  1. Guys it's so frustrating isn't it, it's taking so long. Are things slow in the office these days? is there anything you can do to that can help?

     

    I know i'm only April filer, i know someone who filed in December waiting for interview TO BE SCHEDULED, it's just so insane. I'm sure things will eventually move to online and this will probably be a history in couple years.

     

     

    Does anyone know how you check their current month from their dates posted, like if it says April, what does it mean ? Are they working on April 2016 applications now, what step? scheduling interviews, oath? interview? How is it translated exactly?

  2. Should you leave the blank lines as blank or put N/A? A while back a saw a poster mentioning soemthing like 'blank lines are misread by computer and end up causing issues and having officers manually add data'. Please let me know if that's true. If i should write N/A on all blanks or just the first ones in the individual sections that don't apply to me.

     

    I'm filing under "3 year rule by marriage". I'm sending my 3 year tax transcripts (filed jointly) and nothing else as evidence. Is that enough? I'm going by rules but i want to be sure.

     

    Also I understand that after some changes couple years back, the pics are no longer needed, right?

  3. This is the letter added with the package explaining the change of route and just wondering if it looks good...

    I am petitioning for my wife Alien Relative(name), I am sending a copy of NOA approval notice for I-130. However, she is now in US on a B2 Visa, hence the case no longer needs to be sent to consulate abroad. The letter states ‘We have sent the original visa petition to the Department of State National Visa Centre (NVC), 32 Rochester Avenue, Portsmouth, NH 03801-2909”. Following the instructions on I-485, I am sending the package to the Chicago Lockbox as the instructions say, with the copy of NOA approval of I-130 attached with this letter. I want to make sure that the case is transferred back to Chicago Lockbox now that the relative is in US. Following the instructions I have put everything together along with NOA for I130.

    I was considering the address on the approval notice, which is the one that I mentioned. Now I see Receipt notice address is what you said, I'll have to get that because I don't think they saved it, I was sure the address on both NOA's for i130 would be same...

    However, as you said, following the instructions for stand alone I-485, it seems like it should be mailed to Chicago Lockbox. Petitioner will write a letter explaining the change of route. I just want to make sure it won't get delayed, lost or rejected due to this....

I am sending them a copy of approval notice of I130 with I-485, and as Darnell suggested, i may also write them a letter explaining this, but the question is, whether i should send the package to Chicago Lockbox (correct office for normal filling) or as Darnell suggested send them to the address on NOA (approval of I130) which would be :Department of State National Visa Centre (NVC) 32 Rochester Avenue, Portsmouth, NH 03801-290.

    The NOA states 'The above petition has been approved (I-130). We have sent original Visa petition to Department of State National Visa Centre (NVC) 32 Rochester Avenue, Portsmouth, NH 03801-2909" ...So you're suggesting that instead of sending it to Chicago Lockbox (where it's suppose to go), i should send the whole package (I-485 and everything) to this above address? This has really thrown me, i hope i don't make a mistake, that would be going against the instructions, should i really do that?

  7. This is a bit complicated and the petitioner is stressing out. Petitioner (US Citizen) applied for his wife's visa while she was abroad in her home country, she came to US to meet him on B2 (visitor visa), he received a response and I130 is approved, now he has to send her I-485 and rest of the required forms and he's not sure if this is the right way or if anything else is needed since the case was filed while she was abroad and went to consulate, she's still living with him in US. He has I-485 ready along with the approval notice if I-130, is there anything else needed? for example what if the case is in the embassy abroad and they don't have her information. , again, I-130has been approaved and a stand alone I-485 has to be sent to Chicago Lockbox, but he just wants to make sure if he's doing everything right.

    I've searched the forum and looks like this is quite unique, hopefully someone can prove me wrong.

  8. Should i write 2012 as the most recent tax year? once this is sent, taxes for 2013 will be filed and when and if they send a RFE for 2013 tax returns, i'll send them that, it'll give them enough time to prepare for it. He has to pay late fee there is no other option.

    Secondly, the question 13. on PAGE 5, Which goes 'i have filed taxes for the last three years...' should not be checked, right?


    Should i include pay check stubs for his 2014 income to help the case?

  9. Few questions regarding i864:

    Sponsor who is filing for mom and wife has filed taxes for 2012,2011,2010, but not 2013. What to write on Part 6, Sponsor income and employment; 13a (most recent year), should i write 2012 as most recent year? or 2013? However, 2013 would be a lie because it says 'adjusted gross income on IRS FORM 1040EZ) which was never filed. This is very tricky, sponsor can file taxes soon or with 2014, however immigration forms needs to be sent this week. Annual income is around 90k, i can include paycheck stubs for 2014 and a letter to explain that taxes were not filed in 2013? if that would help.

    Secondly, he's filing for mom and wife separately, on separate visas, so he will not put wife's name on parent's i-864 (part 3) (if parent is the principal immigrant) and vice versa. It seems like the right way to it, i just need confirmation.

  10. How important it is to file taxes together for spouses? Is it going to effect negatively later on if you haven't filed taxes together later on when you renew your Green card after 2 years? Surely there are a lot of couples who are in different cities/states due to work / college etc and have to file seperately, does it prolongs the case in immigration?

    We would be filing seperately but we're concerned about whether it's important or not, we would definitely not want to complicate our case if it's not recommended and create issues.

  11. We had our AOS interview in Sep 2013 and received a RFE later, interview hadn't gone well and they had asked for more evidence. RFE was submitted in 3rd weeks of Dec 2013 and we still haven't received any response, the case is pending since July, married for more than an year now. When we try to call or book an appointment, we get no response. Should we go to the immigration office to ask them about it? i know that the case is with the officer who took our interview, i don't think he was nice at all, he was constantly picking on what we were saying and giving us negative looks. Which scares me because, if he's in control and doesn't want to approve, he can take forever and then reject it. My other concern is that, we didn't receive any confirmation that RFE has been received by office, should we be worried? They were about to close the office and security officer told me he'll take it and put it in the mail box (same office). And he went in an did that and came back and told me it's in and i don't have to worry. Aren't you suppose to receive any letter or notification for RFE that's been received?
