  1. The long back ground is this. I, the petitioner for the I-129f K1 visa am in the US and want to bring my Filipino fiance to the US. She is working legally in HK so is going to HK consulate. We started the visa process in 2013 and withdrew it after finding out her marriage many years ago was legally recorded. After finding out that the CENOMAR would not be acceptable we withdrew the visa petition(s) .She has since obtained a divorce in Hong Kong. The former husband is not disputing or fighting any divorce or annulment procedure. The annulment process was begun 12/2013 and is ongoing, with a minimum of 2 more court appearances and at least 4-8 more months.

    We have begun a second K1 visa, I have NOA2 and she has (after NVC) received papers from HK consulate I know that the US web site says that all Filipino citizens must have annulment for CENOMAR approval of visa. Some acquaintances in the exact same situation have recently gotten approval (last 6 months) with only a divorce certificate. We don't want to jeopardize the visa process, but of course, want her here soon as possible.

    Does anyone know if this will be approved with Phillipine CENOMAR recorded as marriage with the divorce certificate presented?

    IF NOT:

    In some cases cited on VJ when other types of paperwork are missing, the approval is granted and visa is issued upon submittal of necessary paperwork. Is it possible in this case that approval may be granted and visa issued later upon CENOMAR presented after annulment?

    I could ask an attorney but feel that I will get only the correct legal answers.

  2. yes, correct responses, the I129f form states it is to be used by people free to marry. She hid that from me, thinking that it was maybe not recorded. Now that we know that, we have lost 7 months, over $400 and lessened my chances of approval for another 129f. Yes, she was married about 25 years ago, marriage union ended in separation, nothing was done about the legality of it, she is still married, her husband is a bigamist.

  3. Our I129f petition has made it to the HK consulate (where Pinay beneficiary is). She has received the papers and it is time for me, petitioner, to respond with the electronic submission of the Cenomar from the Phil. NSO sent to US HK Consul. I just became aware that she is married. She didn't think that the marriage at the church was recorded about 25 years ago, but it is on the NSO records. The marriage lasted only a couple years and he is remarried. Annulment should not be a problem, except for cost. I do know that annulment may be the only option. But I don't know the length of time I have to reply to the HK consulate, I don't know if I can be granted an ext., I don't know my options.

  4. Yes, I have learned that the entire process is sometimes slow, not fair and sometimes applications not treated equally. But here in the USA you do have a right to complain about it, you will not disappear. You have a process to suggest changes.

    How many other countries in the world would you like to emigrate to? How many will even give you a chance or want you? There were many K1 applications to the CSC in March and April which slowed the entire USCIS, NVC system down. Plus USCIS had many more non K1 applications because of the expected amnesty. They deal with millions every year.

  5. Our noa2 was Sept 5. The NVC finally got ours, gave us a number Oct 17, exactly 6 weeks. I have been tracking similar timelines and see some not been received from end of Aug.

    I don't think calling NVC speeds up your case, but it will finally tell you when NVC received.

    The story is this............. NVC says it hasn't received your case..........USCIS says it was sent out on ___. Who do you believe? I am inclined to believe that USCIS does send them out on the same day as noa2 or soon after. The NVC is backlogged at present (that is what one nvc represenative person told me). So I think the NVC has them and doesn't work on them right away. Unfortunately, they don't take them in any order. CSC cases take a long time, but if it goes thru VSC or TSC it may be accepted in 2 days! This is certainly an unfair situation and we can't do anything about it. I searched similar cases to ours and found that the NVC was only taking 2 days (from noa2 to acceptance) at the beginning of the year, and as this year progressed the time went to 14 days and now to 8 or more weeks. There were a lot of K1 applicants in March and April. Also USCIS was working on a higher number of other type cases from the expected amnesty.

    But we can be thankful and appreciative that the US is somewhat open about it's policies and does hold open arms to immigrants from most countries. There are very few countries in the world who do this. So when you get here, please don't try to make us over into your religion (as in Dearborn, Mi) or try to change our customs or laws to fit into the way you were brought up. May God bless the USA.

  6. The nvc is just now working on 8/27-29 time periods. I have been trying to follow similar timelines. Should be any day now. Ours is 9/05. Many of us had to wait much longer because of a high number of applicants in March and April , also the USCIS was working on other things because of Obama's unconstitutional changes and the expected passing of the so called amnesty bill, which should be called cheaper labor for American farmers

  7. I did the same thing, I had also done much reading on the USCIS website. I was unaware of VisaJourney or other help sites. I sent in the info it asked for on the I-129f form. I never saw any instructions and didn't look for any...........seemed pretty straight forward to me. If they want all this information it should be mentioned on the form. I did call them up after acceptance to ask if I should send in more paperwork and they replied that I should not. According to the USCIS website when the application is received it is checked for completeness and accuracy. ???? My fiance had to send some passport photos and other signed papers, another mistake we made was using the SLOW standard mail. So you are not stupid. We just wait longer. God's blessings to you.
