  1. We it is that time of the year again when its time to go through the process of removing conditions on my wife 2 year GC.

    I feel this time I was more prepared thanks to all of you in this forum.

    Also note I am in Houston,TX.

    I will list the timeline throughout the process below:

    I-751 sent: 05/02/2016

    Receipt date: 05/03/2016

    Biometrics notice date: 5/14/2016

    Biometrics appointment: 5/31/2016 11:00a *they had trouble fingerprinting one of her pinky so I hope its not an issue later on in this process

    If anyone has any questions, just give me a hollar and i will try my best to answer them.

  2. It is not advisable for her to leave the country as it will add more questions during your interview and might or might not hurt your case for her AOS. I just got my wife AOS finished but i believe there was a person before me that got questioned for leaving out of country during the process. (just overheard them talking to their lawyer about it.)

    If it is not very critical important then I will advice you not to do so.

    Sorry i missed the part where her father is ill. I would travel and come back before the specified date.

  4. My advice is to wait what the RFE wants. Mine was as simple as another copy of my wife Expired and current EAD cards (which i sent with the papers but apparently they wanted the same ones mailed to them again.)

    But if it is not about the co sponsor then you should bring your supporting evidence at your interview. It will help make your case stronger that you are above the specified poverty level.

  5. Good News. She got accepted for her EAD after i sent in the RFE. We had our interview on July 18th 2014, and got accepted on the same day for a 2 year conditional Green card since we are married for less than two years. The interview process took over an hour, we went through all the paperwork. We didn't have a joint bank account or our car in both our names. All IO asked us is how we met, so we told her our story and there was silence after that, writing, typing on the computer, and about 20 minutes later (the computer had issues) she goes out to the printer outside the office and grabbed some papers, then she sat back down and told us to get a joint bank account because it is important and said she was accepting our application for a conditional green card because of our marriage is under two years.

    I was a suspenseful day. We didn't use any lawyers but almost all the couples that morning we were there had lawyers. Some of them was questioned for fraud, forgot what they called that test, and some got denied. So really as long as your marriage is honest and real, there is really nothing to worry about.

  6. ok Now i got an RFE:

    " For the household member's income to be included in the household income, the household member's income must have been from a lawful source and earned while the household member was authorized to work in the United States."

    " Please submit evidence that the household member of Form i-864, Affidavit of Support, or Form i-864a Contract between sponsor and household member, was authorized to work in the United States."

    -- on the initial papers sent, i included my wifes EAD card from her stem opt extension she is under right now. Should i resend it again and maybe include the previous Opt EAD card to show that she was legal to work in the united states for our taxes in 2012 and 2013?

    I also recommend I-131 for advance parole. Also, many of the forms will require their own supporting forms. e.g. I-485 will require I-864 affidavit of support, and also another G-325a. Also, it is recommended to put a G-1145 at the front of everyting, for notification.



    What is the i-131 for? She is already in the US legally and we have no plans to travel anywhere.


  8. So let me give you a background:

    I have known my wife since we were kids back in Indonesia. Well I moved down to Texas with my parents when I was in middle school and we didn't get in contact again till 2010.

    Talked a lot to each other, she was going to college at University of Florida and graduated 2011 for Electrical Engineering.

    We started dating at March 14 2011 and started living together after her graduation which was in December 2011.

    She applied for her OPT status before hand.

    My wife and I got married 10/16/2012

    She is now on OPT Extension Expires June 2013

    We are now gathering all the documents for her GC application. Which is the I-130, (2)G325a, I-485 w/ I-765, and I-693

    I am currently A student half-time Fall 2013 and full time Spring 2014 (Unemployed but still searching for part time work here in California). She is working making over 50k/year as a Engineer.

    Questions:

    1. I was told that I could send all the papers at the same time since she is already here in the US living together, is this true?

    2. What kind of proof exactly do I need to send for them to see it as legitimate marriage?

    2a.She is an authorized person on my credit card and so am I on her Bank of America CC. (I am having trouble getting a bank account since lol its a long story.) (but I do deposit my paychecks into her account)

    2b. We have plenty of photos together.

    2c. She on my car insurance which she drives the car to work everyday.

    2d. I have marriage certificate.

    3. Can I just send my Certificate of Naturalization to show proof that I'm a US Citizen or do I need to get a US passport and send it too? (they didn't let us register for passport at the Ceremony and got busy afterwards.)

    4. On the Petition we would file it joint? since we are married and living together right. Which looks at the overall household income, which is above the 19k/year for two I think the website says for the poverty line.

    4A. Is that good enough or do I need someone else like my step-father(me mom and stepfather lives in Texas) to petition with me?

    5. Am I missing anything else?? I really want to make this process go smoothly because these kind of stuff makes me stress out and overthink.

    Thanks Everyone for your Advice and help on my Naturalization which I got approved March 2013!!(I was ridiculously stressed lol).

    And Thank you ahead of time for everyone that helps me through another Visa Journey together and hope by this experience I can also give a helping hand to other couples that will go thru this process.

  9. I just saw visa bulletin for january- marriage to a GC holder has no wait time anymore? I know it used to be years....now it is C - current?

    that means if one of us gets their gc, the other can get it in a relatively short time as well?

    It is not right away if married to a GC holder. it might say current now but it can not guarantee a visa right away, might take years yet again. Only married to a USC can guarantee you an immediate GC if you meet the requirements.

    A spouse of a U.S. citizen is considered an immediate relative. You will need to file an I-130 petition. Since she is here in the States on a work visa, she will need to adjust her status, Form I-485. You may file these two concurrently. Once the I-130 petition is approved, they will concurrently adjust her status to LPR (Legal Permanent Resident).

    Additionally, you may file Form I-765 for an Employment Authorization Document. IIRC, if filed with Form I-485, there is no filing fee. She would then be authorized to work while waiting for her green card.

    Attached is the cover sheet of the documents we sent. My wife successfully adjusted her status with zero problems. I hope you both experience the same.

    What if i don't have a birth certificate?

    Also i am doing only temp work right now because of school in fall but she does make over 50k a year from her job.

  11. I just received my citizenship May 23rd 2013. My wife works here in LA as an engineer under her OPT which expires next year. We got married Oct 16 2012 at the court house with only the judge present in El Paso,Tx where we both previously worked until we moved Dec 2012 to LA. We both have filed 2012 taxes jointly. now my question is because i want her to get a greencard is that Im not working right now well im doing temp jobs but i will be going back to school this fall 2013 for engineering degree, What documents would we need to do? We plan on starting on august or September for her GC. We have lived together since Dec 2011, I knew her since we were 6 years old in Indonesia where both our parents had a project together. Please i need all the advice i can get, i want this to be as smooth as possible
