  1. Where is this information coming from? What can be done to confirm this before the interview? I'm sick with worry over this and have over a month before my fiancé's interview. As the USC can I email the embassy and ask if I have to be present? Would contacting a Senator or Congressman help? My recently finished vacation to Brazil to be with my fiancé was planned and taken around the fact that I didn't have to travel there for the interview. It would be very difficult to attend the interview but probably not impossible, but its still not something I want to do unless its necessary. Help! sad.png

    This happened with 3 people from a group of Brazilian K1 I'm part of. For all we know they're doing this randomly, we couldn't find any pattern between them to justify the resquest. The embassy website says that the petitioner's presence is not required but it's always encouraged. Someone in hte same group had their congresman to call and they said that the petitions from k1 had increased lately and they're trying to make people to give up. What scares me the most is that we never heard of this happening before and only in august they've already done this several times. I have the feeling that if you email the embassy, they'll tell you the same as written on the website. So maybe ask for your congresman to do it for you maybe? We already asked ours and we're waiting for a response. I have a strong feeling that they will keep doing that without following a pattern just to make our lives harder.

    No, there were a lot of different cases, and no apparent reason for that. There was this girl that was in a 2 year relationship with her fiancé, they travelled to see each other, had TONS of evidence, and she had to cry and show the evidence herself cause the consul didn't even ask for it.

    "On the day of the interview, the beneficiary (applicant) must appear in person at the U.S. Consulate in Rio de Janeiro at 7:15am. The petitioner's presence at the interview is always encouraged."

    What amazes me is that they have never done that, they just started, like one month ago and it's not one or two people, it's like for 90% of the interviews!

  3. Rio de Janeiro's consulate started to require the petitioner's presence at the interview out of nowhere and without following any patterns whatsoever. What they do is to send the beneficiary home with a green envelope in hand requiring that they reschedule the interview to have the petitioner with them. They do this randomly, some people they don't even interview, some they do a lot of questions and don't even ask to look at any evidences and just hand the envelope without saying the reason.
    This has never happened before and just started around a month ago.

    Have anyone here know what is this all about?? Does any other embassy/consulate in the world started doing that as well?

  4. I'm sorry this might sound as a stupid question, but this got me all confused:

    "....two electronic filled out DS-156(with Barcode). Does that mean i have to fill out the form online, print, comeback to the website and fill another one (stupid I know, but so many things in this procces didn't make sense either) OR does it mean i go, fill out the form and PRINT two identical copies of the same page?

  5. We filed in April and received NOA1 on April 25th

    On July 30th my online status changed so we called USCIS on August 1st to find out why.

    They said that on July 30th a RFE was sent out.

    We did not receive RFE after 15 days so called again and they said they would resend again.

    We received a letter in post saying about the phone call we had a few days before and a email saying the same.

    No RFE arrives in post again.

    On advice of a friend who is a lawyer we went online and booked a INFO PASS which is on Monday 24th.

    We have spoke to tier 2 officers twice.

    They have correct email address and correct address to send letters to as we have received everything else via them they just don't seem to be sending any RFEs in post like they said they would and no emails with regards to RFEs.

    Don't get a lawyer, get a comgressman involved.

    We've been through something similar, our RFE never arived, 15 days later, my fiancé called USCIS and put a service request on it, they said it'd take 30 days just to process the darn service request. Got an infopass and nothing, just another service request. 20 days after the rfe being sent we got a sentor's help. The person responsible for immigration issues gave them a call, talked to some people and all. A week after that, my fiancé got a call from TSC saying that they would disconsider the RFE and approve us anyway. We got our noa 2 that same day, 11 days later our case was shipped to the DOS.

    Now, for them to CALL, the senator's person must have done something!

    That's my advice.

  6. Guys, we finally got our case shipped today!! It took 29 days from the noa2. But I gotta say, I don't think this would happen today without our congressman's help!!

    There's one thing I want to make clear here for those who don't know what is going on and why this is taking so long. All this waiting to get the new case number after the noa2 is NOT NVC's fault, although they always say it can take up 8 weeks, this is just the deadline they have, but the real delay is from Texas Service Center.

    It had been 4 weeks since we got the noa2. We sent several emails to different email addresses (NVC & TSC), we called NVC almost everyday and still hadn't got anything. Then, my fiance decided to try the Congressman again (he contacted him when we were waiting for the noa2 for 5 month and a few hours after the congressman's assistant made a phone call to TSC we got the noa2. Coincidence? maybe). The assistant called TSC again and guess what?! The attendant confirmed that our case hadn't been sent to the NVC yet and she also told him that they are having trouble with cases transferred from Vermont! Shortly after he talked to TSC my fiancé received an email saying that our case was shipped today! Another coincidence? I don't think so...

