  1. In Part 6 of the form 13a, 13b, 13c we need to fill out the adjusted gross income from previous years.

    My wife was in collage for 2012 and 2011 tax year and had zero income so she didn't need to file. The instruction in the PDF states to write a letter explaining the reasoning behind not filling.

    What should i write in the letter, just simple explanation that she was in collage and didn't have a income. Is there anything else i should add. Can someone help in drafting a letter for this.

  2. The current annual income is what she makes now. Take her weekly pay and multiply that by 52. If she gets paid bi-weekly, then take how much she makes in 2 weeks and multiply that by 26. If she makes around $1800 a month from the employer, then she meets the income requirement for a household of 2. Provide a letter from employer and/or recent pay stubs to prove that income amount. If she received a 1099 for her freelance work in 2013, then you can add that amount to the current annual income from the employer to get her total annual income. Her tax transcript for 2013 is proof of her self-employment income. She meets the requirement without it though, and should not need a joint sponsor. You can only use one joint sponsor, if you needed one.

    For the years she did not file taxes, do not put $0 where it asks for the total income(line 22 of the 1040) from her past returns for 2011 and 2012. She did not file. Leave them blank and provide a statement as to why she was not legally required to file those 2 years.

    So i'll file the pay stubs for the last six months and also letter from her work saying how much she makes from them.

    I was under the impression that she didn't meet the minimum requirement and because the previous year transcript showed a lower amount. But its a huge relief that she does qualify.

    Are we not allowed by law to use a joint sponsor, Even if the primary sponsor meets the required income for a household of 2. We just want to have that as a precaution, we don't have to use two joint sponsors.

    You said to look at the 2013 (line 22 of the 1040) that exactly am i looking for. I understand that i can't put $0 for 2012 and 2011, even though she didn't file for those years because she was still in school and had no source of income. I have four sets of 1040 from her, account transcript, wage and income transcript, tax return transcript and record of account.

    I was filling out I-864 and i am quite confused about Part 6. My wife who is the primary sponsor graduated from collage last year and got a job in the middle of the year and on her IRS transcript is says that she earned a total of $16,000 and after adjustments she earned around $14,000.

    She works for a company as a full time employee but also does freelance work. From the full time job she averages $1800 per month ($21,000 annual AVG) and from the freelance jobs she can average about $3000 a year. (To show the freelance and full time employment i ticked 1. and 2.) Is that correct.

    So my question is what do i put in " My current individual annual income is" do i put the income from previous year IRS form. If so then which one. The total income or the adjusted income.

    With the present projected income, she can be my sponsor but even then we have two other joint sponsors. Who's income is well over $70,000.

    The other problem i have is that she didn't file her taxes for 2011 or 2012, so she only has a transcript for 2013.

    In the form they are asking for three years of income. What is the solution to that problem ?

    So do i just leave those as $0.

    I would really appreciate any help i can get with this.

  4. My soon to be wife who is a recent graduate from collage like me, only earned $15000 after adjusted gross income. But her total income was around $24000. For her to be my sponsor she needed to earn around $20000 after the adjusted gross income. Does that mean she can't sponsor me, is there a work around ?

    If i have a friend who makes around $40000 and has 2 children and a wife, is it possible for him to sponsor me ?

  5. One more thing: there's the alternative. That is what I did. You file for AOS this year and you go over to your international adviser and tell him/her that you would like to keep your F1 status. That means while AOS is pending, you are still F1 student. Has bad side, but good side too. Bad side, you still cannot get a job outside of campus and your tuition is still high (if you pay for it). Good side of it though, if AOS fails, you can still stay finish up your school as an F1 student. That is what I chose at the time, it is safe®. Alternatively, you could tell him/her that you no longer want your F1 status, but that will mean that if AOS fails, you have to pack up and go home and cannot finish school. So, I recommend you to choose the first option what I also chose at the time. That way, AOS failing, or not, you can still finish your studies. Or, as I mentioned above, just file next year this time. Good luck!

    We have been together for over 3 and a half year and just wanted to get married and start a family.

    We have had a lease under our names for 3 years. We have several friends who are giving us the affidavit for bona fide marriage, we are opening a joint account this month and she makes over $20k a year. Does this look like a case where they deny AOS ?

  6. You need to take the time and read all these both on this forum that people have provided the link for, as well as on USCIS website. You are asking every second question that is actually written down. Please read first, and then if you still have questions, feel free to ask. Not trying to be mean, but you cannot expect to have every question by the minute be answered. You need to read and check out websites, and links. People have provided here numerous ones that are really good to start with, but also if you go to USCIS website you'll see exactly what you need to do, where a civil surgeon is located in your area, and what is proof of naturalization accepted for etc. Please, read all these, okay? And really, I'm not trying to be mean but you need to be a bit more independent, and read things and ask once you have read all the required documentations, and fees. Good luck!

    I apologize if i am getting on people's nerve, i have read the step by step guide several times and the naturalization, permanent residence and the birth certificate was a little confusing at first.

    Again i am sorry, i was just a little scared about this process.

  7. I know someone who paid $1500 including immunisations. So... $100-$300 is the "reasonable" price which is why people should shop around!

    That's what i have been reading that it normally cost between $100 to $300 depending upon which vaccination is needed.

    I also found out that it cheaper to get vaccinated at your local department of public health.

    I live in downtown San Francisco, so everything is three times the normal price so i will getting the vaccination from the department of public health before hand and just go for the physical with the civil surgeon.

    What are test's and vaccination are needed to be done.

    1. We have been living together for over 3 years in a rented apartment with lease under our names.

    2. We don't have joint accounts.

    3. We don't have a child together.

    4. Don't own property together.

    5. We do have many common friends who can confirm our relationship. What do i need to write on the affidavit, other the basic information about them.

  9. So after getting married and getting the marrige certificate.

    I will need to file;


    1. I-485 (AOS and Green Card)

    2. I-765 (Work Authorization, EAD) which is optional. What does the EAD stand for?

    3. I-131 (Travel Authorization) is that same as AP

    4. I-130 what is this petition for?


    Does the sponsor have to be a family member or does a friend work.


    What other forms are there to file?

  10. I am on F1 visa which expires in 2015, but i am going to be done with collage by 2014 July. We are getting married in July 2013, and we are getting married in city hall so it will be a legal marriage.


    Do i need to do anything before getting married, and what paper work do i need to do so i can obtain a green card. I read that i can't travel for sometime, when i am in the process of getting a green card. I need to travel out of the country in January, is there anything i can do so i can enter back with out any problems.



    How much does it cost, because i don't have job and my soon be wife just got done with school and is looking for a job.
