aside from being seriously illegal this action is immoral and a great disservice to your child. Will you really deny your daughter, her father?? Please think carefully! Actually please reconsider and don't do it. For sure you should seek legal advice.

    I am inclined to agree with all dogs go to heaven. A connected attorney might be in order ....if you are set on going down this road. Best of luck whatever you decide.
