  1. I have a USC brother in law who has been residing in Pakistan for the last 17 years.During this period he has never visited the US but was busy in his own business in Karachi.

Now he is in the final process of sponsoring his wife for a green card.

NVC is asking to complete a I-864 which requires tax returns for the last 3 years.

Has anyone gone through the similar situation?Does anyone know any tax attorney in Pakistan who can help him file past returns?

  2. What if I have a spouse and an infant who live outside the US,waiting to join me here?

    The N-400 requirement says:

If you have a dependent spouse or child(ren) who do not live with you, send:

    * Any court or government order to provide financial support;

Does this clause pertain only to those who live in US?

  3. Search for some additional info on your consulate. Some consulates will not accept co-spnosors. Mostly for K-1s, but you are filing for IR-1, so I'm not really sure. I would call the Consulate and ask the question. I would think that the interview is a bit late to be dealing with it. Makes you wonder how it made it thru NVC....

When the case was still with the NVC,all they asked me was a new I-864 with the signature as I missed signing up the I-864 but they said, bring it at the time of interview.I specifically asked them if they need anything else other than that, they said no.

The consulate too has not raised the Co-Sponsor issue and the interview is 3 weeks from now. What is making me wonder is,if the case requires a Co-Sponsor,they have to ask us to provide that well before the interview. Why would they send her home on the interview day since arranging a Co-Sponsor takes time.

BTW my case is F2A not IR,does that make any difference,I don't think so.

  4. Guys I need your input on this:

I'm an LPR and my wife has an interview date next month(in her home country).I have been unemployed for 2 years now but I have already sent in my I-864 and file is now at the consulate.

Neither the NVC nor the consulate have so far asked for a Co-Sponsor.I assume they will but so far they have not.

Just in case I have the Co-Sponsor's I-864 ready with me and I have sent it to my wife,in case they ask for it.

I am wondering why they have not asked for Co-Sponsor yet.

    Any input on that,guys?

    Thanks.

  5. The baby doesn't need a visa if one of the parent is a USC, all you have to do is report the birth of the child at the consulate.

In your case it's not so....so baby will get a visa.

Here is one link I came across:

Children born abroad to permanent resident mothers are permanent residents.

The requirements are that such a child must be brought to the U.S. on the mother's first return trip, which must occur before the child is two years of age.

As of this writing, the child in this situation does not need a visa.

  6. Once born take the baby to the interview and he will be processed along with your wife's visa. She will be asked if she's the mother and if she wants to take her baby with her when traveling. If she decides to travel with the baby she will be asked to fill out the DS-230 form for the baby, pay the visa fee and do a medical test for the baby, and visa will be issued for both your wife and soon.

I have heard before on this forum, the baby doesn't need a visa. This is confusing.I know all this confusion will go away once the embassy clarifies this but they are not answering.

  7. i dont think it matters. but to be sure, just consult it from the US embassy where your wife will have her interview..... the only big worry here if you have to file separate petition for your baby since the mom is leaving and already has the visa ---- WHICH YOU WILL BE FINE... just tell your wife to keep all the pregnancy records.... i mean all..prenatal records, cert from the OBGYNECOLOGIST, ultrasound... etc.. and that will be a must to have that waiver for the newborn.

i would ask the consul right after he/she will approve my visa..... normally, they will tell you what to do.

    Mitch,

There is an obscure law where a baby can draw citizenship if the grandparents were or are US citizens. In my case they are,I mean my parents(baby's grandparents)are US citizens, are alive and live here in the US.

Can our child benefit from this?

  8. I am an LPR and my wife is in her home country, she has been scheduled a visa interview in the embassy.I am requesting the embassy for a re-scheduling of the interview, probably for a month later since she is 9 mo pregnant.

Can anyone educate us,what is the procedure for grant of visa to the newborn,if he needs one.Doe we have to take him to the embassy?

    Someone in this forum,different thread,said He won't need a visa.We are confused?

Has anyone gone through all this?

  9. Guys I need advice.

My wife is schedule for an interview on 24 September, however it is unlikely she will make it,since we are expecting a baby around the same time,Inshallah.I need to re-schedule the visa interview for sometime in November.Has anyone of you -rescheduled his/her interview before?

Secondly what is the procedure of granting an immigrant visa to the newborn given that I am an LPR not a USC?What do we have to do at the embassy?

  10. So I am getting things ready for my wifes trip through the NVC. I have run into a slight issue and would appreciate any help or guidance that anyone can offer me.

I am a US citizen who is applying for a CR1\IR1 visa for my wife.

I have a question regarding the Police Certificate also known in Pakistan as the Character Certificate.

After we were married in November 2009 my wife (beneficiary) updated her Pakistani id card and passport to reflect that she was now married and accordingly she had to update her address on her passport and id card with my address in Pakistan.

My understanding is that the Police Certificate (Character Certificate) required for the CR1\IR1 visa needs to be issued from each locality that the beneficiary has resided in. My wife has lived almost all her life in Karachi; her Pakistani ID card and her Pakistani passport have a new and updated address which is barely 5 months old. I was informed by the authority that issues the police certificate that it will only be issued against the address that is on her passport and id card, which has the new address on it. They informed her that they will not issue any other certificates against any other Karachi addresses; they will only issue a Police Certificate against her address that is on her passport and id card. Will this be sufficient or is there something else I need to do in order to satisfy her visa requirements?

Please also note that her address on her passport and id card are different then the address on her CR1\IR1 visa and I-130 applications. Both the addresses are valid however all visa related items need to be mailed to her address that is on her application. Will this be an issue?

Meanwhile I ahve also emailed the US embassy in Islamabad to see what their thoughts are.

Thanks in advance to all who can help me get this figured out.

Does the SSP office accept POC card as a valid Pakistani ID?

  11. I am an LPR and my wife's paperwork is being processed at NVC.I sent in my I-864 even though I had no job,the NVC said I'd require a co-sponsor,then they returned my own I-864 and asked me to send in proof of my bank balance in US.I returned the I-864 with proof, all this while my co-sponsor is still lingering over in sending his I-864.

Today when I called the NVC,they told me the file is complete and waiting to schedule the interview at Islamabad.

Is this usual? How come they have completed the file even though they don't have the I-864 from the co-sponsor?

maybe they are forwarding the file to the embassy who will decide if I need a co-sponsor.Is it right?

Its a paper and not even a card and it is against the law to laminate it.

Also Feisal, never ever carry it with you when you go out.Just memorize the number and save it at home somewhere.Same goes for the green card.I have never carried it on me anywhere, nor have I ever been asked to show it unless someone asks you to bring it along otherwise there was never the need to carry it,except ofcourse when you are travelling internationally.Hope these tips help.

  13. It depends where you will be coming from but if you get to bus stop at 6:00 or 6:30AM then you will have enough time. They used to have this bus stop at convention center before buth now they moved it to Bara kahoo side. it better to be early for an hour than coming 5 min late. Good Luck

  14. In a few months time I will be getting ready to apply for naturalization.Although I have kept every precise detail of my trips abroad(none lasted more than 6 months)I still want to make sure USCIS doesn't bungle up my dates or I will lose my $600 naturalization fee.

A friend I know had to pay $600 twice since USCIS messed up the dates in their system.

I looked at my passport and I noticed on one of my returns, the CBP officer missed stamping the passport.

Is there any way one can retrieve a record of departures arrivals from the CBP.