    Snce we're both from Brasil and had our cases forward on the same day, maybe we will have oir interviews scheduled on the same day either! it'll be good to have company in Rio! :)

  7. We called DOS today (first time calling ever after getting our noa2) we basically knew that there's no chance they have our file yet but we still wanted to try.

    Of course they didn't have anything, it's been exactly 2 weeks since we been approved. But here comes the interesting part, the lady was super nice and said to allow it 3 weeks from approval.. Not 8? Are they all giving out different information? I'm confused.

    Well, after the call we received from Texas saying that they would waive our RFE and go ahead and approve our petition anyway, i don't doubt anything else from these people.

  8. What happens if RFE is not in hand within the 15 days they say to wait? What do we do? What do they do? Please don't tell me they will just resend and tell us to wait up to another 15 days!!

    I'm sorry to tell you but, yes, they will.

    Actually that happened to us, my fiance called on day 15, they put a service request on it and told him it would take 30 days just to process the service request. He kept calling, got an infopass and nothing. After 25 days from the first lette they resent it. It has been 8 days and nothing again. The first letter was returned to TSC. My fiance contacted our local representative and that helped a lot. Actually, they ended up waiving the rfe and we got our noa 2 instead, don't ask me how or why, but i think the representative helped.

  9. It all started when they sent us a RFE a month ago that never came. After around 3,000 calls to uscis, 3 service requests, and a contact with our representative, they resent the letter last thursday (still didn't come). Past monday the first RFE letter was returned to uscis as undeliverable (the address was right, we got letters from them before!). Today my fiance gets a call from a TSC agent saying that she looked over our process again and that she was going to approve it, WITH NO RFE!!!! I mean...miracles do happen and a contact from your senator office helps as well.

    We just got our NOA2!!! I can't believe it! Finally!!!!! :)

  10. I recieved a RFE on July 5th 2013 and they are requesting the G-325A and passport pictures that I forget to send in with my application. In the RFE letter it states I have 84 days. I am so happy it gives me that amount of time because I am still waiting on my fiance to sned me his. I hope to get it by next week. But for the most part I think the deadline is 3months. I hope that answers your question.........

    you are usually given 3months to get back to them with whatever they requested from you!

    we got an RFE requesting for letters of intent to marry from both parties,and we were approved in a couple of weeks after they recieved it!

    Cause my rfe never arrived and they just resent it, but the tier 2 person we spoke to kept saying that there's a deadline for it to be replied and if it's something simple they give you less time. That kinda freaked us out, because if we missed the first deadline then it'll be a great headache for us to prove that was their fault in the first place (like telling us to wait 15 days before calling) - although we do have 2 service requests to prove it. I just wanted to know the average time so maybe we can feel a little bit less desperate while we wait for the second time for the hard copy to arrive.

  13. So, after 3 service requests, an infopass and a congressman involved...today my fiance called them and they said they'd mailed the RFE again last thursday. He spoke with a TIER 2 person today and this person said to give it another 30 days for it to arrive! Oh for God sakes, really??? The same person said that the RFE has a deadline - and tells us to wait 30 days to do something in case we don't receive the package? What sort of advice is that? - so she said for us to mail the service requests receipts with the RFE to prove we didn't receive it in first place and to disconsider the first deadline. So I'd say that if any of you didn't call them yet, CALL NOW! Don't wait until the deadlines they give you, cause each person says something different every time you call, and they don't even know what they are saying (hence the "you have a deadline to make, but wait another month to call in case you don't get it") call them everyday, get in touch with your congressman, send an e-request, there's even an email address there somewhere. Do everything you can, even if they keep telling you to wait, cause if you miss the deadline then they'll say it'll be your fault.

  14. Hello , I received the email for RFE July 9 . From the site I calculated an estimated 5-20 days but soon it will be a month and I'm very worried. We wanted him to be here before our daughters 1st birthday :/

    Well, i was in the same situation as you, RFE sent on july 8th and never arrived. On day 15 my fiance call uscis and filed a service resquest, which they said it could take up to 30 days just to process. He also got an infopass (a appointment with your local USCIS office) and they couldn't do anything, so they filed another service resquest. Last monday he got in touch with his congressman's office, and the person responsible for immigration issues also gave them a call. Today he called USCIS again, spoke with a tier 2 person and they said that the resent the RFE last thursday, and to give it another 30 days to arrive (is it coming from China?). Anyway...call them, file service resquests, email them, call you representative. Do everything you can.
