    Just want to ask how to apply NBI with AKA. I have few question and pls help me how to fill up the form. I have NBI way back 2007 in married name, and now I am annulled.

    1. Do I need to fill up as a new or renewal?

    2. Single name (since I am annulled)?

    I called the court said they can not issue me a cert finality or decree of annulment because in my court decision and cert entry judgment indicate " in section 21 for declaration absolute nullity and voidable file petition prayers custody" it means i can not remarry eventhough my nso mc mark declared void ab initio? I donot understand and my lawyer left me after my decision received. Pls enlighten me.

  4. Honestly after the court issued the annulment decision just count 18 days and u can request for it.... Same day u will have it, it's only the court clerk doin that certificate.

    Is the Certificate Finality and Certificate Entry of Judgment is the same. The Court issued me a Certificate of Entry of Judgment?

  5. You must be talking about DS230. According to those who have been interviewed, it is not needed.

    You just need DS 156, DS 156K, DS 157.

    Just explain your previous marriage on the DS 156 and 156K. You can't provide a CENOMAR since you are "previously married" so a different certification from NSO, I forgot how it's exactly called, Certification of nullity of Marriage????

    Where can I get the Certification of Nullity Marriage?

    Sorry I am makulit... I do not understand what the Decree of Annulment, and/or the Certificate Finality is ? I only have 3 documents (Decision, Cert. Entry of Judgment, and Marriage Certificate from NSO Annotated mark Void Ab Inito). If I do not have the Decree of Annulment and/or Certificate of Finality, Where and how do I obtain these documents ?

    Some VJ members said the Court Decision and Decree Annulment is the same. The 3 documents that I have as evidence, is it sufficient for a K1 Visa ? I am really confused..

  7. Here is the replay from the lady who works in the Family Court on what you will need.

    "I am a Filipina working in a Family Court that handles annulment here in the Philippines. Your fiancée will need the decision of the annulment, entry of judgment, then the decree of annulment. Then she need to secure copy of the marriage contract with the annulment annotated on it. A total of four documents. BTW, if there is already a decision, she need to wait 20 days from receipt of the Solicitor General of copy of her decision before she can secure the entry of judgment. After securing the Entry of Judgment, she will have to register the same to the Local Civil Registrar where the marriage took place. The said office will transmit the same to the NSO. She will show the Court what date the LCR transmitted the documents to the NSO. With the proof of receipt of the NSO, the Court will then issue the Decree of Annulment. After 15 days from receipt of the NSO of her documents, she can now request for copy of the marriage contract with the annotated annulment proceedings. She need to request for at least 4 copies for future use."

    There is no need to get stressed out. Just ask questions from the professionals at the Court and they will tell you everything you will need. When my fiancée completed her Divorce (yes there is a divorce for a Muslim Marriage in the Philippines through a Muslim Court and it is very much legal) the good people at the Court House told her what she needed to do for each step. She filed it with her local registrar they told her what they were going to do next. All she just needed to do was pay the fees. The final papers came through NSO Manila with the notation to the original marriage contract and I quote "Judgement is hereby rendered approving the divorce of herein petitioners thereby severing and terminating their marriage bond." Of course there is some more legal mumbo jumbo but that is all that was needed to end the marriage. Now we have all the documents in their completeness.

    She had to register the final decree from the Judge to the registrar in the city where the court is. Then she had to go to her local city registrar to register and get their endorsement and then the registrar sent it on to NSO Manila and NSO Manila made their endorsements and mailed the final papers back to my fiancée.

    So don't get so worked up. Just follow the steps from the Court and you will get through this. Just ask questions from the court. They are the experts.

  8. If you have the annulment decree (decision), certificate of finality, certificate of registration of the court decree and the Annotated Marriage Certificate from NSO, you are good to go. smile.png

    Hi thanks for quick reply... I have some clarification... the Decree of Annulment is Decision signed by the Judge? Certificate of Finality is Certification Entry of Judgment signed by Court of Clerk? and Certificate of Registration and Certificate of Authenticity is Certificate came from Office of the Local Civil Registry?

    I am stressed out and I do not know what to do. Thank you....

  9. It's not final and you're not free to re-marry until you get the final court decision, been to NSO and get the annotated "Null and Void" Marriage Certificate and Declaration of Nullity from Civil Registrar

    Hi I just want to ask is it enough evidence my Decision (signed by Judge), Certificate Entry of Judgment (signed by court clerk), and Marriage Certificate (from NSO annotated). is this all enough to show as evidence? What is Decree of Annulment? I ask court clerk said I need to file motion for custody of my son they they will issue me a Decree of Annulment. Please help..

    I just want to ask what are the requirements for interview in embassy. Can i bring my Certification/Entry of Judgment, Decision, and annotated marriage certificate from the civil registrar? I am just confuse about the decree of annulment? I do not know if its the same the decision and decree of annulment.

    I do not think so my case is done, because in my desicion i need to file custody and support of my son. So i can get the decree of annulment in court. Am i rght? I know its not supposed to ask this, but i wanted to know what are the steps and procedure?

    When can i get my Decree of Nullity? I went to Local Civil Registrar to file they i need to waith 3 weeks and call back to fallow up. What is next step? Can i get my Decree of Nullity even i have stil "Entry of Judgement to file motion for custody support of my son."

    Please help what i am going to do.

    I would like to ask I got my decision last Feb. 2013 and its granted. In last paragraph it said :

    " Meanwhile, in accordance with Section 21 of the rules on Declaration of Absolute Nullity of Void Marriage and the Annulment of Voidable Marriage, upon Entry of Judgement of the Appellate Court, the Court on motion shall proceed with petitioner's prayer for custody and support of my son.

    SO ORDEREE."

    and that the same become final and executory.

    The Court gave me a Certification/Entry of Judgement, then i file to LCR Pasig (Local Civil Registrar) to registered, the LCR gave me a Certification and Certificate of Authenticity. The LCR said file this to LCR in Manila were i have marriage there. The LCR Manila said call after 3 weeks to fallow-up.

    My question are:

    1.How come the LCR Manila took 3 weeks to fallow-up? What documents they will give it to me? and what is next procedure?

    2. Is the Certification that gave from LCR Pasig is a Certification of Registration?

    3. The Certification/Entry of Judgement is a Certificate Finality?

    4. The Decision is a Decree of Annulment?

    5. Or do i need to file motion custody support first before i get my Decree of Annulment?

    6. What are the consequences if a file motion custody support? My son is 16 now, he live with his grandparent and support him.

    7. If i file motion custody support mean i need to get my son with his grandparent and live with me? I do not have money to support him but i can buy a little what he needs (like clothes, food, school micellaneus, and i visit him holidays, weekends, spend few days in my parents) I do not have permanent house i live ony at boarding house.

    8. What should i file Sole, of Joint custody which i can not provide support? and his father has no job.

    9. If i file custody support can i inclued his grandparent support and do they need to attend hearing (grandparent and my ex) with the lawyer. If it not respond in motion what happen next?

    I thought my annulment is done, but the court clerk said it is not. Because i ask them can i request for Decree of Annulment and it said you have to file motion custody support.

    Please help me and advise what i am going to do, and step/procedure. I am stressed out. My lawyer doesnt make sense every time i talk him. Please help.

Meanwhile in accordance with section 21 of the rules on declararion of absolute nullity of void marriage and annulemnt of voidable marriage, upon entry of judgement of the appellate court, the court on motion shall proceed with the petitionre's prayers for my son.
